{"id":9103,"date":"2020-09-11T01:28:58","date_gmt":"2020-09-11T06:28:58","guid":{"rendered":"https:\/\/agrilife.org\/texasaglaw\/?p=9103"},"modified":"2026-04-17T15:18:34","modified_gmt":"2026-04-17T20:18:34","slug":"september-11-2020-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2020\/09\/11\/september-11-2020-weekly-round-up\/","title":{"rendered":"September 11, 2020 Weekly Round Up"},"content":{"rendered":"<p>Happy Friday!\u00a0 We&#8217;ve had quite the cold snap come through the Texas Panhandle this week&#8211;when I was feeding on Wednesday morning, it was a brisk 36 degrees!\u00a0 Here&#8217;s wishing everyone a big of a warmer weekend.<\/p>\n<p>Here are some of the ag law stories over the past couple of weeks.<\/p>\n<p><strong>*Court dismisses western cattle groups lawsuits against NWPR Rule.<\/strong>\u00a0 An Oregon federal court has dismissed a lawsuit filed by the Oregon Cattlemen&#8217;s Association, Washington Cattlemen&#8217;s Association and New Mexico Cattle Growers Association challenging the Navigable Waters Protection Rule, the Trump Administrations new definition of &#8220;waters of the United States&#8221; with regard to the Clean Water Act.\u00a0 In particular, the plaintiff groups believed that the NWPR definition, despite being narrower than the prior WOTUS definition, was too broadly written.\u00a0 The judge dismissed the case without prejudice for lack of standing, finding a lack of evidence that the members of the plaintiff groups were affected by the NWPR definition.\u00a0 Dismissal without prejudice will allow the parties to re-file with additional detail to show sufficient evidence of standing should they wish to do so.\u00a0 [Read article <a href=\"https:\/\/news.bloomberglaw.com\/environment-and-energy\/federal-court-dismisses-trump-water-rule-challenge-in-oregon\">here<\/a>.]<\/p>\n<div id=\"attachment_9135\" style=\"width: 810px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-9135\" class=\"size-full wp-image-9135\" src=\"https:\/\/agrilife.org\/texasaglaw\/files\/2020\/09\/17412400785_474c7d8654_c.jpg\" alt=\"\" width=\"800\" height=\"659\" data-wp-editing=\"1\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2020\/09\/17412400785_474c7d8654_c.jpg 800w, https:\/\/agrilife.org\/texasaglaw\/files\/2020\/09\/17412400785_474c7d8654_c-300x247.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2020\/09\/17412400785_474c7d8654_c-768x633.jpg 768w\" sizes=\"auto, (max-width: 800px) 100vw, 800px\" \/><p id=\"caption-attachment-9135\" class=\"wp-caption-text\"><em>TAMU AgriLife photo by Kay Ledbetter<\/em><\/p><\/div>\n<p><strong>*NM court dismisses lawsuits against beef packers.<\/strong>\u00a0 A New Mexico federal court has dismissed a pair of lawsuits filed against the &#8220;Big 4&#8221; beef packers, Tyson Foods, JBS USDA, Cargill, and NBP.\u00a0 The plaintiffs have appealed this decision to the United States Court of Appeals for the Tenth Circuit.\u00a0 The lawsuits, one filed by a producer and one by a consumer, challenged the use of the &#8220;Product of the USA&#8221; label, arguing that it misleads consumers because it is accepted even if the animal was raised and harvested in another country.\u00a0 The federal district judge granted the motion to dismiss, finding that the federal labeling law and approval by the USDA of these label supersedes state laws related to consumer protection.\u00a0 The dismissal in this case was made with prejudice, meaning they may not be refiled unless overturned on appeal.\u00a0 [Read article <a href=\"https:\/\/www.drovers.com\/article\/nm-judge-rejects-cool-lawsuit?fbclid=IwAR3CiNNorFLmA5U7GKWqL-RZ7bkIeilfHFK5Vw10YMZ7wU2C_LBpV--9zQw\">here<\/a>.]<\/p>\n<p><strong>*Good advice for property owners facing eminent domain.<\/strong>\u00a0 My friend and Texas eminent domain attorney, Luke Ellis, recently wrote an article offering great advice to landowners potentially facing condemnation.\u00a0 While the article specifically focuses on the TxDOT 620 expansion near Austin, he offers tips applicable to landowners facing eminent domain in any context.\u00a0 [Read article <a href=\"https:\/\/bit.ly\/31SoBy4\">here<\/a>.]<\/p>\n<p><strong>*Bloomberg article on Right to Farm case seeking SCOTUS review.<\/strong>\u00a0 There is an interesting Bloomberg News article discussing\u00a0<em>Himsel v. Himsel<\/em>, the Indiana nuisance case that was dismissed pursuant to the state&#8217;s Right to Farm Act and in which the plaintiffs are now seeking review before the United States Supreme Court. [Read article <a href=\"https:\/\/www.theindianalawyer.com\/articles\/farm-feud-cafo-challenge-turns-to-u-s-supreme-court\">here<\/a>.]<\/p>\n<p><strong>*Hemp fiber processing facility to be built in Wichita Falls, TX.<\/strong>\u00a0 Panda Biotech has announced it intends to build the &#8220;largest and most state-of-the-art hemp processing center in the United States&#8221; in Wichita Falls, Texas.\u00a0 The Panda Texas Plains Hemp Gin will be built on the grounds of the former General Motors Delphi assembly plant.
