{"id":909,"date":"2013-12-02T08:00:29","date_gmt":"2013-12-02T14:00:29","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=909"},"modified":"2026-04-17T15:35:33","modified_gmt":"2026-04-17T20:35:33","slug":"questions-from-tiffanys-desk-if-i-die-without-a-will","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2013\/12\/02\/questions-from-tiffanys-desk-if-i-die-without-a-will\/","title":{"rendered":"Questions from Tiffany&#8217;s Desk:  If I Die Without a Will&#8230;"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"color: #993300;\">**This article is not a substitute for the advice of an attorney.**<\/span><\/p>\n<p><strong>Question:<\/strong>\u00a0 I don&#8217;t need a will.\u00a0 If I die without a will, don&#8217;t all of my assets just\u00a0go to my spouse?<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-915 aligncenter\" alt=\"funeral\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/11\/funeral-201x300.jpg\" width=\"201\" height=\"300\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2013\/11\/funeral-201x300.jpg 201w, https:\/\/agrilife.org\/texasaglaw\/files\/2013\/11\/funeral.jpg 644w\" sizes=\"auto, (max-width: 201px) 100vw, 201px\" \/><\/p>\n<p><span style=\"text-decoration: underline;\"><strong>Answer:<\/strong><\/span>\u00a0 <strong>No!\u00a0<\/strong> Let me repeat myself because this is important.\u00a0 <span style=\"text-decoration: underline;\"><strong>No!<\/strong><\/span>\u00a0 This is a common misconception that can lead to serious family problems down the road.<\/p>\n<p>If a person dies without a will, every state has statutes (called &#8220;intestate succession statutes&#8221;)\u00a0that control the distribution of that person&#8217;s estate.\u00a0 (Importantly, not all assets pass through an estate.\u00a0 Life insurance policies for\u00a0which a beneficiary is named or accounts held in joint tenancy are examples of assets that would pass via those contracts and would not be subject to intestate succession statutes.)\u00a0 Essentially, if a person dies without directing how\u00a0his or her\u00a0estate should be distributed, the state&#8217;s legislature will decide for the deceased person by statute.\u00a0 These statutes can be complex and may lead to results the decedent never would have foreseen or desired. This is not surprising given the fact that family relationships and dynamics differ greatly for each person, yet when a person\u00a0dies without a will, the same statutory standards apply to everyone.<\/p>\n<p>Here are links to versions of the intestate succession statutes in <a href=\"http:\/\/codes.lp.findlaw.com\/txstatutes\/PB\/II\/38\">Texas<\/a>, <a href=\"http:\/\/statutes.laws.com\/new-mexico\/chapter-45\/article-2\">New Mexico<\/a>, and <a href=\"http:\/\/www.oscn.net\/applications\/oscn\/DeliverDocument.asp?CiteID=73029\">Oklahoma<\/a>.\u00a0 If anyone needs the link to an intestate succession statute in another state, please feel free to contact me, and I will be happy to provide that information for you.<\/p>\n<p>Furthermore, going\u00a0estates distributed by intestate statutes\u00a0will likely cause the probate process to be more expensive and time consuming.\u00a0\u00a0An administrator appointed by the court will be forced to spend time and money searching for all possible heirs who will be entitled to inherit under the statute.<\/p>\n<p><strong><span style=\"text-decoration: underline;\">A Few Examples<\/span>:\u00a0 <\/strong>In order to help explain how intestate succession statutes work (and to encourage everyone reading this to draft a will rather than rely upon these statues), here are a few sample scenarios.<\/p>\n<p>Let&#8217;s suppose that a husband dies without a will in Texas.\u00a0 All of his property does not go to his wife.\u00a0 Instead, the following will occur based upon the Texas instate succession statute.<\/p>\n<p>If the husband was married with no children, his wife would get all of the community property, all of the separate property, but only 1\/2 of the separate real property.\u00a0 The other 1\/2 of the separate real property would be given to the husband&#8217;s parents in equal shares.\u00a0\u00a0\u00a0 Here is an example of how this could play out:\u00a0 Suppose that the husband inherited a ranch from his grandfather.\u00a0 That ranch would be separate\u00a0real property.\u00a0 Under the intestate succession rules in Texas, his wife and in-laws would each own 1\/2 of the ranch.\u00a0 This could pose a problem if the wife did not get along well with her in-laws or if the decedent&#8217;s parents were estranged from each other.<\/p>\n<p>If the husband was married with children, his wife would get 1\/3 of the separate personal property and the children would get 2\/3.\u00a0 For the separate real property, his wife would get 1\/3 as a life estate and the ownership and remaining 2\/3 would go to his children.\u00a0 For his share of the community property, if the husband&#8217;s children are also the wife&#8217;s children, she gets all of the\u00a0community property.\u00a0 If, however, the children were step-children and not the wife&#8217;s children, the husband&#8217;s 1\/2 share of the community property would go to the children.\u00a0 Again, this could pose a serious problem\u00a0in certain families.\u00a0 Under this statute,\u00a01\/2\u00a0of a couple&#8217;s personal assets would be owned by the\u00a0surviving spouse&#8217;s step-children.\u00a0 In the event there was not a good relationship, this, too, could cause serious problems for the surviving family.<\/p>\n<p><strong><span style=\"text-decoration: underline;\">Take Away Message<\/span>:<\/strong>\u00a0 If you die without a will, your property does not all automatically go to your surviving spouse.\u00a0 It is extremely important to have a will that directs the disposition of your property upon your death.\u00a0 Without a will, intestate statutes will be applied to your estate and may cause\u00a0 not only undesired but disastrous results for the family that you leave behind.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>**This article is not a substitute for the advice of an attorney.** Question:\u00a0 I don&#8217;t need a will.\u00a0 If I die without a will, don&#8217;t all of my assets just\u00a0go to my spouse?
