{"id":9389,"date":"2020-11-20T11:07:15","date_gmt":"2020-11-20T17:07:15","guid":{"rendered":"https:\/\/agrilife.org\/texasaglaw\/?p=9389"},"modified":"2026-04-17T15:18:20","modified_gmt":"2026-04-17T20:18:20","slug":"november-20-2020-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2020\/11\/20\/november-20-2020-weekly-round-up\/","title":{"rendered":"November 20, 2020 Weekly Round Up"},"content":{"rendered":"<p>Happy Friday and Happy Thanksgiving to you all next week.\u00a0 Here are a few of the ag law stories in the news over the past couple of weeks.\u00a0 As you will see, there has been lots going on!<\/p>\n<p>*<strong>Appellate court affirms liability for compensatory and punitive damages in NC hog farm nuisance cases; Smithfield announces\u00a0<\/strong><b>settlement<\/b>.\u00a0 Major developments happened at the end of this week in the nuisance lawsuits in North Carolina filed against Smithfield subsidiary, Murphy Brown.\u00a0 First, the US Court of Appeals for the Fourth Circuit issued an opinion in which it affirmed the juries findings of liability for compensatory and punitive damages, but vacated and remanded the amount of the punitive damage awards.\u00a0 [Read <a href=\"https:\/\/agrilife.org\/texasaglaw\/files\/2020\/11\/Opinion-here.pdf\">Opinion here<\/a>.]\u00a0 Shortly after this decision was released, Smithfield announced the parties reached a settlement in the cases. [Read <a href=\"https:\/\/www.usnews.com\/news\/business\/articles\/2020-11-19\/court-upholds-nuisance-verdicts-against-hog-production-giant\">article here<\/a>.]\u00a0 I&#8217;ll have a blog post on this coming out soon, once I&#8217;ve had time to thoroughly read the 144-page opinion from the Fourth Circuit.<\/p>\n<p><strong>*FMCSA announces Interim Final Rule &#8220;Hours of Service Drivers; Definition of Agricultural Commodity.&#8221;\u00a0<\/strong>The FMCSA has issued a new Interim Final Rule defining several terms related to agriculture as they apply to the Agency&#8217;s Hours of Service of Drivers regulations.\u00a0 Once published in the Federal Register, the Interim Final Rule will be open for comment for 30 days. [Read Interim Final Rule <a href=\"https:\/\/www.fmcsa.dot.gov\/sites\/fmcsa.dot.gov\/files\/2020-11\/FMC-P-200324-001%20HOS%20Ag%20Commodity%20IFR%20111720%20%28OST%20Approved%29%20-%20WD%20Signed.pdf\">here<\/a>.]\u00a0 \u00a0I&#8217;ll have more details in a forthcoming blog post on this as well.<\/p>\n<p>*<strong>Plains Cotton Growers &amp; American Soybean Association file lawsuit challenging new dicamba label restrictions.<\/strong>\u00a0 You may recall from this prior blog post that the EPA recently registered three dicamba pesticides for over-the-top use in soybeans and cotton through 2025.\u00a0 This registration contained new labeling requirements discussed in detail in that blog post, including nationwide cutoff dates and additional buffer requirements.\u00a0 In response to these new labeling requirements, Plains Cotton Growers and the American Soybean Association filed suit against the EPA challenging the new registration.\u00a0 [View Complaint <a href=\"https:\/\/www.epa.gov\/sites\/production\/files\/2020-11\/documents\/american_soybean_assoc_complaint.pdf\">here<\/a>.]In particular, the plaintiffs claim that the additional restrictions are arbitrary and capricious and exceed the EPA&#8217;s authority under FIFRA and the Endangered Species Act.\u00a0 To read a summary of the lawsuit from the National Ag Law Center&#8217;s Brigit Rollins, <a href=\"https:\/\/nationalaglawcenter.org\/the-deal-with-dicamba-lawsuit-challenges-registration-epa-changes-fifra-policy\/\">click here.<\/a><\/p>\n<div id=\"attachment_9432\" style=\"width: 650px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-9432\" class=\"size-large wp-image-9432\" src=\"https:\/\/agrilife.org\/texasaglaw\/files\/2020\/11\/8241853472_93d474041b_k-1024x681.jpg\" alt=\"\" width=\"640\" height=\"426\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2020\/11\/8241853472_93d474041b_k-1024x681.jpg 1024w, https:\/\/agrilife.org\/texasaglaw\/files\/2020\/11\/8241853472_93d474041b_k-300x200.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2020\/11\/8241853472_93d474041b_k-768x511.jpg 768w, https:\/\/agrilife.org\/texasaglaw\/files\/2020\/11\/8241853472_93d474041b_k-1536x1022.jpg 1536w, https:\/\/agrilife.org\/texasaglaw\/files\/2020\/11\/8241853472_93d474041b_k.jpg 2048w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><p id=\"caption-attachment-9432\" class=\"wp-caption-text\"><em>TAMU AgriLife photo by Kathleen Phillips<\/em><\/p><\/div>\n<p><strong>*FSA reverses earlier rule change defining actively engaged in farming.\u00a0 <\/strong>Earlier this year, the USDA issued a rule related to requirements to qualify as actively engaged in a farming operation, which made family farm operations subject to stricter guidelines that had previously been applicable to non-family operations under the 2018 farm bill. This week, the FSA restored the previous definitions to essentially negate the rule change.\u00a0 In a statement on this reversal, FSA Administrator, Richard Fordyce, explained that it was neither the intent of FSA nor Congress to bring family farm entities under the more stringent provisions.\u00a0 [Read article <a href=\"https:\/\/www.dtnpf.com\/agriculture\/web\/ag\/news\/world-policy\/article\/2020\/11\/19\/agency-reverses-earlier-rule-active?referrer=twitter#.X7aMwYfQPoQ.twitter\">here<\/a>.]<\/p>\n<p><strong>*Ninth Circuit Court of Appeals hears argument in <em>Sackett v. EPA<\/em>.\u00a0<\/strong>The US Court of Appeals for the Ninth Circuit heard argument this week on a Clean Water Act case that has been ongoing for over 8 years and has already been to the US Supreme Court and back. The case is currently at the Ninth Circuit on issues of mootness when the EPA has stated it will not &#8220;take further action for now&#8221; against the Sacketts and the court raised the question of whether the Trump administration&#8217;s Navigable Waters Protection Rule renders moot the EPA&#8217;s determination that the Sackett&#8217;s property was jurisdictional.\u00a0 [Read article <a href=\"https:\/\/news.bloomberglaw.com\/us-law-week\/wetlands-legal-saga-reaches-ninth-circuit-again-a-decade-later\">here<\/a>.]<\/p>\n<p><strong>*Farmers Legal Action Group publishes CFAP2 Guide.<\/strong>\u00a0 The deadline for producers to sign up for the\u00a0 second round of the Coronavirus Food Assistance Program (CFAP 2) is December 11. If you are a producer and have not yet done so, the Farmers Legal Action Group published a great guide walking through the provisions of the CFAP 2 program.
