Federal Judge Finds Idaho “Ag Gag” Law Unconstitutional
In a much anticipated decision from the United States District Court for the District of Idaho, Idaho Code Section 18-7042, which is commonly referred to as an “ag gag law” (hereinafter “the Statute”) has been deemed unconstitutional, specifically violating the Free Speech Clause of the First Amendment and the Equal Protection Clause of the Fourteenth Amendment. Spring is in the air! Hope you are all enjoying some warmer temperatures, and hopefully, some rain! Here are some of the ag law stories in the news this week. *Briscoe County Will Not Become Part of High Plains Water District. Despite a TCEQ recommendation that the High Plains Water District annex Briscoe County under its jurisdiction, the District Board voted unanimously not to do so last week. I spent a good part of this week at county Farm Bureau meetings visiting with Texas agricultural producers. Idaho Judge Allows “Ag Gag” Lawsuit to Move Forward
Judge B. Lynn Winmill, Chief Judge of the United States District Court for the District of Idaho has denied a motion to dismiss a federal lawsuit challenging the constitutionality of the Idaho Interference with Agricultural Production statute, known as the “ag gag” statute. This week I was literally all across the state of Texas at various programs. From Monahans discussing oil and gas leasing, pipeline easement negotiations, and water law, to Caldwell speaking on groundwater ownership, to Diboll discussing eminent domain and pipeline easements for forest landowners, to Corrigan on Friday discussing grazing leases, water law, and generational transfer.
