{"id":4653,"date":"2017-03-17T01:26:03","date_gmt":"2017-03-17T06:26:03","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=4653"},"modified":"2026-04-17T15:25:54","modified_gmt":"2026-04-17T20:25:54","slug":"march-17-2017-weekly-round","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2017\/03\/17\/march-17-2017-weekly-round\/","title":{"rendered":"March 17, 2017 Weekly Round Up"},"content":{"rendered":"<p>Happy St. Patrick&#8217;s Day to you all! \u00a0And welcome to those of you joining from the Fannin County Ag Law Program we had last week in Bonham. \u00a0It was a great turn out and a wonderful audience.<\/p>\n<p>Here are some of the ag law stories in the news this week.<\/p>\n<p><strong>*Travis County Court issues Temporary Restraining Order in case over feral hog poison.<\/strong>\u00a0 The issue of feral hogs is one that has caused problems across Texas.\u00a0 One product on the market for controlling\u00a0feral hogs is warfarin-based Kaput. The EPA has already approved the product for general application, meaning that anyone could purchase the product for use. \u00a0\u00a0In February, the Texas Department of Agriculture (\u201cTDA\u201d) issued an emergency ruling that would allow the use of Kaput in order to kill feral hogs.\u00a0 The TDA\u2019s rule would allow only limited use application, meaning anyone applying the poison would be required to meet certain requirements.\u00a0 Wild Boar Meats, LLC filed a Complaint in Travis County Court seeking an Temporary Restraining Order, preventing the TDA\u2019s emergency rule from going into effect. \u00a0[Read <a href=\"http:\/\/www.courthousenews.com\/wp-content\/uploads\/2017\/03\/hog-poison.pdf\">Complaint here<\/a>.] \u00a0The On March 2, the Travis County District Court issued a Temporary Restraining Order prohibiting the TDA from \u201cimplementing, communicating, and enforcing\u201d the emergency rule until further order of the Court. \u00a0Specifically, the court found that because there was no \u201cimminent peril to public health, safety or welfare\u201d and because TDA \u201cdid not follow the requirements of the Texas Administrative Procedure Act,\u201d which makes the rule invalid. This order remains in place until the next hearing is held on March 30, 2017.[Read\u00a0<a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2017\/03\/TRO-here.pdf\">TRO here<\/a>].<\/p>\n<div id=\"attachment_4659\" style=\"width: 650px\" class=\"wp-caption aligncenter\"><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2017\/03\/5062125913_2a875d59d4_b.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-4659\" class=\"wp-image-4659 size-large\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2017\/03\/5062125913_2a875d59d4_b-1024x683.jpg\" alt=\"\" width=\"640\" height=\"427\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2017\/03\/5062125913_2a875d59d4_b.jpg 1024w, https:\/\/agrilife.org\/texasaglaw\/files\/2017\/03\/5062125913_2a875d59d4_b-300x200.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2017\/03\/5062125913_2a875d59d4_b-768x512.jpg 768w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/a><p id=\"caption-attachment-4659\" class=\"wp-caption-text\">TAMU Agrilife Extension Service photo by Bill Watson<\/p><\/div>\n<p><strong>*Texas residents receive legal notices of potential condemnation for border wall.<\/strong> \u00a0Some Texas landowners along the Texas border are receiving letters informing them that their property is being eyed for the border wall that has been planned by President Trump. \u00a0Of course, the government would have to pay &#8220;just compensation&#8221; for the property. \u00a0If the plans for the wall move forward, these landowners will have to determine whether\u00a0or not to fight the government&#8217;s offers of compensation for their land. \u00a0The Texas Observer published an article outlining one family&#8217;s story and showing a sample of the letter they received. \u00a0[Read article <a href=\"https:\/\/www.texasobserver.org\/texas-border-wall-mexico-condemnation-letter\/\">here<\/a>.]<\/p>\n<p>*<strong>Overview of liens for ag chemical &amp; seed providers.<\/strong>\u00a0 My friend Amber Miller, an attorney in Lubbock at Crenshaw Dupree &amp; Milam, recently published an article providing an overview of the statutory liens available to suppliers of ag chemicals and seeds. \u00a0Given the current state of the agriculture economy, this may become a major issue for any of you who sell ag chemicals or seeds. \u00a0And, even if you are a purchaser and not a seller, being aware of the legal options available to your supplier in the event that a bill is left outstanding is important. \u00a0[Read article <a href=\"http:\/\/www.cdmlaw.com\/lien-protections-for-ag-chemical-and-seed-providers\/\">here<\/a>.]<\/p>\n<p><strong>*&#8221;Pink Slime&#8221; lawsuit will go to jury.<\/strong> \u00a0In South Dakota, a judge has rejected a motion for summary judgment in a case pitting Beef Products Inc. against ABC News. \u00a0BPI lodged claims of defamation against ABC, Diane Sawyer, and journalist Jim Avila after a story ran discussing &#8220;lean, finely textured beef,&#8221; which ABC referred to as &#8220;pink slime.&#8221;\u00a0 The defendants argue their report was protected by the First Amendment. \u00a0Although the court did dismiss claims against news anchor Diane Sawyer, it found that a jury could find that ABC News and journalist Jim Avila acted recklessly in\u00a0publishing their story. \u00a0Now, the case will go before a jury for consideration. \u00a0[Read article <a href=\"https:\/\/www.wsj.com\/articles\/abc-news-to-face-south-dakota-jury-over-pink-slime-story-1489504974\">here<\/a>.]<\/p>\n<p><strong>* Everyone&#8211;even if you are single and childless&#8211;needs a will.<\/strong> \u00a0The New York Times published an article written by a single, childless reporter about the importance of having a will, regardless of one&#8217;s season of life. \u00a0He walks through his own thought process behind deciding it was time to get a will written up, including the ever-popular &#8220;to hire a lawyer or to rely on Google&#8221; issue. \u00a0(You can probably guess where I come down on that one.) \u00a0[Read article <a href=\"https:\/\/www.nytimes.com\/2017\/03\/10\/business\/retirement\/how-do-i-make-a-will.html?smprod=nytcore-iphone&amp;smid=nytcore-iphone-share&amp;_r=0\">here<\/a>.]<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Happy St. Patrick&#8217;s Day to you all! \u00a0And welcome to those of you joining from the Fannin County Ag Law Program we had last week in Bonham. \u00a0It was a great turn out and a wonderful audience.
