{"id":5917,"date":"2018-03-15T15:06:53","date_gmt":"2018-03-15T20:06:53","guid":{"rendered":"https:\/\/agrilife.org\/texasaglaw\/?p=5917"},"modified":"2026-04-17T15:23:57","modified_gmt":"2026-04-17T20:23:57","slug":"march-16-2018-weekly-round","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2018\/03\/15\/march-16-2018-weekly-round\/","title":{"rendered":"March 16, 2018 Weekly Round Up"},"content":{"rendered":"<p>It&#8217;s been a busy week for me and for agricultural law!\u00a0 On Wednesday I spoke in Albany, Texas at a program hosted by the Leon Bosque RC&amp;D and on Thursday evening I was in Brownwood to speak at the Brown County Ag Day.\u00a0 Welcome to those of you joining from those events.<\/p>\n<p>Here are some of the ag law stories in the news this week.<\/p>\n<p><strong>* FMCSA Extends Agricultural Exemption to New Hauling Regulations Another 90 Days.<\/strong>\u00a0 The Federal Motor Carrier Safety Administration (FMCSA) announced that it will extend the current waiver of the new hauling rules related to hours of service another 90 days, extending the waiver period through June 18, 2018.\u00a0 This means that the new regulations related to hours of service and electronic logging devices will not apply to people hauling agricultural commodities, supplies, livestock, or horses.\u00a0 The waiver does not apply to the rules regarding Commercial Drivers Licenses (CDLs) for agricultural haulers.\u00a0 [Read announcement <a href=\"https:\/\/www.fmcsa.dot.gov\/newsroom\/fmcsa-announces-new-eld-waiver-transporters-agricultural-commodities-and-additional\">here<\/a>.]<\/p>\n<p><strong>* Proposed $1.51 Billion Settlement Announced in Syngenta Litigation<\/strong>.\u00a0 Plaintiffs in the litigation pitting corn farmers against Synegnta involving genetically modified seeds containing the trait MIR-162 have filed a motion for preliminary approval of a settlement agreement.\u00a0 [Read Motion <a href=\"https:\/\/www.calt.iastate.edu\/sites\/default\/files\/document%2859%29.pdf\">here<\/a>.]\u00a0 Because the cases filed were class actions, any settlement must be preliminarily approved by a court, then notice and an opportunity to object or opt out is given to all class members, then a fairness hearing is heard, and a judge must decide whether to grant final approval.\u00a0 The proposed settlement would include all farmers, grain elevators, and ethanol facilities who have offered corn for sale between 9\/15\/2013 and the date of preliminary settlement approval (which has not yet occurred.)\u00a0 I will have a full blog post discussing this settlement in the coming weeks.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-5922\" src=\"https:\/\/agrilife.org\/texasaglaw\/files\/2018\/03\/pexels-photo-614006-1024x683.jpg\" alt=\"\" width=\"500\" height=\"333\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2018\/03\/pexels-photo-614006-1024x683.jpg 1024w, https:\/\/agrilife.org\/texasaglaw\/files\/2018\/03\/pexels-photo-614006-300x200.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2018\/03\/pexels-photo-614006-768x512.jpg 768w\" sizes=\"auto, (max-width: 500px) 100vw, 500px\" \/><\/p>\n<p><strong>* Report that Congress has &#8220;found a fix&#8221; for the co-op issue in tax reform bill.<\/strong>\u00a0 Lawmakers say they have &#8220;found a fix&#8221; for an issue in the recent tax reform act that gave an &#8220;unintended advantage&#8221; to cooperatives.\u00a0 Under the tax<span style=\"display: inline !important; float: none; background-color: transparent; color: #433c3a; font-family: 'minion-pro-1','minion-pro-2','Cambria','Georgia','Times New Roman',serif; font-size: 17px; font-size-adjust: none; font-stretch: normal; font-style: normal; font-variant: normal; font-weight: 400; letter-spacing: normal; line-height: 25.5px; orphans: 2; text-align: left; text-decoration: none; text-indent: 0px; text-shadow: none; text-transform: none; -webkit-text-stroke-width: 0px; white-space: normal; word-spacing: 0px;\"> law as passed, Section 199A allows farmers to deduct 20% of gross sales to cooperatives, but only 20% of net income if they sell to another purchaser.\u00a0 Legislators intend to include the amendment in the omnibus spending bill.<\/span><\/p>\n<p><strong>* Planning checklist for parents of children with special needs.<\/strong>\u00a0 I came across a blog post last week written by an Idaho attorney offering a checklist with regard to long-term planning for parents of children with special needs.\u00a0 This is such an important issue for all parents, but especially for those parenting kiddos with special needs.\u00a0 [Read checklist <a href=\"http:\/\/www.hallock-law.com\/planning-for-special-needs-children-a-parents-checklist\/\">here.<\/a>]<\/p>\n<p>*<strong>Reading, understanding dairy contracts is imperative.<\/strong>\u00a0 Indiana-based attorney Todd Janzen was recently interviewed for an article focusing in milk supply contracts in the dairy industry.\u00a0 Todd did a great job of outlining major issues that should be considered before entering a milk supply contract.\u00a0 [Read article here.]\u00a0 Todd also did a webinar on dairy supply contracts, and you can listen in on that recording <a href=\"http:\/\/nationalaglawcenter.org\/consortium\/webinars\/dairyk\/\">here<\/a>.<\/p>\n<p style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>Programs Next Week<\/strong><\/span><\/p>\n<p>Next week I will be in Ft.
