{"id":4290,"date":"2016-12-26T01:51:31","date_gmt":"2016-12-26T07:51:31","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=4290"},"modified":"2026-04-17T15:26:45","modified_gmt":"2026-04-17T20:26:45","slug":"2016-ag-law-year-review-federal-level","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2016\/12\/26\/2016-ag-law-year-review-federal-level\/","title":{"rendered":"2016 Ag Law Year In Review:  Federal Level"},"content":{"rendered":"<p>2016 was quite a year for agricultural law. \u00a0From the FAA passing UAS regulations to a major water law decision by the Texas Supreme Court to Congress passing a GMO labeling bill, a lot has happened in the past 12 months. \u00a0We will take a look at the highlights in two parts, focusing today on federal issues and considering Texas issues in our next blog post.<\/p>\n<p><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2016\/10\/4973942775_bcc90ae814_z.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-4351\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2016\/10\/4973942775_bcc90ae814_z.jpg\" alt=\"4973942775_bcc90ae814_z\" width=\"450\" height=\"300\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2016\/10\/4973942775_bcc90ae814_z.jpg 640w, https:\/\/agrilife.org\/texasaglaw\/files\/2016\/10\/4973942775_bcc90ae814_z-300x200.jpg 300w\" sizes=\"auto, (max-width: 450px) 100vw, 450px\" \/><\/a><\/p>\n<p><strong>*WOTUS joint resolution vetoed, stay in place during litigation.<\/strong> \u00a0The controversy surrounding the Clean Water Act definition of &#8220;Waters of the United States&#8221; continued from years past, and there does not to appear to be an end in sight. \u00a0Currently, the nationwide stay issued by the United States Court of Appeals for the Sixth Circuit in late 2015 remains in place, and the new EPA definition of &#8220;Waters of the United States&#8221; is currently not in effect anywhere in the US. \u00a0In January 2016, Congress passed a joint resolution that would have declared the new EPA definition null and void. \u00a0On January 20, 2016, however, this bill was vetoed by President Obama. \u00a0Thus, litigation remains pending before numerous trial courts as well as before the Sixth Circuit. \u00a0Currently being considered are disputes over whether jurisdiction is proper before appellate or trial level federal courts. \u00a0[To review all prior WOTUS-related blog posts, click <a href=\"http:\/\/agrilife.org\/texasaglaw\/category\/wotus\/\">here<\/a>.]<\/p>\n<p>*<strong>Unanimous victory for landowners at United States Supreme Court.<\/strong> \u00a0Sticking with the Clean Water Act, landowners scored an important victory before the United States Supreme Court this year in\u00a0<em> US Army Corps of Engineers v. Hawkes.<\/em> \u00a0That case addressed the issue of when a landowner can appeal an approved jurisdictional determination from the EPA or Corps that their property includes a &#8220;water of the United States,&#8221; thereby imposing Clean Water Act jurisdiction. \u00a0The landowner, who did not agree with the Corps&#8217; determination filed an appeal. \u00a0The Corps argued that the landowner did not have the legal right to appeal. \u00a0Instead, they argued, his remedies were limited to obtaining the required Clean Water Act permits (at a significant cost) or proceeding with his project and waiting to be fined tens of thousands of dollars per day for not having the permits. \u00a0Siding with the landowner, the Court held that a landowner may immediately appeal an approved jurisdiction determination. \u00a0[Read blog post <a href=\"http:\/\/agrilife.org\/texasaglaw\/2016\/06\/13\/unanimous-victory-united-states-supreme-court-landowners\/\">here<\/a>.]<\/p>\n<p><strong>*FAA passes UAS regulations, opens commercial use in the United States.<\/strong> \u00a0After years of waiting, folks are now able to fly unmanned aircraft systems (&#8220;UAS&#8221; or &#8220;drones&#8221;) for commercial use in the US, thanks to the Federal Aviation Administration issuing final rules. \u00a0Importantly, all UAS\u00a0users&#8211;regardless of the purpose of the flight&#8211;are required to register their aircraft with the FAA. \u00a0For those making commercial use of the UAS, a host of rules regarding pre-flight, during flight and post-flight actions have been passed by the FAA and must be followed. \u00a0These include requirements like obtaining a pilots&#8217; certificate, conducting pre-flight safety checks, maintaining a visual line of sight, not flying faster than 100 mph or lower than 400&#8242;, and more. \u00a0[Read this prior blog post for a <a href=\"http:\/\/agrilife.org\/texasaglaw\/2016\/09\/19\/drone-rules\/\">summary<\/a>.]<\/p>\n<p><strong>* Lawsuits filed regarding drones and privacy.<\/strong> \u00a0There continue to be numerous news stories surrounding drones and privacy rights. \u00a0Several lawsuits are pending across the country involving issues related to UAS operation and privacy of landowners. \u00a0For example, in Kentucky, a landowner shot down a drone flying over his property. \u00a0The drone operator has filed a federal lawsuit seeking to determine the rights of the parties in this situation. \u00a0To read more about that case, <a href=\"http:\/\/agrilife.org\/texasaglaw\/2016\/02\/24\/federal-lawsuit-seeks-ruling-drone-rights\/\">click here<\/a>. \u00a0I&#8217;ve written extensively on these issues, including <a href=\"http:\/\/agrilife.org\/texasaglaw\/2016\/01\/19\/drones-privacy-part-potential-common-law-claims\/\">a post<\/a> on the possible common law claims available to landowners and the <a href=\"http:\/\/agrilife.org\/texasaglaw\/2016\/01\/19\/drones-privacy-part-potential-common-law-claims\/\">Texas Privacy Act<\/a>, an example of a statute addressing parties&#8217; rights.<\/p>\n<p>*<strong>Congress passes mandatory GMO labeling bill, state bills\u00a0pre-empted.<\/strong> \u00a0President Obama signed the federal GMO labeling bill into law in July. \u00a0The bill gives authority to the USDA to develop a labeling scheme within the next two years. \u00a0Further, the bill expressly pre-empts state laws including the Vermont law, which went into effect for a short time this year. \u00a0[Read prior post <a href=\"http:\/\/agrilife.org\/texasaglaw\/2016\/08\/05\/august-5-2016-weekly-round\/\">here<\/a>.]<\/p>\n<p><strong>*Lesser Prairie Chicken no longer on the Endangered Species list&#8230;for now.<\/strong> \u00a0The United States District Court for the Western District of Texas issued an order finding that the US Fish and Wildlife Service acted improperly when making its decision to list the Lesser Prairie Chicken as threatened under the Endangered Species Act. \u00a0Initially, the USFWS said they would appeal the decision, but later decided not to pursue that avenue. \u00a0Instead, the USFWS has indicated that it will start over and undertake the proper considerations and re-consider the listing. \u00a0[Read blog post <a href=\"http:\/\/agrilife.org\/texasaglaw\/2015\/11\/06\/court-vacates-lesser-prairie-chicken-listing-under-endangered-species-act\/\">here<\/a>.]<\/p>\n<p>*<strong>Special Master recommends denying\u00a0Motion\u00a0to Dismiss in Texas v. NM water law dispute. \u00a0<\/strong>The ongoing dispute between Texas and \u00a0New Mexico regarding the waters of the Rio Grande River and the 1938 Rio Grande Compact is still pending before the United States Supreme Court. \u00a0Essentially, Texas alleges that New Mexico is violating the compact by intercepting water between the Elephant Butte Reservoir and the Texas state line that belongs to Texas. \u00a0[Read blog post outlining the case <a href=\"http:\/\/agrilife.org\/texasaglaw\/2013\/09\/18\/texas-water-wars-texas-v-new-mexico\/\">here<\/a>.] \u00a0In July, the Special Master appointed by the Court to handle motions and discovery issued a report recommending that the Supreme Court deny New Mexico&#8217;s Motion to Dismiss the case and let Texas proceed with its claims. \u00a0[Read blog post <a href=\"http:\/\/agrilife.org\/texasaglaw\/2016\/07\/22\/july-22-2016-weekly-round\/\">here<\/a>.]<\/p>\n<p>*<strong>Judge Certifies 9 producer classes in Syngenta corn litigation.<\/strong> \u00a0Recently, the federal judge sitting on the multi-district litigation involving claims by producers and agribusinesses against Syngenta certified 9 classes of producers to proceed as class action cases. \u00a0[Read more about this <a href=\"http:\/\/agrilife.org\/texasaglaw\/2016\/10\/03\/court-certifies-9-classes-syngenta-litigation\/\">here<\/a>.] \u00a0The producers&#8217; claims center around Syngenta&#8217;s sale and marketing of a specific corn seed containing the trait MIR-162. \u00a0The genetically modified corn was approved for sale in the United States, but had not been approved by China.
