{"id":3756,"date":"2016-02-19T10:22:55","date_gmt":"2016-02-19T16:22:55","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=3756"},"modified":"2026-04-17T15:28:08","modified_gmt":"2026-04-17T20:28:08","slug":"breaking-news-tx-and-nm-supreme-court-rulings-impact-ag","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2016\/02\/19\/breaking-news-tx-and-nm-supreme-court-rulings-impact-ag\/","title":{"rendered":"BREAKING NEWS: TX and NM Supreme Court Rulings Impact Agriculture"},"content":{"rendered":"<p>Well it turned into a busy week for ag law right at the last minute and after I posted the weekly round up. \u00a0Major actions\u00a0from the Texas and New Mexico Supreme Courts that have major impacts on the agriculture industry in both states.<\/p>\n<p>First up, the Texas Supreme Court will\u00a0<span style=\"text-decoration: underline;\">NOT<\/span> hear the appeal in\u00a0<em>Texas Farm Bureau v. Texas Commission on Environmental Quality. \u00a0<\/em>This case arose during the drought of 2012 when there was a shortage of water on the Brazos River. \u00a0Dow Chemical had a 1942 water right and sought a priority call requesting the TCEQ to cut off water rights to all junior water users, meaning users whose permits were issued after 1942. \u00a0The TCEQ issued the priority call and cut off water rights to over 700 junior water users, most of whom were farmers. \u00a0The order, however, made an exception for power generators and municipalities, allowing those junior users to continue pumping. \u00a0Several farmers got together with the Texas Farm Bureau and filed suit against TCEQ, arguing that this violated the prior appropriation doctrine. \u00a0The farmers basically argued that while they understood junior water rights could be curtailed in a time of drought, that rule applied to all junior users, and TCEQ could not pick certain users and allow them to keep pumping. \u00a0The TCEQ argued that they had the right to make these exceptions which were necessary for the public welfare. \u00a0Both the trial court and the Court of Appeals ruled in favor of the farmers. \u00a0The TCEQ had appealed to the Texas Supreme Court, and just today, that appeal was denied. \u00a0This means that the opinion from the Corpus Christi\u00a0Court of Appeals will stand. \u00a0<a href=\"http:\/\/agrilife.org\/texasaglaw\/2015\/04\/02\/court-of-appeals-sides-with-farmers-in-surface-water-case\/\">Click here<\/a> to read my prior blog post discussing this case and the Court of Appeals opinion in more detail.<\/p>\n<p><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2015\/07\/Agrilife-Extension.jpg\" rel=\"attachment wp-att-3159\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-3159\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2015\/07\/Agrilife-Extension-300x225.jpg\" alt=\"Agrilife Extension\" width=\"400\" height=\"300\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2015\/07\/Agrilife-Extension-300x225.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2015\/07\/Agrilife-Extension-1024x768.jpg 1024w, https:\/\/agrilife.org\/texasaglaw\/files\/2015\/07\/Agrilife-Extension.jpg 2048w\" sizes=\"auto, (max-width: 400px) 100vw, 400px\" \/><\/a><\/p>\n<p>Second, the New Mexico Supreme Court has issued a stay in a Court of Appeals ruling that found the agricultural worker exception to the Workers Compensation Act was unconstitutional. \u00a0As you may recall from <a href=\"http:\/\/agrilife.org\/texasaglaw\/2015\/07\/06\/new-mexico-court-of-appeals-agriculture-exclusion-to-workers-compensation-act-unconstitutional\/\">this prior blog post<\/a>, the Court of Appeals made this ruling in\u00a0<em>Rodriguez v. Brand West Dairy<\/em>. \u00a0 \u00a0When two agricultural workers&#8212;a chile farm hand and a dairy laborer and herdsman&#8211;were injured on the job, they sought workers compensation benefits, which were denied\u00a0because\u00a0New Mexico law excludes agricultural laborers from workers compensation coverage. \u00a0They filed suit claiming the exception violates the Equal Protection Clause. \u00a0The New Mexico Court of Appeals agreed with the workers and deemed the exclusion to be unconstitutional. \u00a0Perhaps most concerning for agricultural producers in the state was the finding that the ruling\u00a0would not only apply going forward (meaning that the exclusion would not apply to new workers compensation claims), but would also apply retroactively to all claims that were pending as of March 30, 2012. \u00a0On Thursday, the New Mexico Supreme Court issued a stay on this opinion. \u00a0Specifically, the Order states that &#8220;the precedential value of the Court of Appeals&#8217; opinion in <em>Rodriguez v.
