{"id":4923,"date":"2017-06-30T01:16:34","date_gmt":"2017-06-30T06:16:34","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=4923"},"modified":"2026-04-17T15:25:27","modified_gmt":"2026-04-17T20:25:27","slug":"june-30-2017-weekly-round","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2017\/06\/30\/june-30-2017-weekly-round\/","title":{"rendered":"June 30, 2017 Weekly Round Up"},"content":{"rendered":"<p>This week I spoke to a great group in Sweetwater about leases and estate planning. \u00a0Welcome to those of you joining from that meeting!<\/p>\n<p>There has been so much ag law news happening in the last couple of weeks that my head is still spinning. \u00a0Here are the highlights.<\/p>\n<p>*\u00a0<strong>Jury verdict for Kansas farmers in first Syngenta Viptera\/Duracade class action trial.<\/strong> \u00a0A Kansas jury awarded nearly $218 million to Kansas farmers in this much-watched class action suit, finding that Syngenta was negligent. \u00a0Syngenta has already said it plans to appeal. \u00a0I wrote a detailed blog post about the verdict <a href=\"https:\/\/www.reuters.com\/article\/us-syngenta-ag-lawsuit-idUSKBN19E1VY\">here<\/a>. \u00a0Going forward, there are individual cases in Minnesota set for trial in July and I understand that the next class action case will likely go early next year. \u00a0For those of you interested in this issue, I am planning on having class counsel appear on my <a href=\"http:\/\/aglaw.libsyn.com\/\">Ag Law in the Field Podcast<\/a>\u00a0in the next month or so, so be on the lookout for that.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-large wp-image-4924\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2017\/06\/pexels-photo-278927-1024x644.jpeg\" alt=\"\" width=\"640\" height=\"403\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2017\/06\/pexels-photo-278927-1024x644.jpeg 1024w, https:\/\/agrilife.org\/texasaglaw\/files\/2017\/06\/pexels-photo-278927-300x189.jpeg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2017\/06\/pexels-photo-278927-768x483.jpeg 768w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/p>\n<p>*<strong>EPA will rescind 2015 Waters of the United States (&#8220;WOTUS&#8221;) rule.<\/strong> \u00a0On Tuesday, the Environmental Protection Agency announced it would be taking the first step to rescind the definition of WOTUS as published in the Federal Register in 2015 and to re-codify the definition of WOTUS &#8220;which currently governs administration of the Clean Water Act.&#8221; \u00a0Essentially, it appears that the EPA intends to codify the approach taken prior to the WOTUS rule being passed. \u00a0Of course, as many remember, there was a great deal of uncertainty prior to the 2015 WOTUS Rule, leading to significant litigation. \u00a0The EPA has released its &#8220;pre-publication version&#8221; of the proposed rule defining Waters of the United Sates, which will be published in the Federal Register soon. \u00a0[Read pre-publication version <a href=\"https:\/\/www.epa.gov\/wotus-rule\/pre-publication-version-proposed-rule-definition-waters-united-states-recodification-pre\">here<\/a>.] \u00a0After publication, there will be a 30 day notice period for interested parties to submit comments about the new proposed rule. \u00a0[Read article <a href=\"https:\/\/www.nytimes.com\/2017\/06\/27\/climate\/epa-rescind-water-pollution-regulation.html\">here<\/a>.] \u00a0I&#8217;ll have a more detailed analysis of the new version of the rule upon its publication in the Federal Register.<\/p>\n<p><strong>*<\/strong><strong>ABC settles with BPI in \u00a0&#8220;pink slime&#8221; defamation suit.<\/strong> \u00a0BPI filed suit against ABC news seeking $5 million in damages after ABC news aired stories in 2012 referring to lean, finely textured beef product as &#8220;pink slime.&#8221; \u00a0BPI claimed that that coverage was defamatory and severely damaged their business. \u00a0The trial in this case began earlier this month and the settlement came before ABC put on its defense. \u00a0Terms of the settlement have not been disclosed. \u00a0[Read article <a href=\"http:\/\/www.businessinsider.com\/pink-slime-case-settlement-2017-6?utm_source=feedburner&amp;utm_medium=referral\">here<\/a>.]<\/p>\n<p><strong>*US Supreme Court issues decision in\u00a0<em>Murr v. Wisconsin<\/em> regulatory takings case.<\/strong> \u00a0You may remember from <a href=\"http:\/\/agrilife.org\/texasaglaw\/2016\/02\/22\/regulatory-takings-case-scotus\/\">this prior blog post<\/a> that the US Supreme Court heard argument in a case out of Wisconsin regarding a landowner claiming a regulatory taking of his property. \u00a0The Supreme Court held that their two lots constituted one parcel for purposes of regulatory takings analysis, and that no taking occurred based on the facts in this case. \u00a0I&#8217;ll have a more detailed blog post on this decision next week. \u00a0[Read full opinion <a href=\"https:\/\/www.supremecourt.gov\/opinions\/16pdf\/15-214_f1gj.pdf\">here<\/a>.]<\/p>\n<p><strong>* Federal District Judge affirms magistrate&#8217;s opinion in Montana Beef Checkoff litigation.<\/strong> \u00a0As we discussed in <a href=\"http:\/\/agrilife.org\/texasaglaw\/2017\/01\/09\/federal-magistrate-sides-producers-montana-beef-checkoff-lawsuit\/\">this prior post<\/a>, a Federal Magistrate recommended that the Federal District Judge deny a motion to dismiss and issue an injunction prohibiting the Montana Beef COuncil from using checkoff dollars to support promotional campaigns unless they obtain affirmative permission from the cattle producers paying the assessment. \u00a0The District Judge did just that. \u00a0The lawsuit will now proceed and the plaintiffs&#8217; First Amendment claims will move forward. \u00a0[Read article <a href=\"http:\/\/billingsgazette.com\/news\/local\/beef-council-must-get-permission-to-use-checkoff-fees-judge\/article_b6dbcf0a-3ed7-566d-bfb2-b4538a5528e0.html?utm_medium=social&amp;utm_source=twitter&amp;utm_campaign=user-share\">here<\/a>.]<\/p>\n<p><strong>* &#8220;All I Ever Wanted To Be Was a Soldier&#8221; now available.<\/strong> \u00a0Not ag law related, but I just finished helping my uncle write a book about his tour of duty in Vietnam back in 1969-1970. \u00a0It has been a project in the works for over 5 years, and we are quite proud to have it completed! \u00a0[View book info <a href=\"https:\/\/www.createspace.com\/7006859\">here<\/a>.]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>This week I spoke to a great group in Sweetwater about leases and estate planning. \u00a0Welcome to those of you joining from that meeting!
