{"id":7452,"date":"2019-03-18T01:04:33","date_gmt":"2019-03-18T06:04:33","guid":{"rendered":"https:\/\/agrilife.org\/texasaglaw\/?p=7452"},"modified":"2019-03-18T10:46:25","modified_gmt":"2019-03-18T15:46:25","slug":"ca-animal-welfare-act-could-impact-farm-practices-nationwide","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2019\/03\/18\/ca-animal-welfare-act-could-impact-farm-practices-nationwide\/","title":{"rendered":"CA Animal Welfare Act Could Impact Farm Practices Nationwide"},"content":{"rendered":"<p><em>This article was published in <a href=\"https:\/\/www.progressivecattle.com\/\">Progressive Cattleman&#8217;s<\/a> April issue.<\/em><\/p>\n<p>In a difficult time for agriculture, when producers are already facing low commodity prices and trade uncertainty, many livestock producers may also have to be concerned about the potential impact of something else in the coming years: California voters.<\/p>\n<p>In November 2018, California voters passed Proposition 12 with 59% of the vote.\u00a0 This ballot initiative prohibits California businesses from knowingly selling veal, pork, shell eggs, or liquid eggs, that were produced by animals \u201cconfined in a cruel manner.\u201d\u00a0 The statute defines \u201cconfined in a cruel manner\u201d to mean any of the following practices:<\/p>\n<ul>\n<li>Confining an animal in any manner that prevents the animal from lying down, standing up, fulling extending the animal\u2019s limbs, or turning around freely, or<\/li>\n<li>After December 31, 2019, confining a calf raised for veal with less than 43 square feet of usable floor space per calf; or<\/li>\n<li>After December 31, 2019, confining an egg-laying hen with less than 144 square inches of usable floor space per hen; or<\/li>\n<li>After December 31, 2021, confining a breeding pig with less than 24 square feet of usable space per pig; or<\/li>\n<li>After December 31, 2021, confining an egg-laying hen in an enclosure other than a cage-free housing system.<\/li>\n<\/ul>\n<div id=\"attachment_7453\" style=\"width: 650px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-7453\" class=\"size-full wp-image-7453\" src=\"https:\/\/agrilife.org\/texasaglaw\/files\/2019\/03\/chickens-3949199_640.jpg\" alt=\"\" width=\"640\" height=\"427\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2019\/03\/chickens-3949199_640.jpg 640w, https:\/\/agrilife.org\/texasaglaw\/files\/2019\/03\/chickens-3949199_640-300x200.jpg 300w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><p id=\"caption-attachment-7453\" class=\"wp-caption-text\">Image by <a href=\"https:\/\/pixabay.com\/users\/RitaE-19628\/?utm_source=link-attribution&amp;utm_medium=referral&amp;utm_campaign=image&amp;utm_content=3949199\">RitaE<\/a> from <a href=\"https:\/\/pixabay.com\/?utm_source=link-attribution&amp;utm_medium=referral&amp;utm_campaign=image&amp;utm_content=3949199\">Pixabay<\/a><\/p><\/div>\n<p>Ironically enough, the measure was opposed by groups on both sides of the animal welfare issue, including the National Pork Producers Council (NPPC) and the People for the Ethical Treatment of Animals (PETA).\u00a0 The NPPC opposed the proposition because it will increase production costs for farmers and prices for consumers.\u00a0 PETA opposed as well, arguing that the initiative did not go far enough to prevent animal cruelty.<\/p>\n<p>This was not the first law of this type to come out of the Golden State.\u00a0 In 2015, California passed a law stating that a shelled egg may not been sold or contracted for sale for human consumption in California if the egg is the product of a hen that was at a confined farm or a farm not in compliance with California animal care standards, which requires hens be allowed to lay down, stand up, fully extend their limbs, and turn around freely.\u00a0 Numerous states led by Missouri and Indiana filed suit against this 2015 law in the US Supreme Court, but in January 2019, the Justices refused to hear the cases.<\/p>\n<p>On its face, Proposition 12 applies only to California businesses selling pork, veal, and eggs.\u00a0 However, in practice, it has the potential to impact farmers and ranchers producing beef, pork and eggs nationwide.\u00a0 If a farmer in Texas, for example, does not adopt these practices, then he or she will be unable to sell his or her products in California.\u00a0 These types of ballot initiatives could certainly be expanded to additional products and could have major impacts on the farm level, requiring producers to invest in new or different facilities in order to continue producing the products.\u00a0 This is an issue of which everyone involved in production agriculture should be aware.<\/p>\n<p>For readers interested in the topic of consumer impact on livestock production at the farm level, I recorded a great podcast episode with Indiana-based attorney, Brianna Schroeder, discussing this topic as it relates to livestock production.\u00a0 To listen, <a href=\"http:\/\/aglaw.libsyn.com\/episode-46-brianna-schroeder-consumer-impact-on-livestock-production\">click here<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>This article was published in Progressive Cattleman&#8217;s April issue.
