{"id":516,"date":"2013-09-12T16:00:33","date_gmt":"2013-09-12T21:00:33","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=516"},"modified":"2026-04-17T15:35:48","modified_gmt":"2026-04-17T20:35:48","slug":"september-13-2013-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2013\/09\/12\/september-13-2013-weekly-round-up\/","title":{"rendered":"September 13, 2013 Weekly Round Up"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"color: #993300;\">**This article is not a substitute for the advice of an attorney.**<\/span><\/p>\n<p>Here are some of the agricultural law stories making news this second week of September.<\/p>\n<p>*\u00a0 <strong>Texas Groundwater Summit Presentations.<\/strong>\u00a0 A couple of weeks ago, I attended the Texas Groundwater Summit in San Marcos.\u00a0 It was a great conference put on by the Texas Alliance of Groundwater Districts.\u00a0 The presentations ranged from discussions about the basic authority of Groundwater Conservation Districts, to legal updates, to House Bill 4, to the potential use of brackish water, to fracking regulations, to underground disposal wells.\u00a0\u00a0 There was a great variety of speakers:\u00a0 Texas Commissioner of Agriculture Todd Staples, several politicians, engineers, scientists, attorneys,\u00a0city managers, and Groundwater Conservation District managers.\u00a0 The TAGD has a website where you can view all of the Power Point presentations given at the conference.\u00a0 There is some great information on this site&#8211;just click <a href=\"https:\/\/www.regonline.com\/builder\/site\/tab3.aspx?EventID=1201482\">here<\/a>.<\/p>\n<p>* <strong>Mexico\/United States Water Battle Update.<\/strong>\u00a0 As you recall from <a href=\"http:\/\/agrilife.org\/texasaglaw\/2013\/08\/04\/texas-water-wars-united-states-v-mexico\/\">this prior post<\/a>, Mexico and the United States have been in a battle over water owed to the US under a 1944 treaty.\u00a0 During the month of August, Mexico reduced their deficit of water owed to the US by nearly 100,000 acre feet.\u00a0 Both heavy rainfall and political pressure may have led to these additional diversions.\u00a0 As of August 31, 2031, Mexico&#8217;s deficit remains at 377,577 acre feet.\u00a0 [Read article <a href=\"http:\/\/www.brownsvilleherald.com\/news\/local\/article_3458c162-1767-11e3-b441-0019bb30f31a.html\">here<\/a>.]<\/p>\n<p><strong>*\u00a0 New Mexico County Fracking Ban Receives National Attention.\u00a0 <\/strong>Mora County, located in sparsely populated\u00a0northern New Mexico has gained national attention after becoming the first county in the United States to pass a complete ban on fracking.\u00a0 The county understands that it could face litigation over this ban and has found a law firm willing to represent the county pro bono if litigation arises.\u00a0 [Read article <a href=\"http:\/\/www.dailyfinance.com\/2013\/09\/09\/could-this-tiny-new-mexico-county-rewrite-fracking\/\">here<\/a>.]\u00a0 If other states are any indication, litigation may well occur.\u00a0 For example, you may recall from <a href=\"http:\/\/agrilife.org\/texasaglaw\/2013\/09\/06\/september-6-2013-weekly-round-up\/\">last week&#8217;s update <\/a>that litigation over municipal bans on fracking is currently pending before the highest court in New York State.<\/p>\n<p><strong>*\u00a0 Interesting Missouri Statute Upheld.<\/strong>\u00a0 This week, the Missouri Supreme Court\u00a0decided <em>St. Louis County v. River Bend Estates Homeowners&#8217; Association<\/em>,\u00a0an interesting\u00a0case dealing with &#8220;just compensation&#8221; in condemnation proceedings.\u00a0\u00a0The\u00a0United States Constitution (and most state constitutions, including the Texas Constitution) provide that private property may not be taken for public use without just compensation.\u00a0\u00a0Just compensation is generally defined as the market value of the property at the time of the\u00a0taking.\u00a0\u00a0Missouri, however, has a statute that\u00a0provides additional compensation, known as a &#8220;heritage value&#8221;\u00a0for people\u00a0whose families have\u00a0the land being taken for more than 50 years.\u00a0\u00a0Specifically, the statute provides\u00a0that when condemnation of property &#8220;prevents the owner from utilizing property in substantially the same manner as it was currently being utilized on the day of the taking and involving property owned within the same family for fifty\u00a0or more years&#8221; the compensation shall be the\u00a0fair market value plus a &#8220;heritage value&#8221; equal to 50% of the fair market value.\u00a0 In that instance, the proper amount of compensation is 150% of\u00a0 market value, rather than the normal 100% of market value.\u00a0 The condemner challenged the statute, claiming that it was unconstitutional.\u00a0 The Supreme Court disagreed and upheld the statute.\u00a0 [Read opinion <a href=\"http:\/\/www.inversecondemnation.com\/files\/st-louis-cnty-v-river-bend-estates---missouri-sct-9-10-2013.pdf\">here<\/a>.]<\/p>\n<p><span style=\"text-decoration: underline;\">What do you think&#8211;should additional value be given in cases where the land taken has been in a family for over 50 years?\u00a0 Is it unfair to award more compensation to certain landowners than to\u00a0 others for land with equal market value?<\/span><\/p>\n<p><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/09\/39658_1519412219046_6706225_n.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-527 aligncenter\" alt=\"39658_1519412219046_6706225_n\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/09\/39658_1519412219046_6706225_n-300x225.jpg\" width=\"350\" height=\"252\" \/><\/a><\/p>\n<p><strong>*\u00a0 COOL Injunction Denied.<\/strong>\u00a0 The U.S. District Court for the District of Columbia denied the plaintiffs&#8217; request for a preliminary injunction to prevent the USDA from implementing and enforcing its country of origin labeling regulations until a lawsuit challenging the constitutionality of the regulations is completed.\u00a0\u00a0As I have <a href=\"http:\/\/agrilife.org\/texasaglaw\/2013\/07\/11\/july-12-2013-weekly-round-up\/\">previously blogged about<\/a>,\u00a0in July\u00a0a group of plaintiffs, including the\u00a0 National Cattlemen&#8217;s Beef Association, American Meat Institute, National Pork Council, and Southwest Meat Association filed a lawsuit challenging the regulations.\u00a0 In light of the court&#8217;s decision, the regulations&#8211;which require labeling describing where meat was born, raised and slaughtered and prohibits the mixing of meat\u00a0from different countries&#8211;may be implemented despite the pending lawsuit.<\/p>\n<p><strong>*\u00a0 Discussion of Texas Groundwater management.<\/strong>\u00a0 The Southwest Farm Press reported that Texas groundwater was a topic of conversation this week at the Southwest Ag Issues Summit in Oklahoma City.\u00a0 The round-table discussion included the topics of potential federal regulation of groundwater, the fact that some politicians support a state-wide system of governing groundwater as opposed to the current local system of groundwater conservation districts, and discussion of the impact of fracking on groundwater in Texas.\u00a0 [Read article <a href=\"http:\/\/southwestfarmpress.com\/irrigation\/will-fed-take-over-groundwater-regulations?NL=SWFP-01&amp;Issue=SWFP-01_20130911_SWFP-01_395&amp;YM_RID=tdowell@tamu.edu&amp;YM_MID=1421769&amp;sfvc4enews=42\">here<\/a>.]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>**This article is not a substitute for the advice of an attorney.** Here are some of the agricultural law stories making news this second week of September. *\u00a0 Texas Groundwater Summit Presentations.\u00a0 A couple of weeks ago, I attended the Texas Groundwater Summit in San Marcos.\u00a0 It was a great conference put on by the Texas Alliance of Groundwater Districts.\u00a0 The presentations ranged from discussions about the basic authority of Groundwater Conservation Districts, to legal updates, to House Bill 4, to the potential use of brackish water, to&#8230;
