{"id":816,"date":"2013-11-04T11:47:45","date_gmt":"2013-11-04T17:47:45","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=816"},"modified":"2026-04-17T15:35:34","modified_gmt":"2026-04-17T20:35:34","slug":"breaking-news-federal-judge-dismisses-lawsuit-prohibiting-opening-of-horse-slaughter-plants","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2013\/11\/04\/breaking-news-federal-judge-dismisses-lawsuit-prohibiting-opening-of-horse-slaughter-plants\/","title":{"rendered":"Breaking News:  Federal Judge Dismisses Lawsuit Prohibiting Opening of Horse Slaughter Plants"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"color: #993300;\">**This article is not a substitute for the advice of an attorney.**<\/span><\/p>\n<p>On Friday afternoon, federal Judge Christina Armijo dismissed a lawsuit and denied an injunction sought by animal rights groups, including the Humane Society of the United States,\u00a0that would have prevented\u00a0plants in New Mexico and Missouri\u00a0from slaughtering\u00a0horses.<\/p>\n<div id=\"attachment_822\" style=\"width: 361px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/agrilife.org\/texasaglaw\/files\/2013\/11\/fed-courthouse-nm.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-822\" class=\"size-medium wp-image-822  \" alt=\"\" src=\"https:\/\/agrilife.org\/texasaglaw\/files\/2013\/11\/fed-courthouse-nm-300x225.jpg\" width=\"351\" height=\"226\" \/><\/a><p id=\"caption-attachment-822\" class=\"wp-caption-text\">United States Court for the District of New Mexico<br \/>Photo via Tom Blog, Albuquerque NM<\/p><\/div>\n<p style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>Background<\/strong><\/span><\/p>\n<p>Under federal law,\u00a0the Food Safety Inspection Service (&#8220;FSIS&#8221;) must inspect all species, including horses, before they are allowed to be slaughtered and the meat sold in commerce.\u00a0\u00a0Without this inspection, slaughter houses may not operate.\u00a0 In December 2011, Valley Meat of Roswell, New Mexico and Responsible Transportation of Sigourney, Iowa, filed an applications for inspection of its facility so that it could begin the slaughter of horses.\u00a0 The applications were granted and inspections ordered.\u00a0 In January 2013, Rains Natural Meats of Gallatin, Missouri, filed a similar application.<\/p>\n<p>At that point, a group of plaintiffs filed suit in federal court seeking an injunction from the court to prevent the\u00a0FSIS from performing any horse slaughter inspections until the USDA had conducted an environmental impact study under the National Environmental Policy Act (&#8220;NEPA&#8221;).\u00a0 The plaintiffs&#8217; theory was that because the\u00a0FSIS implemented a new drug residue testing plan applicable to all horse slaughter plants, but did not conduct an environmental impact study, the FSIS violated NEPA and\u00a0should be prohibited from\u00a0conducting any inspections until the proper study was conducted.\u00a0 Thus, plaintiffs argued that because there was no environmental impact statement, there could be no inspections, and because there were no inspections, there could be no horse slaughter.<\/p>\n<p>In August 2013, the Court granted a temporary restraining order for the plaintiffs, thereby barring the inspections from going forward and in September, the Court prohibited inspectors from being dispatched to the horse slaughter plants.\u00a0 This order was set to expire on October 31, 2013.<\/p>\n<p style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>November 1, <\/strong><strong>2013<\/strong><strong> Decision<\/strong><\/span><\/p>\n<p style=\"text-align: left;\">On Friday, November 1, 2013, the Court denied the plaintiffs&#8217;
