{"id":5082,"date":"2017-09-01T01:37:57","date_gmt":"2017-09-01T06:37:57","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=5082"},"modified":"2026-04-17T15:24:56","modified_gmt":"2026-04-17T20:24:56","slug":"september-1-2017-ag-law-weekly-round","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2017\/09\/01\/september-1-2017-ag-law-weekly-round\/","title":{"rendered":"September 1, 2017 Ag Law Weekly Round Up"},"content":{"rendered":"<p>It has been quite a week here in Texas. \u00a0To those of you suffering the devastating floods, our thoughts and prayers are with you.<\/p>\n<p>To those of you joining us this week who attended the Ranchers Leasing Workshops in Lubbock and College Station, welcome to the blog! \u00a0Also, happy to have new followers from the estate planning program I recently spoke at in Longview.<\/p>\n<p>Here are some of the ag law stories making news this week.<\/p>\n<p><strong>*WOTUS Rule repeal comment period extended through September 27, 2017.<\/strong> \u00a0The Environmental Protection Agency has extended the deadline for submitting comments regarding the repeal of the WOTUS rule. \u00a0Comments may be submitted <a href=\"https:\/\/www.regulations.gov\/document?D=EPA-HQ-OW-2017-0203-0001\">here<\/a>.<\/p>\n<p><strong>*Water Law Update webinar featuring Jesse Richardson.<\/strong> \u00a0My friend and West Virginia University College of Law Professor, Jesse Richardson, will be offering a free webinar on September 6, 2017 at 11:00 CST. \u00a0Jesse will discuss legislative developments, case law, regulations, and other water-related issues in the news. \u00a0For more information, <a href=\"http:\/\/nationalaglawcenter.org\/consortium\/webinars\/waterlawupdate\/\">click here.<\/a><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-5111\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2017\/08\/5012326360_092daebdfd_z.jpg\" alt=\"\" width=\"640\" height=\"413\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2017\/08\/5012326360_092daebdfd_z.jpg 640w, https:\/\/agrilife.org\/texasaglaw\/files\/2017\/08\/5012326360_092daebdfd_z-300x194.jpg 300w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/p>\n<p><strong>*Nuisance lawsuit filed against Hickman&#8217;s Family Farms chicken operation in Arizona.<\/strong> \u00a0Neighbors surrounding the Hickman Family Farms chicken operation near Tonopah, Arizona. \u00a0The facility houses about 4 million chickens and was built in 2014. \u00a0Neighbors complain of odor and flies. \u00a0Hickman says it is careful to try and prevent these issues and follows every governmental regulation. \u00a0Under Arizona law, the Right to Farm statute in that state may not apply given that the neighbor plaintiffs lived in the area before the chicken operation was built. \u00a0Under the Arizona Right to Farm <a href=\"http:\/\/nationalaglawcenter.org\/wp-content\/uploads\/assets\/righttofarm\/arizona.pdf\">statute<\/a>, the defense is available only if the agricultural operation was established prior to the non-agricultural surrounding uses. \u00a0[Read article <a href=\"http:\/\/www.azfamily.com\/story\/36214592\/neighbors-file-lawsuit-against-hickmans-family-farms-for-nuisance-in-tonopah\">here<\/a>.]<\/p>\n<p><strong>Ranchers Leasing Workshop is now available on demand to be taken anytime at your own pace.
