{"id":8497,"date":"2020-02-28T11:54:33","date_gmt":"2020-02-28T17:54:33","guid":{"rendered":"https:\/\/agrilife.org\/texasaglaw\/?p=8497"},"modified":"2026-04-17T15:20:01","modified_gmt":"2026-04-17T20:20:01","slug":"february-28-2020-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2020\/02\/28\/february-28-2020-weekly-round-up\/","title":{"rendered":"February 28, 2020 Weekly Round Up"},"content":{"rendered":"<p>As usual, there have been a number of ag law stories in the news the past couple of weeks.\u00a0 Here&#8217;s this week&#8217;s round up.<\/p>\n<div id=\"attachment_8504\" style=\"width: 650px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-8504\" class=\"size-large wp-image-8504\" src=\"https:\/\/agrilife.org\/texasaglaw\/files\/2020\/02\/timothy-eberly-XemjjFd_4qE-unsplash-1024x682.jpg\" alt=\"\" width=\"640\" height=\"426\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2020\/02\/timothy-eberly-XemjjFd_4qE-unsplash-1024x682.jpg 1024w, https:\/\/agrilife.org\/texasaglaw\/files\/2020\/02\/timothy-eberly-XemjjFd_4qE-unsplash-300x200.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2020\/02\/timothy-eberly-XemjjFd_4qE-unsplash-768x512.jpg 768w, https:\/\/agrilife.org\/texasaglaw\/files\/2020\/02\/timothy-eberly-XemjjFd_4qE-unsplash-1536x1024.jpg 1536w, https:\/\/agrilife.org\/texasaglaw\/files\/2020\/02\/timothy-eberly-XemjjFd_4qE-unsplash-2048x1365.jpg 2048w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><p id=\"caption-attachment-8504\" class=\"wp-caption-text\"><em>Photo by Timothy Eberly on Unsplash<\/em><\/p><\/div>\n<p>*<strong>USDA delays enforcement of two major portions of hemp Interim Final Rule.<\/strong>\u00a0 This week, the USDA announced that it will temporarily delay enforcement of two provisions of the Interim Final Rule on hemp production until October 31, 2021 or the publication of the Final Rule, whichever is earlier.\u00a0 First, the DEA will delay enforcing the requirement that THC testing must be conducted at DEA registered laboratories.\u00a0 Instead, testing may be conducted by labs that are not yet DEA registered.\u00a0 Second, USDA will delay enforcement of the requirement that producers use a DEA-registered reverse distrubutor or law enforcement to dispose of non-compliant plants.\u00a0 Instead, the producer may dispose of his or her crop using one of the <a href=\"https:\/\/www.ams.usda.gov\/rules-regulations\/hemp\/disposal-activities\">methods listed by the USDA<\/a>, which include plowing under, disking, and\u00a0 burning, among other options. The USDA says it is delaying the enforcement of these rules due to comment received in response to the Interim Final Rule and from discussions with states as they develop their plans. &#8220;We have learned that these provisions will serve as a significant hindrance to the growth of a domestic hemp market at this nascent stage.&#8221;\u00a0 [Read guidance <a href=\"https:\/\/www.ams.usda.gov\/rules-regulations\/hemp\/enforcement\">here<\/a>.] Texas has yet to publish its final hemp production regulations, but according to the Texas Department of Agriculture website, they should be forthcoming soon. It will be important for Texas producers to determine whether the TDA final regulations take the same delayed enforcement approach as the USDA.<\/p>\n<p><strong>*Verdict awards $265 million to peach farmers in dicamba trial.\u00a0<\/strong>You may remember from <a href=\"https:\/\/agrilife.org\/texasaglaw\/2017\/11\/20\/dicamba-update-part-ii\/\">this prior blog post<\/a> and <a href=\"https:\/\/aglaw.libsyn.com\/episode-27-kelly-nuckolls-winslow-dicamba\">this prior podcast<\/a> that there are a number of lawsuits pending around the country involving dicamba drift.\u00a0 The first of these lawsuits, brought by a peach farm in Missouri, was completed earlier this month when the jury awarded $265 million in damages to the farmers. The award breaks down into $15 million in compensatory damages and $250 million in punitive damages.\u00a0 The plaintiffs in the case claimed that because Monsanto released the Xtend soybeans prior to releasing the corresponding Xtendimax herbicide, they should have foreseen a use that is dangerous to the public.\u00a0 The defendants in the case, Bayer (which makes Xtendimax) and BASF (which markets Engenia), who claim the damages to the trees were caused by a fungal disease, rather than drift damage, have announced they intend to appeal. [Read article <a href=\"https:\/\/www.agriculture.com\/news\/business\/bader-farms-wins-dicamba-lawsuit-against-bayer-basf\">here<\/a>.]\u00a0 For a more detailed look at the\u00a0<em>Bader Farms\u00a0<\/em>case, <a href=\"https:\/\/nationalaglawcenter.org\/the-deal-with-dicamba-part-four\/\">click here<\/a> to read a blog post from the National Agricultural Law Center.<\/p>\n<p><strong>*Indiana Supreme Court will not hear Right to Farm challenge.\u00a0\u00a0<\/strong>In 2019, the Indiana Court of Appeals sided with a hog farm and upheld the constitutionality of the Indiana Right to Farm Act.
