Colorado.<\/p>\n<p><strong>*\u00a0 Texas Comptroller Susan Combs Seeks Funding from Congress for Endangered Species Act Analysis.<\/strong>\u00a0 The Comptroller was in Washington, DC this week to pitch her idea that Congress create a $50 million\u00a0National Science Fund\u00a0to conduct independent research into animals proposed to be listed as endangered species, which would factor in the economic damage to communities when a species is designated under the Act.\u00a0 Combs points to the overwhelming number of potential listings facing the U.S. Fish and Wildlife Service as a main reason for needing this independent review fund.\u00a0 [Read article <a href=\"http:\/\/www.washingtontimes.com\/news\/2013\/nov\/11\/texas-calls-for-aid-from-washington-to-put-science\/?page=all\">here<\/a>.]<\/p>\n<p>*<strong>Lawsuit challenges Mora County, New Mexico&#8217;s fracking ban.\u00a0 <\/strong>As <a href=\"http:\/\/agrilife.org\/texasaglaw\/2013\/09\/12\/september-13-2013-weekly-round-up\/\">previously discussed on this blog<\/a>, Mora County, New Mexico, gained national attention when it became the first county in the United States to issue a complete ban on fracking.\u00a0 When the ban was enacted, the county understood that litigation was likely.\u00a0 This week, that likelihood became a reality as a lawsuit was filed in federal court challenging Mora County&#8217;s fracking ban.\u00a0 [Read\u00a0Complaint <a href=\"http:\/\/www.ipanm.org\/images\/library\/File\/IPANM%20Complaint.pdf\">here<\/a>.]\u00a0 The lawsuit was filed by the Independent Petroleum Association of New Mexico and\u00a0 three landowners who claim that the ban is unconstitutional and violates state laws.\u00a0 Specifically, the Complaint alleges that Mora County lacks the authority to pass this type of ban, that the ban\u00a0violates their\u00a0property and due process rights, and\u00a0that the ban violates their First Amendment rights.\u00a0 [Read article <a href=\"http:\/\/www.seattlepi.com\/business\/energy\/article\/Oil-and-gas-ban-spurs-lawsuit-in-NM-county-4981018.php\">here<\/a>.]<\/p>\n<p><strong>* Oklahoma Enforces Restrictions on Water Use.<\/strong>\u00a0 The Oklahoma Water Resources Board recently\u00a0approved an order limiting the amount of groundwater that may be withdrawn from the Arbuckle-Simpson Groundwater Basin, located in south-central Oklahoma.\u00a0 The Board reduced the maximum\u00a0annual groundwater withdraw from\u00a02\u00a0feet per acre to .2 feet per acre of land per year.\u00a0 [Read ruling <a href=\"http:\/\/www.owrb.ok.gov\/util\/rules\/arbucklesimpson_hearing.php\">here<\/a>.]\u00a0 Opponents of this limitation have appealed the Board&#8217;s decision to Oklahoma County District Court.\u00a0 [Read article <a href=\"http:\/\/www.theadanews.com\/local\/x2112909432\/Arbuckle-Simpson-fight-shifts-to-the-courtroom\">here<\/a>.]<\/p>\n<p><strong>*\u00a0 Wyoming Law Requires Groundwater Testing Near Oil Drilling Sites.<\/strong>\u00a0 The Wyoming Oil and Gas Conservation Commission approved a new ruel on Tuesday that will require oil and gas companies to test nearby water before and after drilling for minerals.\u00a0 [Read rule <a href=\"http:\/\/wogcc.state.wy.us\/downloads\/Groundwater_Baseline_Sampling_Analysis_Monitoring_Amended_Rule_110113.pdf\">here<\/a>.]\u00a0\u00a0 Under this rule, beginning March 1, 2014, industry operators will be required to test water quality once before drilling begins, again 36-48 months after drilling, and a third time 24 months after that.\u00a0 If the tests show an increase in any of the substances required to be tested for, the operators are required to notify both state officials as well as landowners in the area.\u00a0 The water required to be tested is that located within one-half mile of wellheads.\u00a0 [Read article <a 100vw, 300px\" \/><\/a><\/p>\n<p><strong>*\u00a0 Colorado Cantaloupe Farmers Reach Plea Deal, Sue Auditor.<\/strong>\u00a0 This <a href=\"http:\/\/agrilife.org\/texasaglaw\/2013\/10\/17\/october-18-2013-weekly-round-up\/\">blog previously discussed<\/a> the criminal charged filed against the Jensen brothers after a listeria outbreak was traced to their Colorado cantaloupe farm.\u00a0 The brothers have reached a plea deal in their respective criminal cases, which charged them with 6 counts of misdemeanor introducing adulterated food into interstate commerce.\u00a0 Additionally, the brothers are now filing suit against Primus Labs, the company who hired an auditor to inspect the farm.\u00a0 The Jensen brothers allege that the auditor gave them bad advice.\u00a0 The food safety audit scored Jensen Farms at 96\/100 points.\u00a0 The listeria outbreak, which killed 33 and injured over 100, began within weeks of the audit.
