{"id":416,"date":"2013-08-15T17:53:38","date_gmt":"2013-08-15T22:53:38","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=416"},"modified":"2026-04-17T15:36:06","modified_gmt":"2026-04-17T20:36:06","slug":"august-16-2013-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2013\/08\/15\/august-16-2013-weekly-round-up\/","title":{"rendered":"August 16, 2013 Weekly Round Up"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"color: #993300;\">**This article is not a substitute for the advice of an attorney.**<\/span><\/p>\n<p>Here are a few ag law items making the news this week.<\/p>\n<p>&nbsp;<\/p>\n<p>* <strong>AQHA Case Update.<\/strong>\u00a0\u00a0Many of you were interested in the <a href=\"http:\/\/agrilife.org\/texasaglaw\/2013\/08\/05\/jury-finds-aqha-clone-ban-violates-antitrust-laws\/\">blog post last week <\/a>discussing the recent jury verdict against the American Quarter Horse\u00a0Association&#8217;s ban on registration of cloned animals.\u00a0 This week, the judge in that case\u00a0entered an injunction that requires the AQHA to begin registering clones and their offspring.\u00a0 The judge also considered the plaintiffs&#8217; claim\u00a0seeking\u00a0to recover\u00a0nearly $900,000 in attorney fees from the AQHA.\u00a0 The just has requested that briefing and billing statements be submitted and did not issue any ruling on the claim\u00a0at the hearing on Monday.<\/p>\n<p>According to the AQHA&#8217;s website, it is preparing to file a motion asking the court to set aside the jury&#8217;s verdict on grounds that it was not supported by the evidence.\u00a0 If that motion is denied, the AQHA says that it will file a notice of appeal of the decision.\u00a0 It is expected that upon the filing of an appeal, the AQHA will ask the judge to stay the requirement that clones be registered until the appeal is decided.<\/p>\n<p><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/08\/eli2.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-425 aligncenter\" alt=\"eli2\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/08\/eli2.jpg\" width=\"178\" height=\"225\" \/><\/a><\/p>\n<p>* <strong>Texas Facing Water Shortage.\u00a0 <\/strong>Two articles this week outline the water shortage facing Texas.<\/p>\n<p>First, 24\/7 Wall Street published an article listing 9 cities that are running out of water due primarily to a combination of drought and increased water demand from population growth.\u00a0\u00a0Five Texas cities made the list:\u00a0 Corpus Christi, Brownsville, Harlingen, \u00a0McAllen, and Lubbock.\u00a0\u00a0\u00a0 The remaining cities are in Colorado and New Mexico:\u00a0 Santa Fe, Albuquerque, Colorado Springs, and Pueblo.\u00a0 [Read article <a href=\"http:\/\/247wallst.com\/special-report\/2013\/08\/01\/nine-cities-running-out-of-water\/\">here<\/a>.]<\/p>\n<p>Second, the Southwest Farm Press reported on\u00a0a recent panel discussion\u00a0at the Texas Produce Conference\u00a0of\u00a0long-term water issues facing the state.\u00a0 If changes are not made, Texas will have a gap between water demand and water availability by 2060.\u00a0 The panelists believe that conservation will be a pivotal part of the state&#8217;s water strategy.\u00a0 Additionally, improved infrastructure will be key to preventing water loss.\u00a0 [Read article <a href=\"http:\/\/southwestfarmpress.com\/irrigation\/texas-faces-water-shortage-without-water-plan?page=1\">here<\/a>.]<\/p>\n<p>&nbsp;<\/p>\n<p>*\u00a0 <strong>CRP payments and Self Employment Tax<\/strong>.\u00a0 Confusion arises about whether CRP payments are subject to self employment tax.\u00a0 Generally, income that a farmer receives from farming is subject to the tax, but rental income is not.\u00a0 CRP rules refer to payments as &#8220;rent&#8221; and that has caused confusion among producers as to whether self employment taxes are owed.\u00a0 A recent Tax Court decision again holds that\u00a0normally\u00a0CRP payments are subject to the self employment tax.\u00a0 There is an exception, however, for farmers who also receive social security retirement or disability benefits.\u00a0 Farmers with land enrolled in CRP should contact their accountant to ensure that CRP payments are property reported on tax returns.\u00a0 [Read article <a href=\"http:\/\/farmdocdaily.illinois.edu\/2013\/08\/crp-payments-subject-se-tax.html\">here<\/a>.]<\/p>\n<p>&nbsp;<\/p>\n<p>* <strong>Iowa Plant Ends Horse Slaughter Bid.<\/strong>\u00a0After the temporary restraining order prohibiting two plants from commencing horse slaughter, one of the plants has announced it will no longer seek to slaughter horses.\u00a0 Responsible Transportation, located in Sigourney, Iowa, says that it cannot afford to wait for additional legal action and will turn its focus to slaughtering cattle.\u00a0 The second company, Valley Meat Co., which is located in Roswell, New Mexico, will continue to seek to open horse slaughter operations.\u00a0\u00a0The next hearing on this issue is expected within the next\u00a030 days in New Mexico federal court.\u00a0 [Read article <a href=\"http:\/\/www.desmoinesregister.com\/viewart\/20130813\/NEWS\/130813038\/Iowa-plant-drops-horse-slaughter-plan\">here<\/a>.]<\/p>\n<p>&nbsp;<\/p>\n<p>*\u00a0 <strong>Butter Cow Attack.\u00a0 <\/strong>Animal rights activists covered the Iowa State Fair Butter Cow in red paint last Sunday.\u00a0 The cow has been a fair tradition for over 100 years.\u00a0 The Animal Liberation Front made a statement following the attack, claiming that it was a &#8220;reminder that there are people opposed to the eating of meat and dairy and that the meat and dairy industry is inordinately cruel.&#8221;\u00a0 No arrests have been made yet, but the vandalism was cleaned up and the exhibit is back to normal.\u00a0 [Read article <a href=\"http:\/\/www.desmoinesregister.com\/article\/20130812\/NEWS\/130812010\/State-Fair-butter-cow-doused-in-red-paint-animal-rights-group-takes-credit?Frontpage&amp;nclick_check=1\">here<\/a>.]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>**This article is not a substitute for the advice of an attorney.** Here are a few ag law items making the news this week. &nbsp;
