{"id":8844,"date":"2020-06-12T13:28:57","date_gmt":"2020-06-12T18:28:57","guid":{"rendered":"https:\/\/agrilife.org\/texasaglaw\/?p=8844"},"modified":"2026-04-17T15:18:54","modified_gmt":"2026-04-17T20:18:54","slug":"june-12-2020-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2020\/06\/12\/june-12-2020-weekly-round-up\/","title":{"rendered":"June 12, 2020 Weekly Round Up"},"content":{"rendered":"<p>It has been a crazy couple of weeks in the ag law realm!\u00a0 Here is a quick recap of some of the major stories.<\/p>\n<div id=\"attachment_8887\" style=\"width: 809px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-8887\" class=\"wp-image-8887 size-full\" src=\"https:\/\/agrilife.org\/texasaglaw\/files\/2020\/06\/18876065613_4901bc97f1_c.jpg\" alt=\"\" width=\"799\" height=\"607\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2020\/06\/18876065613_4901bc97f1_c.jpg 799w, https:\/\/agrilife.org\/texasaglaw\/files\/2020\/06\/18876065613_4901bc97f1_c-300x228.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2020\/06\/18876065613_4901bc97f1_c-768x583.jpg 768w\" sizes=\"auto, (max-width: 799px) 100vw, 799px\" \/><p id=\"caption-attachment-8887\" class=\"wp-caption-text\"><em>TAMU AgriLife photo by Kay Ledbetter<\/em><\/p><\/div>\n<p><strong>* Dicamba, of course.<\/strong>\u00a0 This has been the story for agriculture over the past two weeks.\u00a0 As we discussed in <a href=\"https:\/\/agrilife.org\/texasaglaw\/2020\/06\/04\/us-court-of-appeals-for-the-ninth-circuit-vacates-dicamba-registration\/\">this blog post<\/a>, the US Court of Appeals for the Ninth Circuit vacated the federal registration for three products, Xtendimax, FeXapan, and Engenia.\u00a0 Then, a few days later, as we discussed in <a href=\"https:\/\/agrilife.org\/texasaglaw\/2020\/06\/09\/epa-issues-cancellation-order-for-3-dicamba-products-limited-existing-stocks-provision-included\/\">this blog post<\/a>, the EPA issued a Final Cancellation Order, which did contain certain existing stock provisions.\u00a0 Additionally, the Texas Department of Agriculture has requested a Section 18 exemption under the Federal Insecticide, Fungicide, and Rodenticide Act, which would allow for unregistered uses of the products if an emergency condition exists.\u00a0 [Read article <a href=\"https:\/\/www.towntalkradio.com\/texas-ag-commissioner-miller-to-request-dicamba-section-18-exemption-from-tda\/\">here<\/a>.]\u00a0 The most recent news is that late on Thursday, June 11, the plaintiffs filed an emergency motion with the Ninth Circuit arguing that EPA did not have the authority to issue a cancellation order, and the order that was issued violates the Court&#8217;s order.\u00a0 [Read motion <a href=\"https:\/\/www.centerforfoodsafety.org\/files\/2020-06-11-dkt-127-1-pets-emergency-motion-to-enforce-vacatur_34283.pdf\">here<\/a> and article <a href=\"https:\/\/www.dtnpf.com\/agriculture\/web\/ag\/crops\/article\/2020\/06\/12\/plaintiffs-ask-federal-court-halt?referrer=twitter#.XuNiFXfh6c8.twitter\">here<\/a>.]<span style=\"color: #ff0000;\"><span style=\"color: #000000;\">\u00a0 If you want to catch up on all of the dicamba details, be sure to listen <\/span><\/span>to my <a href=\"https:\/\/aglaw.libsyn.com\/episode-82-brigit-rollins-dicamba-litigation\">podcast with Brigit Rollins<\/a><span style=\"color: #ff0000;\"><span style=\"color: #000000;\"> from the National Ag Law Center, which we recorded and published yesterday.\u00a0<\/span><\/span><\/p>\n<p><strong>*Lawsuit related to Enlist also pending.<\/strong>\u00a0 Emily Unglesbee published an article yesterday pointing out that the same plaintiffs who brought the dicamba litigation have also filed suit in the US Court of Appeals for the Ninth Circuit related to Enlist.\u00a0 This case, which makes many similar claims to the dicamba litigation, is before a different-three judge panel in the Ninth Circuit.\u00a0 [Read article <a href=\"https:\/\/www.dtnpf.com\/agriculture\/web\/ag\/blogs\/production-blog\/blog-post\/2020\/06\/10\/enlist-duo-herbicide-also-scrutiny?referrer=twitter#.XuGLWkRvl5Q.twitter\">here<\/a>.]<\/p>\n<p><strong>* Litigation &amp; investigation against US meat packers.<\/strong>\u00a0 Over the last few months, there has been several announcements of lawsuits and investigations related to US beef packers.\u00a0 In the last couple of weeks, it was reported that the US Department of Justice has sent &#8220;civil investigative demands&#8221; to Tyson Foods, JBS SA, Cargill, and National Beef\/Marfrig. This is likely related to requests from attorneys general in several states that the DOJ look into potential anti-trust activities. [Read article <a href=\"https:\/\/www.tsln.com\/news\/asking-the-right-questions\/\">here<\/a>.]\u00a0 Additionally, this week Central Grocers filed a class action lawsuit against the same four packers alleging that the defendants conspired to constrain beef supplies since at least 2015.
