{"id":3758,"date":"2016-02-26T01:09:08","date_gmt":"2016-02-26T07:09:08","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=3758"},"modified":"2026-04-17T15:28:08","modified_gmt":"2026-04-17T20:28:08","slug":"february-26-2016-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2016\/02\/26\/february-26-2016-weekly-round-up\/","title":{"rendered":"February 26, 2016 Weekly Round Up"},"content":{"rendered":"<p>Hello and welcome to the last Friday in February! \u00a0Earlier this week, I was in College Station speaking along with my friend and colleague, Shannon Ferrell, at a program called Petroleum Production on Agricultural Lands in Texas: \u00a0Managing Risks and Opportunities. \u00a0We had a great turn out and want to welcome those of you joining us from that presentation! \u00a0Now, on to the agricultural law news of the week, much of which is water related today.<\/p>\n<p><strong>* Breakdown of the\u00a0<em>Bragg<\/em> verdict.<\/strong> \u00a0As you <a href=\"http:\/\/agrilife.org\/texasaglaw\/2016\/02\/23\/jury-awards-2-5-million-to-braggs\/\">read earlier this week<\/a>, a jury has awarded $2.5 million to Medina County pecan farmers after the court found the Edwards Aquifer Authority&#8217;s denial of a permit to pump water for irrigation. \u00a0Now, the specific details of the verdict are available. \u00a0The verdict was reached by a 10-2 vote in Medina County District Court. \u00a0The jury found the difference in value before and after the taking (basically the value of the land with the requested water versus the value of the land without the water) to be \u00a0$1.37 million for the &#8220;Home Place&#8221; orchard, where the Braggs were given about half of the requested water and $1.18 million for the &#8220;D&#8217;Hanis&#8221; orchard where no water was allowed. When pre-judgment interest is calculated, the award will likely reach over $4 million. [View article <a href=\"http:\/\/www.law360.com\/articles\/762833?utm_source=rss&amp;utm_medium=rss&amp;utm_campaign=articles_search\">here<\/a>.]<\/p>\n<p><strong>* WOTUS challenge will remain at appellate court level.<\/strong> \u00a0The WOTUS drama continues this week when the three-judge panel hearing the case in the Sixth Circuit Court of Appeals ruled it did have jurisdiction over the challenge. \u00a0The question at hand was whether legal challenge to the WOTUS rule should be heard at the trial court level (federal district court) or at the appellate level (federal courts of appeals). \u00a0Two of the three judges agreed that the appellate level jurisdiction was proper based upon precedent set in past cases, even though the statute appeared to indicate that district court jurisdiction was appropriate. \u00a0At least for now, the case will continue on in the Sixth Circuit, where the court has already issued a nationwide stay on the application of the new rule. \u00a0My friend Peggy Hall at Ohio State University wrote a great summary of the opinion <a href=\"http:\/\/aglaw.osu.edu\/blog\/tue-02232016-231pm\/sixth-circuit-court-appeals-will-hear-challenge-wotus-rule\">here<\/a>. \u00a0 [Read\u00a0full opinions <a href=\"http:\/\/www.ca6.uscourts.gov\/opinions.pdf\/16a0045p-06.pdf\">here<\/a>.]<\/p>\n<p><strong>* Update on San Antonio Water Systems pipeline project.<\/strong> \u00a0You all may remember the pipeline project, approved by the SAWS and San Antonio City Council to purchase water from a Spanish-based company, Abengoa, that would be pumped in Burleson County and shipped via pipeline to San Anotnio. \u00a0Not long after the project was approved, Abengoa began pre-insolvency proceedings to avoid full bankruptcy filing. \u00a0The company just announced it plans to sell 80% of its interest in the SAWS pipeline project to an unknown third party. \u00a0[Read article <a href=\"http:\/\/www.expressnews.com\/news\/local\/article\/Some-City-Council-members-want-say-on-pipeline-6822121.php?t=f2fb32ec64&amp;cmpid=email-premium\">here<\/a>.] \u00a0As I was driving through Burleson County last week, signs like the one below made clear the controversy is far from over.<\/p>\n<p><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2016\/02\/San-Antone-Hose.jpg\" rel=\"attachment wp-att-3778\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-3778\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2016\/02\/San-Antone-Hose-1024x1024.jpg\" alt=\"San Antone Hose\" width=\"450\" height=\"450\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2016\/02\/San-Antone-Hose-1024x1024.jpg 1024w, https:\/\/agrilife.org\/texasaglaw\/files\/2016\/02\/San-Antone-Hose-150x150.jpg 150w, https:\/\/agrilife.org\/texasaglaw\/files\/2016\/02\/San-Antone-Hose-300x300.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2016\/02\/San-Antone-Hose-768x768.jpg 768w, https:\/\/agrilife.org\/texasaglaw\/files\/2016\/02\/San-Antone-Hose.jpg 1280w\" sizes=\"auto, (max-width: 450px) 100vw, 450px\" \/><\/a><\/p>\n<p><strong>* 2016 is the year of water law battles.<\/strong>\u00a0 Capital Press recently ran an interesting article projecting that several water battles will come to a head this year. \u00a0The article discusses a number of legal issues that could impact the agriculture industry, including the Clean Water Act. \u00a0For example, a California nursery was found to have violated the CWA when it failed to seek a permit before plowing a wetland area on its farm. \u00a0[The LA Times wrote a great article on this case. \u00a0Click <a href=\"http:\/\/www.latimes.com\/local\/abcarian\/la-me-0115-abcarian-farmer-wetlands-20160115-column.html\">here<\/a>.] The Corps of Engineers say that the CWA requires a permit, and that the &#8220;ongoing farming operations&#8221;
