{"id":479,"date":"2013-08-30T14:35:37","date_gmt":"2013-08-30T19:35:37","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=479"},"modified":"2026-04-17T15:36:06","modified_gmt":"2026-04-17T20:36:06","slug":"weekly-round-up-august-30-2013","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2013\/08\/30\/weekly-round-up-august-30-2013\/","title":{"rendered":"August 30, 2013 Weekly Round Up"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"color: #993300;\">**This article is not a substitute for the advice of an attorney.**<\/span><\/p>\n<p>Although\u00a0several\u00a0of this week&#8217;s major Texas court cases were discussed in <a href=\"https:\/\/agrilife.org\/texasaglaw\/2013\/08\/29\/decisions-decisions\/\">yesterday&#8217;s blog post<\/a>, here are some additional ag law stories making headlines this final week of August.<\/p>\n<p>1.\u00a0 Even Congressmen are confused over the EPA&#8217;s\u00a0plans to enforce the Spill, Prevention, Containment, and Countermeasure (&#8220;SPCC&#8221;) rule against farmers.\u00a0 Senators Inhofe and Pryor recently wrote a letter to the EPA &#8220;requesting clarification&#8221; of the EPA&#8217;s interpretation of its own authority to begin retroactive\u00a0enforcement of the SPCC rule on farmers.\u00a0 [Read letter <a href=\"https:\/\/www.inhofe.senate.gov\/download\/?id=eb618db1-b94a-481c-85d1-6e9a40a5d593&amp;download=1\">here<\/a>.]\u00a0\u00a0The rule would require farmers to install double-walled engine oil and diesel storage containers, build berms around their\u00a0 storage facility locations, and submit\u00a0a certification from a professional engineer\u00a0that they have complied with these requirements.\u00a0 Congress has been working to create an agricultural exemption to the rule in order to prevent farmers from being forced to bear the high costs of compliance.\u00a0 According to the Senators, the rule&#8217;s purpose was to ensure safety of large-scale energy production, rather than to deal with farms.\u00a0 Earlier this year, the Senate passed a bill that would exempt farmers from the SPCC rule.\u00a0 The House included a similar provision in its version of the Farm Bill.\u00a0 To date, no final exemption has been passed by both houses.\u00a0\u00a0 Initially,\u00a0the rule was set to apply to farmers\u00a0in May 2013, but that date was stayed due to concerns that the requirements had not been adequately explained.\u00a0 Currently, the rule is set to go into effect on September 23, 2013.\u00a0\u00a0 In response, the EPA stated that it has not investigated any farm for compliance with the SPCC.<\/p>\n<p>&nbsp;<\/p>\n<p>2.\u00a0 A Reuters article this week discussed concerns over the continued ability to rely on the Ogallala aquifer as a source of groundwater in the future.\u00a0 [Read article <a href=\"https:\/\/www.csmonitor.com\/Environment\/Latest-News-Wires\/2013\/0827\/Ogallala-aquifer-Could-critical-water-source-run-dry\">here<\/a>.]<\/p>\n<p>&nbsp;<\/p>\n<p>3.\u00a0 Despite defeating a lawsuit brought by an environmental group, a\u00a0Maryland federal\u00a0court has denied attorney fees to Perdue Farms\u00a0and\u00a0a contract farmer.\u00a0 Waterkeeper Alliance filed suit against a farmer and Perdue Farms, Inc.\u00a0under the Clean Water Act alleging that the farmer&#8217;s poultry operation (a family farm that contracted with Perdue to raise Cornish hens) was responsible for the release of\u00a0a high quantity of\u00a0pollutants into the Pocomoke River.\u00a0 After a trial, the court found for the Defendants.\u00a0 Specifically, the court found that although\u00a0there were high levels of contaminants in the water that were discharged from the farm, the Plaintiff failed to prove that the contamination was from the poultry operation.\u00a0 The only factual evidence showed the pollution to come from the family&#8217;s beef operation, but the lawsuit was brought only against the poultry operation.\u00a0 As prevailing parties under the Clean Water Act, Defendants sought nearly\u00a0$3 million in\u00a0attorney&#8217;s fees.\u00a0 Defendants&#8217; motion for fees pointed out that the\u00a0Plaintiff had made numerous misrepresentations to the press and the\u00a0public, failed to negotiate a settlement in good faith, and failure to conduct\u00a0proper testing to support the case.\u00a0\u00a0The court denied this request, finding that the Plaintiff&#8217;s claims were not frivolous, unreasonable, or without foundation as required in order to award attorney&#8217;s fees under the CWA.<\/p>\n<p>&nbsp;<\/p>\n<p>4.\u00a0 Several environmental groups (Center for Food Safety, Environmental Integrity Project, Food &amp; Water Watch, The Humane Society of the United States, and Iowa Citizens for Community Improvement)\u00a0have filed suit against the EPA for dropping its proposed CAFO reporting rule.\u00a0 The rule&#8211;proposed under the\u00a0Clean Water Act&#8211;would have required CAFOs located in certain watersheds to submit information about their operations to the EPA.\u00a0 The EPA withdrew the rule in 2012, stating that it believed it was more appropriate to determine CAFO information from existing sources, including the USDA.\u00a0 The Plaintiffs&#8217;
