{"id":590,"date":"2013-10-03T17:00:00","date_gmt":"2013-10-03T22:00:00","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=590"},"modified":"2026-04-17T15:35:47","modified_gmt":"2026-04-17T20:35:47","slug":"october-4-2013-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2013\/10\/03\/october-4-2013-weekly-round-up\/","title":{"rendered":"October 4, 2013 Weekly Round Up"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"color: #993300;\">**This article is not a substitute for the advice of an attorney.**<\/span><\/p>\n<p>I spent this week traveling across Texas for various presentations and meetings.\u00a0 I enjoyed the chance to speak to the Texas Chapter of the American Society of Farm Managers and Rural Appraisers in Wichita Falls\u00a0 about current water legislation and litigation on Monday and to a group of landowners in Jack County about eminent domain and pipeline easement negotiations on Tuesday evening.\u00a0 To those of you who are new to the blog from those events, welcome!\u00a0 Here are a few ag law stories making the news this week.<\/p>\n<p><strong>Government Shut Down.<\/strong>\u00a0 The Delta Farm Press published an article this week outlining the impact of the government shut down on agriculture.\u00a0 You can read that <a href=\"http:\/\/deltafarmpress.com\/government\/what-expect-government-shutdown?intlink=rceoc\">here<\/a>.<\/p>\n<p><strong>Blocking Gas Wells with Water Wells?<\/strong>\u00a0 An interesting case was filed last week in West Virginia when a landowner who leased the mineral rights to an oil and gas\u00a0company, but then drilled water wells on his land that essentially prevented the oil company from drilling planned gas wells due to spacing requirements.\u00a0 The oil and gas company filed suit seeking an injunction to require the landowners to plug and abandon the water well so that they could go forward with drilling gas wells pursuant to the mineral lease that they hold.\u00a0[Read article <a href=\"http:\/\/www.observer-reporter.com\/article\/20130926\/NEWS04\/130929499\/-1\/News#.Ukw3cKMo6M9\">here<\/a>.]<\/p>\n<p><strong>Agritourism Article.<\/strong>\u00a0 The Southwest Farm Press ran an interesting <a href=\"http:\/\/southwestfarmpress.com\/management\/tis-season-extra-cash?NL=SWFP-01&amp;Issue=SWFP-01_20130927_SWFP-01_591&amp;YM_RID=tdowell@tamu.edu&amp;YM_MID=1424500&amp;sfvc4enews=42\">article about agritourism in Texas<\/a>.\u00a0 The article discusses different types of agritourism and the potential for making additional income from these types of activities.\u00a0 Importantly, the article also outlines many of the liability issues that come along with running an agritourism enterprise.\u00a0 Before beginning any agritourism activity on your land, it is critical that you secure adequate liability insurance and seek legal counsel to ensure that you are protected.<\/p>\n<p style=\"text-align: left;\"><strong>Vicious Horses?<\/strong>\u00a0 In the Connecticut Supreme Court, a battle is taking place over whether horses should be legally considered to be innately vicious animals.\u00a0 When a boy was bitten on the face by a horse at a Connecticut stable, his parents brought suit on his behalf.\u00a0 The\u00a0Connecticut Court of Appeals reversed the trial court and found that horses were innately vicious animals.\u00a0 This one ruling could have a significant impact on horse owners in Connecticut as it may make\u00a0it extraordinarily expensive or impossible\u00a0to insure horses.\u00a0 No other state has found horses to fall into this category.\u00a0 [Read article <a href=\"http:\/\/www.washingtonpost.com\/national\/bite-by-farm-horse-kicks-off-lawsuit-before-conn-court-on-whether-horses-are-innately-vicious\/2013\/09\/23\/0a810a64-2475-11e3-9372-92606241ae9c_story.html\">here<\/a>.]<\/p>\n<div id=\"attachment_605\" style=\"width: 191px\" class=\"wp-caption aligncenter\"><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/10\/kid.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-605\" class=\"size-medium wp-image-605 \" alt=\"\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/10\/kid-168x300.jpg\" width=\"181\" height=\"306\" \/><\/a><p id=\"caption-attachment-605\" class=\"wp-caption-text\">Photo via Leslie Carter, New Mexico<\/p><\/div>\n<p><strong>Florida v.
