[Read article <a href=\"https:\/\/www.reuters.com\/article\/us-kinder-morgan-pipeline\/kinder-morgan-wins-texas-court-challenge-removing-obstacle-to-2-billion-gas-pipeline-idUSKCN1TQ32D\">here<\/a>.]<\/p>\n<p><b>*No Syngenta settlement payments coming this year.\u00a0\u00a0<\/b>The Syngenta Claims Administrator has provided additional information regarding settlement payments for corn farmers who submitted claims forms last year.\u00a0 According to the <a href=\"https:\/\/www.cornseedsettlement.com\/\">Settlement Update<\/a>, eligible class members will receive a &#8220;Notice of Determination&#8221; showing the number of bushels their payment will be calculated based upon &#8220;as early as July.&#8221;\u00a0 If someone provided insufficient information or otherwise failed to qualify as a class member, &#8220;Notices of Rejection&#8221; will be issued and those receiving such rejection notices will have the chance to attempt to cure any deficiencies.\u00a0 Final Notices of Rejection will be issued by the end of August.\u00a0 Once appeals from final notices have been allowed, the Settlement Administrator will provide a Final Report to the court.\u00a0 Additionally, a pending objection to the settlement is currently pending.\u00a0 It was rejected by the District Court but has been appealed to the US Court of Appeals for the Tenth Circuit.\u00a0 In light of all this, no payments can be issued until the Final Report is submitted to the District Court and the appeal is resolved.\u00a0 The Claims Administrators anticipate the earliest payments may be processed to be February 2020. [View Settlement Update <a href=\"https:\/\/www.cornseedsettlement.com\/\">here<\/a>.]<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-4752 size-large\" src=\"https:\/\/agrilife.org\/texasaglaw\/files\/2017\/04\/corn-pexels-1024x683.jpg\" alt=\"\" width=\"640\" height=\"427\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2017\/04\/corn-pexels-1024x683.jpg 1024w, https:\/\/agrilife.org\/texasaglaw\/files\/2017\/04\/corn-pexels-300x200.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2017\/04\/corn-pexels-768x512.jpg 768w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/p>\n<p><strong>*US Supreme Court overrules precedent; citizens may now bring allegations of takings by local government directly to federal court.<\/strong>\u00a0 In a 5-4 opinion in\u00a0<em>Knick v. Township of Scott<\/em>, the US Supreme Court overturned decades of precedent that required plaintiffs claiming local governments violated the takings clause must have gone through state courts prior to being filed in the federal judiciary.\u00a0 Now, that is no longer the case, and a plaintiff may file court directly in federal court.\u00a0 In addition to this being a major change to procedure for these types of cases, it also shows a willingness on the High Court to overrule decades-old precedence, something that Justice Elena Kagen raised as a concern in her dissenting opinion.\u00a0 [Read opinion <a href=\"https:\/\/www.supremecourt.gov\/opinions\/18pdf\/17-647_m648.pdf\">here<\/a> and articles <a href=\"https:\/\/www.npr.org\/2019\/06\/22\/734919303\/supreme-court-overturns-precedent-in-property-rights-case-a-sign-of-things-to-co?utm_source=npr_newsletter&amp;utm_medium=email&amp;utm_content=20190623&amp;utm_campaign=npr_email_a_friend&amp;utm_term=storyshare\">here<\/a> and <a href=\"https:\/\/www.scotusblog.com\/2019\/06\/opinion-analysis-court-overrules-takings-precedent-allowing-more-suits-in-federal-court\/\">here<\/a>.]<\/p>\n<p><strong>*Lawsuit filed against North Carolina&#8217;s new Right to Farm statute.<\/strong>\u00a0 You may recall that last year, the North Carolina Legislature modified and strengthened the state&#8217;s Right to Farm Act by adding additional restrictions on when a plaintiff may bring a nuisance lawsuit against an agricultural operation. Environmental groups have now filed suit, challenging the constitutionality of this new law.\u00a0 [Read Complaint <a href=\"http:\/\/src.bna.com\/Jha\">here<\/a> and article <a href=\"https:\/\/www.meatpoultry.com\/articles\/21494-north-carolina-nuisance-farm-bills-challenged-in-court\">here<\/a>.]<\/p>\n<p><strong>*USDA says states may not block interstate transfer of hemp.<\/strong>\u00a0 The USDA has issued a memo stating that states may not block the interstate transport of hemp, despite it continuing to be illegal in some states.\u00a0 Meanwhile, the USDA is currently working to promulgate federal rules related to hemp production in light of the 2018 Farm Bill removing hemp from the Controlled Substances Act.\u00a0 It is the absence of these rules that some states, like Idaho, argue allow them to prohibit hemp transport through the state.\u00a0 [Read Memo <a href=\"https:\/\/www.ams.usda.gov\/sites\/default\/files\/HempExecSumandLegalOpinion.pdf\">here<\/a> and article <a href=\"https:\/\/www.morningagclips.com\/usda-says-states-cant-block-hemp-transports\/\">here<\/a>.]<\/p>\n<p><strong>*&#8221;Tackling the agriculture industry&#8217;s mental-health crisis starts with farmers like us.&#8221;<\/strong>\u00a0 Mental health issues in agriculture is a topic near and dear to my heart.\u00a0 This week, I came across an article by Lesley Kelly discussing how it&#8217;s up to farmers like us to help save our friends and neighbors.\u00a0 Here&#8217;s a quote from the article that really resonated with me. &#8220;When we see smoke when a combine or a barn is burning, farmers know our neighbors are quick to run to lend a hand. But we\u2019re still not at a place where we can be sure that the same is true during mental-health challenges&#8230;.The agriculture industry is amazing because of our people&#8211;and right now, our people are hurting.
