FPL Farming LTD.,<\/em>\u00a0a landmark case involving the intersection of oil and gas production and private property rights.\u00a0 The question facing the court is whether trespass can occur nearly 1 mile underground when waste water from oil production that is disposed of in an injection\u00a0well migrates\u00a0under the property of another landowner. \u00a0If you are interested,\u00a0you may\u00a0<a href=\"http:\/\/www.texasbarcle.com\/CLE\/TSC.asp\">watch the argument\u00a0online<\/a>.<\/p>\n<p style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>Factual Background<\/strong><\/span><\/p>\n<p style=\"text-align: left;\">\u00a0In 1997, Environmental Processing Systems (&#8220;EPS&#8221;), a disposal company,\u00a0drilled a deep subsurface waste water\u00a0injection well on its property, located about 400 feet from F.P.L. Farming&#8217;s (&#8220;Farming&#8217;s&#8221;)\u00a0property, which is used for rice farming.\u00a0 In the past 17 years, EPS has disposed of over 100 million gallons of waste water in the well at a depth of approximately 7,000 feet.\u00a0 During the permitting process for the well, EPS admitted that the waste water injected into the well may reach the subsurface water beneath Farming&#8217;s property within about 10 years.\u00a0 Farming filed suit claiming that the waste water injected by EPS has migrated under Farming&#8217;s land into a deep saltwater aquifer and\u00a0this migration constitutes trespassing, for which it should be compensated by EPS.<\/p>\n<p style=\"text-align: left;\"><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2014\/01\/disposal-well.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-1081 aligncenter\" alt=\"\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2014\/01\/disposal-well-300x235.jpg\" width=\"300\" height=\"235\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2014\/01\/disposal-well-300x235.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2014\/01\/disposal-well-1024x804.jpg 1024w, https:\/\/agrilife.org\/texasaglaw\/files\/2014\/01\/disposal-well.jpg 1621w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>Procedural Background<\/strong><\/span><\/p>\n<p style=\"text-align: left;\">This case has a long, complex procedural history.\u00a0 \u00a0In the Liberty County Court, the case was tried to a jury that found in favor of EPS, concluding that no trespassing occurred.\u00a0 Farming appealed, and the Beaumont Court of Appeals affirmed, holding that there could be no trespassing claim because EPS held a valid permit for disposal from the Texas Commission on Environmental Quality.\u00a0 Farming appealed again, this time to the Texas Supreme Court.\u00a0 In 2011, the Supreme Court found for Farming, holding that the mere fact that EPS held a valid permit did not, alone, prevent a trespass claim.\u00a0 The\u00a0Supreme Court, however, did not address the question of whether a cause of action for trespassing existed under these circumstances.\u00a0 Thus, the court reversed and remanded the case back to the Court of Appeals to determine whether a trespass did occur despite the valid TCEQ permit.<\/p>\n<p style=\"text-align: left;\">In September 2012, the Beaumont Court of Appeals found for Farming, holding that subsurface waste water migration did constitute actionable trespass.\u00a0&#8220;We conclude that Texas law recognizes Farming&#8217;s property interest in the briny water underneath its property.\u00a0 We do not agree with EPS that no trespass action exists under Texas law to protect Farmings&#8217; legal interest to its property.&#8221;\u00a0 From this decision, EPS appealed to the Texas Supreme Court.<\/p>\n<p style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>Trespass Law in Texas<\/strong><\/span><\/p>\n<p style=\"text-align: left;\">In Texas, trespassing occurs when a person, not having title to the land, makes entry thereon without the consent of the landowner.\u00a0 In order to constitute a trespass, the entry need not be of a person, but trespassing can occur by allowing a thing to cross the boundary of the premises.<\/p>\n<p style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>Arguments of the Parties<\/strong><\/span><\/p>\n<p><em><span style=\"text-decoration: underline;\">EPS&#8217; Arguments:<\/span>\u00a0<\/em> EPS centers\u00a0its argument on the prior Texas Supreme Court decision in <em>Coastal Oil &amp; Gas Corp. v. Garza Energy Trust<\/em>, which found that a horizontal well drilled on one property that utilized fracking, which extended onto another property and drained a well underneath that property did not constitute a trespass.\u00a0 The Court reasoned that because oil and gas law is governed by the Rule of Capture, neighboring owners were barred from recovering royalties on gas that they allegedly lost due to horizontal drilling.\u00a0 EPS argues that the same reasoning should be applicable\u00a0to disposal waste water.\u00a0 Further, EPS points to the Supreme Court&#8217;s statement in\u00a0<em>Coastal<\/em> that &#8220;the ancient common law maxim that\u00a0land ownership extends to the sky above and the earth&#8217;s center below&#8230;has no place in the modern world.&#8221;\u00a0EPS also relies upon the 1962 decision in\u00a0<em>R.R. Comm&#8217;n of Texas v. Manziel<\/em>, which found that no trespass occurred when waters from a secondary recovery project migrated to the property of another below the surface.<\/p>\n<p>Finally, \u00a0EPS argues that Farming has suffered no damage, as the disposal water has not adversely\u00a0impacted any farming activity and EPS has not sought to use the saltwater at issue.\u00a0 EPS also points out that were the Supreme Court to recognize a cause of action for subsurface trespass, it would be the first court in the country to do so.\u00a0 EPS cites to cases from Ohio, Oklahoma, and Louisiana that have all rejected subsurface trespass claims involving oil and gas production.\u00a0 [Read EPS Opening Brief <a href=\"https:\/\/www.search.txcourts.gov\/SearchMedia.aspx?MediaVersionID=b8f5ed67-6c00-4369-a21e-854ca53310df&amp;coa=cossup&amp;DT=BRIEFS&amp;MediaID=74eeb906-0621-4c95-9868-08cce5881762\">here<\/a>.]<\/p>\n<p><span style=\"text-decoration: underline;\"><em>Farming&#8217;s Arguments:<\/em><\/span><em>\u00a0 <\/em>Farming&#8217;s primary argument is based upon the premise that a property owner owns his land to the center of the earth, a\u00a0historic legal maxim.\u00a0 Farming\u00a0also significantly relies upon the Texas Supreme Court decision in <em>Edwards Aquifer Authority v. Day<\/em>, which found that\u00a0overlying property owners own the groundwater in place\u00a0beneath the surface.\u00a0 Farming attempts to distinguish the <em>Coastal <\/em>and <em>Manziel<\/em> cases on the grounds that both of those cases involved the production of oil and gas, to which the Rule of Capture applies, as opposed to this instance which does not involve production, but merely disposal of waste water.\u00a0 This distinction is important, argues Farming, because when dealing with oil production, a landowner whose well is being drained has the option of drilling another well to prevent the drainage, the theory upon which the Rule of Capture is based.\u00a0 The same is not true for a landowner who faces migration of waste water from a disposal well.<\/p>\n<p>Farming also argues that because of the toxic substances in the waste water, the migration into the water beneath its property has damaged the water.\u00a0 Although Farming admits that the water in the aquifer where the waste water is injected is too salty to drink and that it has not sought to use the water to date, it points to improvements in desalination techniques that could make this water drinkable in the future and argues that the contamination from the waste water could render the water below its property unusable when it otherwise would have been because of potential desalination technology.<\/p>\n<p>Finally, Farming argues that EPS benefits financially from disposing water, and that it should bear the burden of purchasing or leasing the property under which the water will be stored, pointing out that nothing would prohibit EPS from obtaining a subsurface lease from neighboring landowners to avoid trespass claims.\u00a0 [Read Farming&#8217;s Response Brief <a href=\"https:\/\/www.search.txcourts.gov\/SearchMedia.aspx?MediaVersionID=b8f5ed67-6c00-4369-a21e-854ca53310df&amp;coa=cossup&amp;DT=BRIEFS&amp;MediaID=74eeb906-0621-4c95-9868-08cce5881762\">here<\/a>.]<\/p>\n<p><span style=\"text-decoration: underline;\"><em>Amicus <\/em><em>Curiae<\/em><\/span><em><span style=\"text-decoration: underline;\"> Arguments<\/span>:<\/em>\u00a0 Several additional organizations have\u00a0 filed <em>amicus curiae<\/em> (&#8220;friend of the court&#8221;) briefs in this case as well. \u00a0For example, the Texas Oil and Gas Association argues that because the ability to produce oil and gas is tied to the ability to utilize disposal wells, a decision recognizing a trespass cause of action in this circumstance would likely threaten oil and gas production in the state.\u00a0 [Read TOGA\u00a0Brief <a href=\"https:\/\/www.search.txcourts.gov\/SearchMedia.aspx?MediaVersionID=1d573385-41f4-418d-98b2-ea20459600db&amp;coa=cossup&amp;DT=BRIEFS&amp;MediaID=4aa85fad-e1b9-4128-99ad-4427f01767ca\">here<\/a>.]\u00a0On the other hand, the Texas Farm Bureau argues that landowners enjoy the right to\u00a0exclusive possession of their property, including the right to exclude others from that property.\u00a0 [Read TFB Brief <a href=\"https:\/\/www.search.txcourts.gov\/SearchMedia.aspx?MediaVersionID=60ad15f6-4554-4185-9409-fe03f75aa100&amp;coa=cossup&amp;DT=BRIEFS&amp;MediaID=c473e298-c0f6-4ce9-95b9-d1dde4e65ba5\">here<\/a>.]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>*This article is not a substitute for the advice of an attorney.* On Tuesday, the Texas Supreme Court will hear oral arguments in Environmental Processing Systems, L.C. v.
