{"id":4941,"date":"2017-10-16T02:41:32","date_gmt":"2017-10-16T07:41:32","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=4941"},"modified":"2026-04-17T15:24:42","modified_gmt":"2026-04-17T20:24:42","slug":"texas-legislative-session-recap","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2017\/10\/16\/texas-legislative-session-recap\/","title":{"rendered":"Texas Legislative Session Recap"},"content":{"rendered":"<p>The 85th Legislative Session has come to a close.\u00a0 Here is a look at some of the key agriculture-related bills considered in Austin this year.\u00a0 Given the total number of bills introduced, this is not an exhaustive list of every bill that came up this\u00a0session, but instead\u00a0highlights some of the more important and more popular bills related to agriculture.\u00a0 To look up more information about any of these bills or to search for other bills by number or topic, visit\u00a0<a href=\"http:\/\/www.capitol.state.tx.us\/\">Texas Legislature Online.<\/a><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-5184\" src=\"https:\/\/agrilife.org\/texasaglaw\/files\/2017\/09\/austin-356878_1280.jpg\" alt=\"\" width=\"500\" height=\"667\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2017\/09\/austin-356878_1280.jpg 960w, https:\/\/agrilife.org\/texasaglaw\/files\/2017\/09\/austin-356878_1280-225x300.jpg 225w, https:\/\/agrilife.org\/texasaglaw\/files\/2017\/09\/austin-356878_1280-768x1024.jpg 768w\" sizes=\"auto, (max-width: 500px) 100vw, 500px\" \/><\/p>\n<p style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>BILLS THAT PASSED<\/strong><\/span><\/p>\n<p><strong>Farm Products\/Commodities<\/strong><\/p>\n<p><a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/HB00338F.pdf#navpanes=0\">HB 338<\/a>, known as the Producer Protection Act, relates to agricultural production purchase contracts.\u00a0 It passed, signed by Governor Abbott, and became law on September 1, 2017.\u00a0 \u00a0Specifically, it requires express delineation between acreage and production contracts and limits the ability of a purchaser to sue a producer based on a production contract.\u00a0 I&#8217;ve written a more detailed blog post on this new law previously, which can be found\u00a0<a href=\"https:\/\/agrilife.org\/texasaglaw\/2017\/08\/21\/new-rules-agricultural-product-purchase-contracts\/\">here<\/a>.<\/p>\n<p><a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/SB01172F.pdf#navpanes=0\">SB 1172<\/a> passed and was signed into law by Governor Abbott, effective on September 1.\u00a0 This law states that a political subdivision may not adopt an ordinance related to agricultural seed, vegetable seed, weed seed, or any other seed in any manner, including planting seed or cultivating plants grown from seed.\u00a0 Essentially, this means that local governments may not adopt regulations related to seeds, such as prohibiting planting GMO seed in their area, for example.<\/p>\n<p><strong>Drones<\/strong><\/p>\n<p>The Use of Unmanned Aircraft statute was amended by <a href=\"http:\/\/www.legis.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/HB01643F.pdf#navpanes=0\">HB 1643 <\/a>to include confined animal feeding operations (CAFOs) to the list of &#8220;critical infrastructure&#8221; facilities, allowing CAFOs certain statutory protections from drone flights.\u00a0\u00a0<a href=\"https:\/\/agrilife.org\/texasaglaw\/2017\/07\/25\/texas-legislature-adds-protections-cafos-drone-bill\/\">Click here<\/a> to read a prior blog post I wrote detailing this statute.\u00a0 This amendment became effective on September 1.<\/p>\n<p><strong>Property Taxes<\/strong><\/p>\n<p><a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/HB00777F.pdf#navpanes=0\">HB 777<\/a> was signed by Governor Abbott on May 23, 2017 and went into effect immediately.\u00a0 This bill ensures that military members will not lose open- space valuation for property tax purposes if they are unable to keep land in agriculture while they are deployed or stationed outside of Texas so long as they intend to resume the qualifying use within 180 days of their return from deployment or being stationed out of state.\u00a0 Landowners who are deployed or stationed outside of Texas should notify their county appraisal district of their duty station and intent to return and use the property within 30 days of deployment.<\/p>\n<p><a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/SB00594F.pdf#navpanes=0\">SB 594 <\/a>becomes effective January 1, 2018 and requires the Comptroller to develop and distribute manuals to county appraisal districts setting forth the method of appraising open-space and qualifying timberland.\u00a0 The rules published by the Comptroller will be developed in consultation with the Texas Department of Agriculture (for open-space) and the Texas Forest Service (for timber).<\/p>\n<p><strong>Ag Liens<\/strong><\/p>\n<p><a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/HB03063F.pdf#navpanes=0\">HB 3063<\/a>\u00a0was passed and became effective on September 1, 2017.\u00a0 This bill seeks to expand protection for grain producers in the event of\u00a0a grain elevator or warehouse failure.\u00a0 The bill provides that farmers have a lien on their grain if it is held in an open storage facility or in a licensed and bonded warehouse. [Read more <a href=\"http:\/\/texasfarmbureau.org\/additional-farmer-protection-turns-law-sept-1\/\">here<\/a>.]<\/p>\n<p><strong>Oil and Gas<\/strong><\/p>\n<p><a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/HB00129F.pdf#navpanes=0\">HB 129<\/a>\u00a0went into effect on September 1 and requires that oil and gas producers remitting royalty payments by check must provide the required royalty calculation information via check stub, attachment, or other remittance along with the payment, rather than by making this information available only online.\u00a0 A company could provide information in an online-only format only if the company obtained consent from the royalty owner.<\/p>\n<p><a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/HB03198F.pdf#navpanes=0\">HB 3198 <\/a>\u00a0makes clear that a county appraisal district may not revoke open-space or ag use valuation on land included in well pad sites or other oil and gas facilities if the remainder of the land not utilized for oil and gas operations otherwise qualifies for special use valuation.\u00a0 This bill was signed by Governor Abbott.<\/p>\n<p><span style=\"color: #000000;\"><strong>Estate\/Probate<\/strong><\/span><\/p>\n<p><a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/SB01193F.pdf#navpanes=0\">SB 1193<\/a> relates to digital assets and becomes effective September 1.\u00a0 The &#8220;Uniform Fiduciary Access to Digital Assets Act&#8221; deals with issues related to digital assets when the owner passes away.\u00a0 Texas Tech University School of Law professor Gerry Beyer wrote <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=3038052\">an article<\/a> on this new statute and offers steps that should be taken related to digital assets when planning and administering estates.<\/p>\n<p><span style=\"color: #000000;\"><a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/HB02271F.pdf#navpanes=0\">HB 2271<\/a> made a number of changes related to estate and probate law.\u00a0 For example, the estate value qualifying for a small estate affidavit option (in lieu of probate) increased from $50,000 to $75,000.<\/span><\/p>\n<p><span style=\"color: #000000;\"><a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/SB00499F.pdf#navpanes=0\">SB 499<\/a> adopts the Uniform Heirs Property Act in Texas.\u00a0 The purpose of this statute is to limit the situations where a tenant-in-common can seek partition of family-owned property.\u00a0 It applies to co-tenants who acquire an undivided ownership in property through intestate succession. The Uniform Law Commission has a detailed summary of this Act <a href=\"http:\/\/www.uniformlaws.org\/ActSummary.aspx?title=Partition%20of%20Heirs%20Property%20Act\">available here<\/a>.\u00a0 \u00a0<\/span><\/p>\n<p><span style=\"color: #000000;\"><a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/SB01249F.pdf#navpanes=0\">SB 1249<\/a> sets forth a procedure for a cotenant heir to adversely possess property if the tenant meets certain requirements, including a 10 year adverse possession period.<\/span><\/p>\n<p><span style=\"color: #000000;\"><a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/HB01974F.pdf#navpanes=0\">HB 1974<\/a> makes a number of changes to statutes related to a durable power of attorney.\u00a0 This bill was intended to facilitate more widespread acceptance of a power of attorney by requiring that powers of attorney must be <\/span>accepted <span style=\"color: #000000;\">unless a specific exception applies.<\/span><\/p>\n<p><span style=\"color: #000000;\"><a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/HB00995F.pdf#navpanes=0\">HB 995 <\/a>modifies the medical power of attorney statute to make clear that in the event that a power of attorney appoints a spouse, and then the marriage is dissolved, annulled, or otherwise declared void, the medical power of attorney is revoked unless the document provides otherwise.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>BILLS THAT FAILED<\/strong><\/span><\/p>\n<p><strong>Eminent Domain<\/strong><\/p>\n<p>SBs <a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/SB00740E.pdf#navpanes=0\">740<\/a>, <a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/SB00741I.pdf#navpanes=0\">741<\/a>, and <a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/SB00742I.pdf#navpanes=0\">742<\/a> and HBs <a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/html\/HB02684I.htm\">2684<\/a> and <a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/HB02694I.pdf#navpanes=0\">2694<\/a> sought to create statutory protections for landowners facing eminent domain.\u00a0 The provisions included allowing recovery of attorney fees for a landowner who successfully challenges a company in court and a list of minimum provisions that would be required to be included in an easement agreement.\u00a0 Numerous agricultural and landowner groups worked together to draft and support these bills, which did not pass this session.\u00a0 Be looking for similar legislative efforts in 2019.<\/p>\n<p><span style=\"color: #000000;\"><strong>Property Taxes<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">HB <a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/HB01211I.pdf#navpanes=0\">1211 <\/a>related to the rollback period if land is taken out of agricultural or open space valuation for tax purposes.\u00a0 Currently, owners of land no longer qualifying for the special use valution must pay a rollback tax of the difference between special use and regular valuation for the last five years and interest at a 7% rate.\u00a0 This bill sought to decrease the rollback period to three years and the interest rate to 5%.\u00a0 It was left pending in committee.<\/span><\/p>\n<p><a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/SB01979E.pdf#navpanes=0\">SB 1979 <\/a>related to both eminent domain and property taxes.\u00a0 The language provided that if land was taken out of agricultural use due to condemnation, then the condemning entity was responsible for payment of any difference in property taxes. This bill passed the Senate, but died in the House Ways &amp; Means Committee.<\/p>\n<p><span style=\"color: #000000;\"><strong>Water<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/SB00862E.pdf#navpanes=0\">SB 862 <\/a>would have allowed a court to award reasonable attorney&#8217;s fees and court costs to a prevailing party in a lawsuit involving a Groundwater Conservation District.\u00a0 Currently, the Water Code provides that a Groundwater Conservation District &#8220;shall&#8221; recover fees and costs if the district prevails in a case.\u00a0 The amendment would have amended this to say that a court &#8220;may&#8221; award fees and costs to any prevailing party in this type of litigation.\u00a0 Further, the bill would have capped an attorney fee award at $250,000.\u00a0 It passed the Senate, but was left pending in the House Natural Resources Committee.<\/span><\/p>\n<p><strong>Government Agency Actions<\/strong><\/p>\n<p><a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/SB00813F.pdf#navpanes=0\">SB 813 <\/a>would have allowed a person to recover damages, attorney&#8217;s fees, and court costs if he or she faced regulatory action by a state agency\u00a0 that was &#8220;frivolous, unreasonable, or without foundation.&#8221;\u00a0 This bill passed the legislature and was sent to Governor Abbott, who vetoed it on on June 15.\u00a0 He stated that though the bill was &#8220;well-intentioned&#8221; it would subject the state to financial liablity\u00a0that would be &#8220;borne by the taxpayers, not by the bureaucrats who caused the problem.&#8221;<\/p>\n<p><strong>Pesticides<\/strong><\/p>\n<p><a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/HB00572F.pdf#navpanes=0\">HB 572<\/a> would have created a pesticide disposal fund, which would have been funded by pesticide registration fees collected by TDA.\u00a0 This bill passed both houses, but was vetoed by Governor Abbott without a statement.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The 85th Legislative Session has come to a close.\u00a0 Here is a look at some of the key agriculture-related bills considered in Austin this year.\u00a0 Given the total number of bills introduced, this is not an exhaustive list of every bill that came up this\u00a0session, but instead\u00a0highlights some of the more important and more popular bills related to agriculture.\u00a0 To look up more information about any of these bills or to search for other bills by number or topic, visit\u00a0Texas Legislature Online.
