{"id":731,"date":"2013-10-25T16:20:14","date_gmt":"2013-10-25T21:20:14","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=731"},"modified":"2026-04-17T15:35:47","modified_gmt":"2026-04-17T20:35:47","slug":"october-25-2013-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2013\/10\/25\/october-25-2013-weekly-round-up\/","title":{"rendered":"October 25, 2013 Weekly Round Up"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"color: #993300;\">***This blog is not intended as a substitute for the advice of an attorney.***<\/span><\/p>\n<p>&nbsp;<\/p>\n<p>A wide variety of ag law stories were in the news this week.\u00a0 Here is a recap.<\/p>\n<p>&nbsp;<\/p>\n<p><em><strong>AQHA Seeks Delay in Registering Clones During<\/strong><\/em><strong><em> Appeal<\/em>:<\/strong>\u00a0 The AQHA is seeking permission from a federal judge to delay in complying with an order to register cloned horses and their offspring pending a decision on the pending appeal.\u00a0 In July, a jury found that the AQHA&#8217;s rules banning registration of cloned horses violated anti-trust laws.\u00a0 Subsequently, Judge Mary Lou Robinson ordered the AQHA to immediately begin registering clones.\u00a0 The AQHA appealed the decision and that appeal is\u00a0pending before the United States Court of Appeals for the Fifth Circuit.\u00a0 In their motion, the AQHA argues that registering the clones will require expensive modifications to their current computer system, require thousands of hours of work, and months of programming modifications.\u00a0 The Plaintiffs response to this request is expected in the coming weeks.<\/p>\n<p>&nbsp;<\/p>\n<p><em><strong>LCRA Will Release Water to Matagorda Bay:<\/strong>\u00a0 <\/em>Recent rains have raised the levels in Lake Travis and Lake Buchanan, prompting the Lower Colorado River Authority to withdraw its <a href=\"http:\/\/agrilife.org\/texasaglaw\/2013\/09\/20\/september-20-2013-weekly-round-up\/\">request to the Texas Commission on Environmental Quality<\/a> to cut off water to Matagorda Bay.\u00a0 [Read article <a href=\"http:\/\/www.chron.com\/news\/science-environment\/article\/Rainfall-halts-water-plan-for-Matagorda-Bay-4901823.php\">here<\/a>.]<\/p>\n<p>&nbsp;<\/p>\n<p><em><strong>The Chesapeake Bay Lawsuit &#8211; Farm Bureau v. EPA<\/strong><\/em>:\u00a0\u00a0 In 2010, the federal Environmental Protection Agency determined that states surrounding the Chesapeake Bay were not doing enough to prevent harm to the Bay caused by runoff from large farms in the area.\u00a0\u00a0 In order to address this issue, the EPA implemented a Total Maximum Daily Load (&#8220;TMDL&#8221;) of nitrogen, phosphorus, and sediment for the Chesapeake Bay watershed area.\u00a0 Various groups, including the American Farm Bureau Federation filed suit challenging the EPA&#8217;s establishment of the TMDL as being beyond the EPA&#8217;s authority.\u00a0\u00a0In September, the trial court\u00a0sided with the EPA and upheld the TMDL.\u00a0 [Read opinion <a href=\"http:\/\/www.fb.org\/legal\/files\/id_51\/2013.09.13%20District%20Court%20Opinion.pdf\">here<\/a>.]\u00a0 The American Farm Bureau and other plaintiffs have appealed the decision\u00a0to the United States District Court for the\u00a0Third Circuit.\u00a0 [Read article <a href=\"http:\/\/www.farmanddairy.com\/news\/farm-groups-appeal-epa-rule-chesapeake-bay-watershed\/159984.html\">here<\/a>.]\u00a0 This week, Illinois agricultural attorney, Todd Janzen, wrote a blog this week explaining why a case involving the Chesapeake Bay could have impacts on agricultural producers in the midwest.\u00a0 [Read blog <em><a href=\"http:\/\/www.janzenaglaw.com\/2013\/10\/why-chesapeake-bay-matters-to.html\">here<\/a>.]<\/em><\/p>\n<p>&nbsp;<\/p>\n<p><em><strong>West Virginia Poultry Farm Wins Suit Against<\/strong><\/em> <strong><em>EPA<\/em>:<\/strong>\u00a0 A federal district court found that the West Virginia poultry farm did not have to obtain a pollution\u00a0permit from the EPA for runoff from the farm.\u00a0 Lois Alt&#8217;s Eight is Enough farm is home to eight poultry confinement houses.\u00a0 The EPA threatened fines against the\u00a0Ms. Alt\u00a0due to\u00a0water runoff from the farmyard outside her poultry houses.\u00a0 The farmer argued that the\u00a0runoff was exempt from\u00a0EPA\u00a0permitting because\u00a0it was agricultural storm water runoff, which is specifically exempted from the statute.\u00a0 This week, the\u00a0court agreed, holding that because the water runoff from the farm was storm water, it was not subject to regulation by the EPA under the Clean Water Act.\u00a0 In reaching this decision, the court gave the term &#8220;agricultural storm water&#8221;
