{"id":6003,"date":"2018-04-27T11:06:27","date_gmt":"2018-04-27T16:06:27","guid":{"rendered":"https:\/\/agrilife.org\/texasaglaw\/?p=6003"},"modified":"2026-04-17T15:23:56","modified_gmt":"2026-04-17T20:23:56","slug":"april-27-2018-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2018\/04\/27\/april-27-2018-weekly-round-up\/","title":{"rendered":"April 27, 2018 Weekly Round Up"},"content":{"rendered":"<p>Welcome to our final Weekly Round Up post for April.\u00a0 How can it be May already?\u00a0 This week, I traveled to Canadian to present at the Hemphill County Beef Conference and then gave online presentations to groups in Kerrville and Cameron County.\u00a0 Welcome to those of you joining from those events!<\/p>\n<p>Here are some ag law stories in the news this week.<\/p>\n<p><strong>*Judge gives preliminary approval to Syngenta settlement.<\/strong>\u00a0 Earlier this month, the federal judge presiding over the Syngenta class action litigation granted preliminary approval of the parties&#8217; proposed settlement.\u00a0 The next step is for class notice to be sent to all class members, which will occur in May.\u00a0 Class members will have an opportunity to review the settlement and object to it before final settlement approval is given, which is expected in October of this year.\u00a0 [Read Order <a href=\"http:\/\/www.syngentacornlitigation.com\/wp-content\/uploads\/2018\/04\/Order-Preliminarily-Approving-Settlement-04-10-18_-Dkt.-3532.pdf\">here<\/a>.]\u00a0 I&#8217;ll have a more detailed blog post discussing the settlement and who is included coming soon.<\/p>\n<p><strong>*US Supreme Court seeks federal government input on egg production cases.<\/strong>\u00a0 Last week, the US Supreme Court sought input from the Solicitor General on\u00a0<em>Missouri v. California<\/em> and\u00a0<em>Indiana v. Massachusetts<\/em>, the egg production lawsuits pending before the High Court that we previously discussed <a href=\"https:\/\/agrilife.org\/texasaglaw\/2018\/01\/15\/egg-production-practices-subject-supreme-court-lawsuits\/\">here<\/a>.\u00a0 [Read article <a href=\"https:\/\/www.porkbusiness.com\/article\/solicitor-general-review-cases-challenging-state-agriculture-laws\">here<\/a>.]<\/p>\n<p><strong>*NC jury awards $50 million to neighbors of hog farm in nuisance lawsuit.<\/strong>\u00a0 A verdict from North Carolina is raising eyebrows in the ag law community.\u00a0 Yesterday, a federal jury found in favor of neighbors who complained that odor from the farm created a nuisance.\u00a0 The lawsuit was filed not against the farm owner, but against Smithfield Foods, who contracts with the farm owner to raise the pigs.\u00a0 Dozens of other lawsuits remain pending and are set to go to trial.\u00a0 [Read article <a href=\"http:\/\/www.foxnews.com\/health\/2018\/04\/27\/hog-farms-neighbors-awarded-50m-after-suing-over-smells-spraying.html\">here<\/a>.]\u00a0 I will have a more detailed blog post looking at this trial and why the court decided the NC Right to Farm Act did not apply to protect the defendant coming soon.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-6021 size-large\" src=\"https:\/\/agrilife.org\/texasaglaw\/files\/2018\/04\/suzanne-tucker-311692-unsplash-1024x607.jpg\" alt=\"\" width=\"640\" height=\"379\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2018\/04\/suzanne-tucker-311692-unsplash-1024x607.jpg 1024w, https:\/\/agrilife.org\/texasaglaw\/files\/2018\/04\/suzanne-tucker-311692-unsplash-300x178.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2018\/04\/suzanne-tucker-311692-unsplash-768x456.jpg 768w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/p>\n<p><strong>* AR Supreme Court issues temporary restraining orders against farmers spraying dicamba.<\/strong>\u00a0 In what has been a story full of twists and turns each week, the Arkansas Supreme Court has now entered a temporary restraining order (TRO) preventing some farmers from applying dicamba.\u00a0 Remember that the Arkansas Plant Board passed a rule prohibiting\u00a0 application of new dicamba formulations over the top of growing crops after April 15.\u00a0 Two judges, however, issued exemptions from that state-wide ban for a group of farmers involved in litigation with the Plant Board.\u00a0 Those orders would have allowed several farmers to continue spraying.\u00a0 The Supreme Court&#8217;s TRO stayed those lower court orders, meaning that for now, those farmers cannot make the application.\u00a0 A third order granting access to dicamba was issued in Clay County, but there has been no restraining order issued in that case as of yet.
