{"id":519,"date":"2013-09-15T08:00:23","date_gmt":"2013-09-15T13:00:23","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=519"},"modified":"2026-04-17T15:35:48","modified_gmt":"2026-04-17T20:35:48","slug":"appeal-could-impact-new-mexico-oil-and-gas-law","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2013\/09\/15\/appeal-could-impact-new-mexico-oil-and-gas-law\/","title":{"rendered":"Appeal Could Impact New Mexico Oil and Gas Law"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"color: #993300;\">**This article is not a substitute for the advice of an attorney.**<\/span><\/p>\n<p>An application for appeal currently pending before the New Mexico Court of Appeals could impact how royalties are calculated and paid to royalty owners under New Mexico law.<\/p>\n<p>In 2003, a class action lawsuit was brought against Devon on behalf of several hundred royalty and overriding royalty owners in the San Juan Basin.\u00a0 The lawsuit alleged that Devon improperly reduced royalty payments when it deducted from royalties a share of the costs of compressing, dehydrating, treating, and transporting coalbed natural gas from the wellhead to the interstate pipeline.<\/p>\n<p>One of the central questions in this case is whether New Mexico recognizes the Marketable Condition Rule.\u00a0 The Marketable Condition Rule, recognized by several states including Colorado, requires that an producer bear all costs to place gas into marketable condition and prohibits these costs from being imposed on royalty owners.\u00a0 Other states, such as Texas, have rejected this rule and allow these\u00a0deductions to be taken from royalty payments.<\/p>\n<p>Recently, Santa Fe Judge T.
