{"id":4726,"date":"2017-04-19T01:23:50","date_gmt":"2017-04-19T06:23:50","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=4726"},"modified":"2026-04-17T15:25:41","modified_gmt":"2026-04-17T20:25:41","slug":"eminent-domain-white-paper-published-tamu-school-law","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2017\/04\/19\/eminent-domain-white-paper-published-tamu-school-law\/","title":{"rendered":"Eminent Domain White Paper Published by TAMU School of Law"},"content":{"rendered":"<p>Students at the Texas A&amp;M University School of Law recently published a white paper offering a survey of eminent domain laws in Texas and around the country. \u00a0This document, &#8220;<a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2017\/04\/A-Survey-of-Eminent-Domain-Law-in-Texas-and-the-Nation.pdf\">A Survey of Eminent Domain Law in Texas and the Nation<\/a>&#8221; was prepared by the students and presented to members of the Texas Legislature. \u00a0It is a very interesting paper, particularly in light of the eminent domain reform bills currently working their way through the Texas Legislature.<\/p>\n<p><a href=\"\/\/agrilife.org\/texasaglaw\/files\/2017\/04\/TAMUSOL.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-4728 size-full\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2017\/04\/TAMUSOL.jpg\" alt=\"\" width=\"600\" height=\"450\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2017\/04\/TAMUSOL.jpg 600w, https:\/\/agrilife.org\/texasaglaw\/files\/2017\/04\/TAMUSOL-300x225.jpg 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/a><\/p>\n<p>It is a very interesting paper, particularly in light of the eminent domain reform bills currently working their way through the Texas Legislature. \u00a0For example, many of you may know that Texas law does not currently have an attorney fee provision that would allow a landowner to recover his or her attorney&#8217;s fees if they are able to recover more money for their property than was initially offered by the condemnor. \u00a0This is one of the major changes that is included in the pending eminent domain reform legislation,\u00a0<a href=\"https:\/\/legiscan.com\/TX\/bill\/SB740\/2017\">Senate Bill 740<\/a>, currently in the Texas Legislature. \u00a0This paper looks at the availability of attorney fee recovery across the nation and provides maps and discussions of what statutes exist in different states.<\/p>\n<p>I&#8217;d highly recommend that anyone interested in eminent domain law take the time to read over this report. \u00a0Excellent work by the TAMU School of Law Students!<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Students at the Texas A&amp;M University School of Law recently published a white paper offering a survey of eminent domain laws in Texas and around the country. \u00a0This document, &#8220;A Survey of Eminent Domain Law in Texas and the Nation&#8221; was prepared by the students and presented to members of the Texas Legislature. \u00a0It is a very interesting paper, particularly in light of the eminent domain reform bills currently working their way through the Texas Legislature.
