{"id":5942,"date":"2018-04-02T01:03:24","date_gmt":"2018-04-02T06:03:24","guid":{"rendered":"https:\/\/agrilife.org\/texasaglaw\/?p=5942"},"modified":"2026-04-17T15:23:56","modified_gmt":"2026-04-17T20:23:56","slug":"revised-outline-for-analyzing-fmcsa-hauling-regulations","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2018\/04\/02\/revised-outline-for-analyzing-fmcsa-hauling-regulations\/","title":{"rendered":"Revised Outline for Analyzing FMCSA Hauling Regulations"},"content":{"rendered":"<p>You may recall that last month, Beth Rumley from the National Ag Law Center and I published a fact sheet outlining the steps to analyze if various Federal Motor Carrier Safety Administration (FMCSA) regulations would apply.\u00a0 Given some new legislation and some additional guidance from FMCSA, we have now made important revisions to the fact sheet.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-5948\" src=\"https:\/\/agrilife.org\/texasaglaw\/files\/2018\/03\/33191032752_92abaa43cf_z.jpg\" alt=\"\" width=\"449\" height=\"252\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2018\/03\/33191032752_92abaa43cf_z.jpg 640w, https:\/\/agrilife.org\/texasaglaw\/files\/2018\/03\/33191032752_92abaa43cf_z-300x168.jpg 300w\" sizes=\"auto, (max-width: 449px) 100vw, 449px\" \/><\/p>\n<p>You can access the most recent version of our publication <a href=\"http:\/\/nationalaglawcenter.org\/wp-content\/uploads\/assets\/articles\/DowellRumley-ELD.pdf\">here<\/a>.<\/p>\n<p>The major modifications include the following:<\/p>\n<p>(1) FMCSA granted an additional 90-day waiver of the electronic logging device rules to anyone hauling\u00a0&#8220;agricultural commodities.&#8221;\u00a0 The definition of &#8220;agricultural commodities&#8221; includes commodities, unprocessed food, feed, fiber, or livestock and insects.\u00a0 This waiver is now in place \u00a0through June 18, 2018.\u00a0 Haulers should print a <a href=\"https:\/\/bit.ly\/2uaFCoo\">copy of this waiver<\/a> and keep it in their vehicle to present to law enforcement if requested.<\/p>\n<p>(2)\u00a0 In the Consolidated Appropriations Act, 2018, Congress included a provision that authorities will not enforce the electronic logging device requirement for persons hauling livestock or insects through September 30, 2018.<\/p>\n<p>(3)\u00a0 In various guidance documents like <a href=\"https:\/\/www.fmcsa.dot.gov\/hours-service\/elds\/non-business-related-transportation-horses\">this<\/a> and <a href=\"https:\/\/www.fmcsa.dot.gov\/hours-service\/elds\/agricultural-exceptions-and-exemptions-federal-motor-carrier-safety\">this<\/a>, the FMCSA has taken a narrower view of what constitutes &#8220;commerce&#8221; than the\u00a0regulatory language.\u00a0 For drivers, this means that more trips may\u00a0fall outside the\u00a0FMCSA\u00a0understanding of commerce,\u00a0and for which the FMCSA rules do not apply.\u00a0 Although the regulatory language defining &#8220;commerce&#8221; is extremely broad, &#8220;trade, traffic, or transportation in the United States,&#8221; the guidance seems narrower and says that vehicles that are &#8220;non-commercial&#8221; or &#8220;not business related&#8221; or the driver is &#8220;not engaged in underlying business related to the move&#8221; commerce is not present and the FMCSA regulations are inapplicable.\u00a0 One example given by FMCSA of a non-commerce situation to which regulations would not apply would be a cattle rancher hauling horses for personal use that is unrelated to the cattle ranch.<\/p>\n<p>(4) The requirement to have an electronic logging device under FMCSA regulations applies only if the driver is traveling in interstate commerce.<\/p>\n<p>Again, this is an extremely complicated and still-changing area of law.\u00a0 We would recommend that anyone concerned visit with the Department of Transportation in your state and with an attorney licensed in your jurisdiction to ensure compliance with all federal and state hauling laws.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>You may recall that last month, Beth Rumley from the National Ag Law Center and I published a fact sheet outlining the steps to analyze if various Federal Motor Carrier Safety Administration (FMCSA) regulations would apply.\u00a0 Given some new legislation and some additional guidance from FMCSA, we have now made important revisions to the fact sheet.
