{"id":6891,"date":"2018-10-12T13:37:32","date_gmt":"2018-10-12T18:37:32","guid":{"rendered":"https:\/\/agrilife.org\/texasaglaw\/?p=6891"},"modified":"2026-04-17T15:22:23","modified_gmt":"2026-04-17T20:22:23","slug":"october-5-2018-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2018\/10\/12\/october-5-2018-weekly-round-up\/","title":{"rendered":"October 5, 2018 Weekly Round Up"},"content":{"rendered":"<p>Welcome to this week&#8217;s round up post.\u00a0 I hope everyone has a wonderful weekend!\u00a0 Here are some of the agricultural law stories in the news this week.<\/p>\n<p>*<strong>Environmental groups file suit against EPA regarding air emissions reporting for agriculture.\u00a0 <\/strong>This is a continuation of an issue we&#8217;ve been watching for\u00a0several years.\u00a0 You may recall that back in April of 2017, a federal court ruled that animal agricultural operations were required to report air emissions to federal authorities under the\u00a0federal CERCLA and EPCRA statutes.\u00a0 Then, in April of this year, the EPA announced that it would not require emissions reports for animal agricultural operations.\u00a0 [Read prior blog post <a href=\"https:\/\/agrilife.org\/texasaglaw\/2018\/05\/01\/epa-no-emissions-reporting-required-for-agriculture\/\">here<\/a>.]\u00a0 Specifically, under the federal EPCRA statute, the EPA announced that emissions were not required because (1)\u00a0such reporting is not\u00a0required under CERCLA (due to Congressional action) and (2) EPCRA expressly exempts farms that use substances in &#8220;routine agricultural operations&#8221; from reporting.\u00a0 It was this decision&#8211;to exempt farms from reporting under EPCRA based on the two reasons listed above&#8211;that is at issue in the newest lawsuit.\u00a0 The plaintiffs claim that the EPA did not have the authority to make this type of exemption\u00a0and, even if they did, they failed to comply with the notice and comment rulemaking requirements of the Administrative Procedures Act.\u00a0[Read Complaint <a href=\"https:\/\/earthjustice.org\/sites\/default\/files\/files\/Complaint_Challenging_Factory_Farm_Pollution_Exemption.pdf\">here<\/a>.]<\/p>\n<div id=\"attachment_6936\" style=\"width: 650px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-6936\" class=\"wp-image-6936 size-large\" src=\"https:\/\/agrilife.org\/texasaglaw\/files\/2018\/10\/3513073073_3d67f7c3d2_b-1024x683.jpg\" alt=\"\" width=\"640\" height=\"427\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2018\/10\/3513073073_3d67f7c3d2_b.jpg 1024w, https:\/\/agrilife.org\/texasaglaw\/files\/2018\/10\/3513073073_3d67f7c3d2_b-300x200.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2018\/10\/3513073073_3d67f7c3d2_b-768x512.jpg 768w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><p id=\"caption-attachment-6936\" class=\"wp-caption-text\"><em>TAMU AgriLife photo<\/em><\/p><\/div>\n<p><strong>*Fence law dispute brewing between ranchers and feds in New Mexico.\u00a0 <\/strong>New Mexico ranchers have found themselves in a fence law dispute with the federal government over who is responsible to repair fences on federal land.\u00a0 In the Valles Caldera National Preserve, which is bordered by a number of grazing pastures leased by the BLM to New Mexico ranchers, fences are in disrepair from a number of causes including\u00a0 wildfire, falling trees, and other wear and tear.\u00a0 Visitors to the Preserve have complained about livestock in the public area, resulting in a recent situation where federal employees rounded up cattle and allegedly held them with little food and water.\u00a0 Ranchers believe it should be the responsibility of the government to repair these fences, while the government disagrees.\u00a0 Ranchers point to New Mexico law, which generally requires a person to fence out livestock if the landowner does not want cattle on his or her property.\u00a0 The government, however, points to court cases holding that state-level fence laws are pre-empted by federal law that requires landowners to keep livestock off of federal land.\u00a0 [Read article <a href=\"https:\/\/www.usnews.com\/news\/best-states\/new-mexico\/articles\/2018-09-27\/ranchers-us-square-off-over-fencing-at-national-preserve\">here<\/a>.]<\/p>\n<p><strong>* California judge issues tentative ruling for new trial on\u00a0 punitive damages in Glyphosate litigation.<\/strong>\u00a0 You may remember that a couple of months ago, a San Francisco jury awarded $289 million verdict to a school groundskeeper who claimed that exposure to Glyphosate caused his cancer.\u00a0 Of that verdict, $250 million was awarded as punitive damages&#8211;damages intended to punish the defendants&#8217;
