Welcome to those of you joining from my recent presentations in Panhandle, Waco, and Clovis.<\/p>\n<p>Here are some of the ag law stories in the news recently:<\/p>\n<p>*<strong>California voters pass new\u00a0animal welfare law.<\/strong>\u00a0 Earlier this month, California voters passed\u00a0Proposition 12,\u00a0requiring that all eggs sold in California must come from cage-free hens by 2022.\u00a0 The new law will also impose restrictions on the sale of veal and pork where certain production practices are not met.\u00a0 For veal, calves must have at least 43 square feet of floor space by 2020, and breeding pigs must be given at least 24 square foot of floor space by 2022.\u00a0 For hens, the law requires 1 square foot of floor space by 2020, with cage-free being required by 2022.\u00a0 This law will have impacts beyond California&#8217;s borders, as producers in other states wishing to sell products in California will be required to comply as well.\u00a0 [Read article <a href=\"https:\/\/www.morningagclips.com\/california-makes-cage-free-hens-a-state-law\/\">here<\/a>.]\u00a0 Keep in mind, the prior California law that required certain size limitations for hens laying any eggs to be sold in California is currently facing challenge by numerous states in the US Supreme Court.\u00a0 [Read prior blog post<a href=\"https:\/\/agrilife.org\/texasaglaw\/2018\/01\/15\/egg-production-practices-subject-supreme-court-lawsuits\/\"> here<\/a>.]<\/p>\n<div id=\"attachment_7056\" style=\"width: 650px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-7056\" class=\"wp-image-7056 size-large\" src=\"https:\/\/agrilife.org\/texasaglaw\/files\/2018\/11\/mai-moeslund-757971-unsplash-1024x687.jpg\" alt=\"\" width=\"640\" height=\"429\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2018\/11\/mai-moeslund-757971-unsplash-1024x687.jpg 1024w, https:\/\/agrilife.org\/texasaglaw\/files\/2018\/11\/mai-moeslund-757971-unsplash-300x201.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2018\/11\/mai-moeslund-757971-unsplash-768x516.jpg 768w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><p id=\"caption-attachment-7056\" class=\"wp-caption-text\">Photo by Mai Moeslund on Unsplash<\/p><\/div>\n<p><strong>*Montana case raises interesting question about ownership of fossils.<\/strong>\u00a0 One of my readers sent me a really interesting case that raised the following question:\u00a0 Are fossils owned by the surface owner, or the mineral owner?\u00a0 This case arose when valuable fossils were found on a\u00a0ranch in Montana.\u00a0 That\u00a0US Court of Appeals for the Ninth Circuit\u00a0found that dinosaur fossils were &#8220;minerals&#8221; under the terms of the deed, and thus, belonged to the mineral owner.\u00a0 This\u00a0decision was made based on a Texas case that looked at whether the substance at issue\u00a0was &#8220;rare and exceptional in character or possessed a peculiar property giving it special value.&#8221;\u00a0 The dissenting judge would have found the fossils to be owned by the surface owner because the &#8220;ordinary and natural meaning test&#8221; would find fossils not to be a mineral.\u00a0 I did a quick search and found no published opinions addressing this issue here in Texas, but\u00a0it is interesting that it was the approach from a Texas case that led the Ninth Circuit to this decision.\u00a0 We&#8217;ll see if this comes up here one day.\u00a0 [<a href=\"https:\/\/agrilife.org\/texasaglaw\/files\/2018\/11\/Read-Opinion-here.pdf\">Read Opinion here<\/a>.]<\/p>\n<p><strong>* Farm Succession Planning Newsletter Series.<\/strong>\u00a0 The Hallock &amp; Hallock Law Firm in Utah recently published a four-part newsletter series on farm succession planning.\u00a0 The steps are practical and the articles useful.\u00a0 They suggest that farm and ranch owners should (1) Determine where the farm is now; (2) Determine where the farm wants to be in the future; (3) Create a road map to get there; and (4) implement the plan.\u00a0 You can read these newsletters <a href=\"http:\/\/www.hallock-law.com\/newsletters\/\">here<\/a>.<\/p>\n<p>*\u00a0<strong>Podcast focuses on mental health and suicides in rural America.<\/strong>\u00a0 My friend and Ag Day anchor, Clinton Griffiths, recently did a podcast looking at mental health in rural America.\u00a0 In an era of low commodity prices, trade wars, high input costs, and the usual uncertainty like weather, it&#8217;s not been easy for ag producers.\u00a0 Clinton did a great job of covering an important issue and I&#8217;d encourage everyone to listen.\u00a0 [Play podcast <a href=\"https:\/\/omny.fm\/shows\/farm-sense\/episode-004-mental-health\">here<\/a>.]<\/p>\n<p style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>Programs Next Week<\/strong><\/span><\/p>\n<p>Next week, I will not be speaking as it will be Thanksgiving, but the following week I&#8217;ll be back at it.\u00a0 On November 27, I&#8217;ll be presenting a program on hunting leases for County Extension Agents.\u00a0 On Thursday, November 29, I&#8217;m excited to be in Victoria to speak at an extension agricultural law meeting with topics including water law, fence law, and eminent domain.<\/p>\n<p>As always, you can see my complete list of upcoming programs <a href=\"https:\/\/agrilife.org\/texasaglaw\/upcoming-presentations\/\">here<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Hello and Happy Friday!
