{"id":957,"date":"2013-12-10T11:05:32","date_gmt":"2013-12-10T17:05:32","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=957"},"modified":"2026-04-17T15:35:33","modified_gmt":"2026-04-17T20:35:33","slug":"duke-energy-pleads-guilty-to-bird-deaths-caused-by-wind-turbines","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2013\/12\/10\/duke-energy-pleads-guilty-to-bird-deaths-caused-by-wind-turbines\/","title":{"rendered":"Duke Energy Pleads Guilty to Bird Deaths Caused by Wind Turbines"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"color: #800000;\">**This article is not a substitute for the advice of an attorney.**<\/span><\/p>\n<p>Duke Energy Corp. recently pled guilty under the Migratory Bird Treaty Act\u00a0to killing eagles and other birds at two Wyoming wind farms.\u00a0 Specifically, the company pled guilty to killing 14 eagles and 149 other birds at its wind farms located outside of Casper from 2009 to 2013.\u00a0 This case\u00a0marked the first prosecution by the United States\u00a0Department of Justice\u00a0of a wind energy company for bird deaths pursuant to the <a href=\"http:\/\/www.fws.gov\/migratorybirds\/regulationspolicies\/mbta\/mbtintro.html\">Migratory Bird Treaty Act<\/a>, passed in 1918, which makes the killing of over 1,000 species of birds a federal offense.<\/p>\n<div id=\"attachment_960\" style=\"width: 310px\" class=\"wp-caption aligncenter\"><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/12\/41130_1519412339049_90251_n.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-960\" class=\"size-medium wp-image-960 \" alt=\"\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/12\/41130_1519412339049_90251_n-300x225.jpg\" width=\"300\" height=\"225\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2013\/12\/41130_1519412339049_90251_n-300x225.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2013\/12\/41130_1519412339049_90251_n.jpg 720w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><p id=\"caption-attachment-960\" class=\"wp-caption-text\">Photo via Rusty Dowell, Clovis, NM<\/p><\/div>\n<p>As part of the plea, Duke agreed to pay a $1 million fine\u00a0for violating the Act and will be on five years probation.\u00a0 Additionally, the company will continue to use field biologists to identify eagles and shut down wind turbines when eagles are close by.\u00a0 Duke will also install new radar technology to assist in identifying birds and will report all bird deaths to the government.\u00a0 Finally, Duke will apply for a federal &#8220;eagle take permit&#8221;
