{"id":460,"date":"2013-08-21T11:33:08","date_gmt":"2013-08-21T16:33:08","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=460"},"modified":"2026-04-17T15:36:06","modified_gmt":"2026-04-17T20:36:06","slug":"breaking-news-aqha-ordered-to-pay-nearly-900000-in-attorneys-fees","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2013\/08\/21\/breaking-news-aqha-ordered-to-pay-nearly-900000-in-attorneys-fees\/","title":{"rendered":"Breaking News:  AQHA Ordered To Pay Nearly $900,000 In Attorney&#8217;s Fees"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"color: #993300;\">**This article is not a substitute for the advice of an attorney.**<\/span><\/p>\n<p>The American Quarter Horse Association has been ordered by Federal District Judge Mary Lou Robinson to pay $891,387 in attorney fees to the plaintiffs who successfully sued the AQHA for violating antitrust laws.\u00a0 (To read more about the lawsuit, click <a href=\"http:\/\/agrilife.org\/texasaglaw\/2013\/08\/05\/jury-finds-aqha-clone-ban-violates-antitrust-laws\/\">here<\/a>.)<\/p>\n<p><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/08\/eli2.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-425 aligncenter\" alt=\"eli2\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/08\/eli2.jpg\" width=\"164\" height=\"211\" \/><\/a><\/p>\n<p>Generally, attorney fees are not recoverable under Texas law unless they are permitted by statute or by contract.\u00a0 The federal antitrust statute that the jury found was violated by the AQHA\u00a0provides that anyone &#8220;injured in his business\u00a0or property by reason of anything forbidden in the antitrust laws&#8230;shall recover&#8230;a reasonable attorney fee.&#8221;\u00a0 Based upon this, the plaintiffs sought nearly $900,000 in attorney fees from the AQHA.<\/p>\n<p>After the jury found in favor of the plaintiffs, the court took the attorney fee issue under consideration.\u00a0 Judge Robinson ordered the plaintiffs to provide their billing records to the AQHA for review.\u00a0 The AQHA chose not to contest the hourly rates charged by the plaintiff&#8217;s lawyers, or the number of hours claimed on the bills.\u00a0 Instead, the AQHA argued that because the jury did not award any monetary damages to the plaintiffs, no attorney fees should be allowed.<\/p>\n<p>In her order (read full order <a href=\"http:\/\/allaboutcutting.net\/wp-content\/uploads\/2013\/08\/AQHA-140-Order-Granting-Attorneys-Fees.pdf\">here<\/a>),\u00a0Judge Robinson\u00a0found that the AQHA&#8217;s position that because plaintiffs recovered no damages they could recover attorney fees &#8220;must fail.&#8221;\u00a0\u00a0The\u00a0judge found that the violation of the antitrust statutes and the evidence presented by the plaintiffs that the\u00a0AQHA&#8217;s exclusion of cloned animals\u00a0created a monopoly and de-valued the clones\u00a0was sufficient\u00a0injury to entitle them to recover their attorney fees pursuant to the statute.\u00a0In summary, because the jury found that the AQHA violated the antitrust statutes, Judge Robinson held that the plaintiffs were entitled to attorney fees under those statutes.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>**This article is not a substitute for the advice of an attorney.** The American Quarter Horse Association has been ordered by Federal District Judge Mary Lou Robinson to pay $891,387 in attorney fees to the plaintiffs who successfully sued the AQHA for violating antitrust laws.\u00a0 (To read more about the lawsuit, click here.)
