{"id":4929,"date":"2017-07-07T16:41:26","date_gmt":"2017-07-07T21:41:26","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=4929"},"modified":"2026-04-17T15:25:11","modified_gmt":"2026-04-17T20:25:11","slug":"july-7-2017-weekly-round","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2017\/07\/07\/july-7-2017-weekly-round\/","title":{"rendered":"July 7, 2017 Weekly Round Up"},"content":{"rendered":"<p>Amazingly enough, I stayed put here in Amarillo this week catching up on writing and podcast recording here at the office. \u00a0Here are some of the ag law stories in the news this week.<\/p>\n<p><strong>* Arkansas will ban Dicamba use for 120 days.<\/strong> \u00a0Following an increase in the number of pesticide\u00a0drift involving the application of Dicamba in Arkansas, the Arkansas State Plant Board voted to impose a 120-day ban on the application of the dicamba &#8220;Engenia&#8221; formation in the state. \u00a0In January 2017, Xtendimax dicamba technology was banned we as well. \u00a0In order for the Engenia ban to go into effect, it has to be approved by the Governor and pass a state legislative committee. \u00a0On Wednesday, the Governor indicated she would sign the ban and send it on to the committee. It appears from news reports that the committee approval has been granted. \u00a0[See article <a href=\"https:\/\/www.reuters.com\/article\/us-usa-arkansas-dicamba-idUSKBN19S2UE\">here<\/a>.] \u00a0What this means for farmers who planted Xtend soybeans is that they may not spray the crop with Engenia and will have to turn to other chemical or cultivation options to kill weeds. [Read article <a href=\"http:\/\/www.agprofessional.com\/resource-centers\/crop-protection\/arkansas-dicamba-ban-passes-heads-governors-desk\">here<\/a>.]<\/p>\n<p><strong>* Ranchers sue over the removal of COOL requirements.<\/strong> \u00a0A number of cattle groups, including R-CALF, United Stockgrowers of America, and Cattle Producers of Washington have filed suit in Washington federal court against the USDA claiming that the revocation of Country of Origin Labeling rules violates the Meat Inspection Act. \u00a0COOL rules were revoked by USDA after the World Trade Organization found them to violate WTO rules twice and threatened to allow retaliatory\u00a0sanctions from Mexico and Canada. \u00a0[Read Complaint <a href=\"https:\/\/www.publicjustice.net\/wp-content\/uploads\/2017\/06\/COOL-Complaint.pdf\">here.<\/a>]<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-3532\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2015\/12\/Kay.jpg\" alt=\"\" width=\"640\" height=\"334\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2015\/12\/Kay.jpg 640w, https:\/\/agrilife.org\/texasaglaw\/files\/2015\/12\/Kay-300x157.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2015\/12\/Kay-585x305.jpg 585w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/p>\n<p><strong>*Additional Syngenta trial dates set.<\/strong> \u00a0The MDL court has set trial dates for several additional class action trials involving Syngenta corn litigation. \u00a0The court ordered that AR and MO classes will be tried together in January 2018. \u00a0IL and NE classes will be tried together in April 2018. \u00a0IA and SD classes will be tried together in May 2018. \u00a0The Ohio class will be scheduled for October 2018. \u00a0Remember, there are numerous other state classes, including Texas, that have not yet been considered for certification but remain pending. \u00a0[View Order <a href=\"https:\/\/www.calt.iastate.edu\/sites\/default\/files\/document%2846%29.pdf\">here<\/a>.] \u00a0Additionally, there are several individual cases pending in Minnesota that are set to be tried this month. \u00a0For more information on the current status of the case or the recent $217 million verdict for the Kansas class, <a href=\"http:\/\/agrilife.org\/texasaglaw\/2017\/06\/23\/breaking-news-jury-awards-217-million-ks-corn-farmers-syngenta-class-action\/\">click here<\/a>.<\/p>\n<p><strong>* European Court of Justice rules of dairy labeling standards.<\/strong> \u00a0In June, the European Court of Justice ruled that products made from plants may not be labeled as &#8220;milk,&#8221;
