{"id":349,"date":"2013-08-01T17:00:33","date_gmt":"2013-08-01T22:00:33","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=349"},"modified":"2026-04-17T15:36:07","modified_gmt":"2026-04-17T20:36:07","slug":"august-2-2013-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2013\/08\/01\/august-2-2013-weekly-round-up\/","title":{"rendered":"August 2, 2013 Weekly Round Up"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"color: #993300;\">**This article is not a substitute for the advice of an attorney.**<\/span><\/p>\n<p>Happy August!\u00a0 Here are some agricultural law-related stories making the news this week.<\/p>\n<p><strong>* Arsenic in Texas Wells?<\/strong>\u00a0 A recent study looking at water well quality in the Barnett Shale region\u00a0has found elevated levels of arsenic in wells that are closer to natural gas extraction sites.\u00a0 The study tested 100 wells in the region where fracking has been used to extract natural gas and found that those with dangerous arsenic levels were generally closer to the natural gas\u00a0extraction sites\u00a0than\u00a0the wells with lower arsenic levels.\u00a0 It is not clear from the study, however, that\u00a0the natural gas\u00a0production caused the increased arsenic levels.\u00a0 The environmental\u00a0effects of fracking are a\u00a0hotly debated issue, and this study will likely add to that debate.\u00a0[Read study <a href=\"http:\/\/pubs.acs.org\/doi\/abs\/10.1021\/es4011724?prevSearch=Barnett&amp;searchHistoryKey=\">here<\/a>\u00a0and article <a href=\"http:\/\/www.texastribune.org\/2013\/07\/30\/fracking\/?utm_source=texastribune.org&amp;utm_medium=alerts&amp;utm_campaign=News%20Alert:%20Subscriptions\">here<\/a>.]<\/p>\n<p><strong>* Flurry of Nuisance Suits in New Mexico.<\/strong>\u00a0 Nuisance lawsuits and right to farm laws (both of which have been discussed previously on this blog <a href=\"http:\/\/agrilife.org\/texasaglaw\/2013\/07\/23\/nuisance-suit-against-hog-farmer-doesnt-fly-in-indiana\/\">here<\/a> and <a href=\"http:\/\/agrilife.org\/texasaglaw\/2013\/07\/24\/texas-right-to-farm-law\/\">here<\/a>) have been in the news recently in many states.\u00a0 This past week, New Mexico joined that list.\u00a0 [Read article <a href=\"http:\/\/cnjonline.com\/2013\/07\/25\/ag-producers-advocates-want-decades-old-right-to-farm-act-updated\/\">here<\/a>.]\u00a0 According to Dairy Farmers of America, there have been 11 nuisance lawsuits filed against dairies in New Mexico since 2011.\u00a0 All of these suits claim nuisance based on odor, flies, or obstructions, and all were filed by the same out-of-state law firm.\u00a0 The DFA and the dairies who have been sued are requesting amendments to New Mexico&#8217;s right to farm statute to ensure that agriculture is protected from this type of situation.\u00a0 Specifically, the\u00a0provision that allows suits to go forward against farms operating &#8220;negligently, improperly, or illegally&#8221; is seen as problematic because these terms are not defined by the statute.\u00a0 A group of agricultural interests groups representing cattle, sheep, and green chile producers\u00a0have all joined together in seeking a legislative amendment to the right to farm law next session in order to ensure protections for New Mexico producers.\u00a0 [Read New Mexico&#8217;s right to farm statute <a href=\"http:\/\/www.nationalaglawcenter.org\/assets\/righttofarm\/newmexico.pdf\">here<\/a> and article <a href=\"http:\/\/cnjonline.com\/2013\/07\/25\/ag-producers-advocates-want-decades-old-right-to-farm-act-updated\/\">here<\/a>.]<\/p>\n<p><strong>*\u00a0Half-Million Dollar Award for Hog Farmer<\/strong>.\u00a0 The Florida Court of Appeals has upheld a verdict awarding $505,000 to a hog farmer in an inverse condemnation action after a Florida voters passed an amendment to the Constitution banning farrowing crates.\u00a0 In\u00a0 2002, Florida voters approved a Constitutional amendment known as the &#8220;Pregnant Pig Amendment,&#8221; which went into effect in Florida in 2008.\u00a0 The amendment makes it unlawful &#8220;for any person to confine a pig during pregnancy in an enclosure, or to tether a pig during pregnancy, on a farm in such a way that she is prevented from turning around freely.&#8221;\u00a0 Prior to the 2002 amendment being passed,\u00a0Basford Farms\u00a0built operated a large commercial hog farm and built certain improvements o the property including a breeding barn, a gestation barn that used\u00a0gestation crates, a farrowing barn with farrowing crates, and a host of\u00a0other structures,\u00a0wells, and\u00a0lagoons.\u00a0 \u00a0After the amendment was passed in 2003,\u00a0Mr. Basford\u00a0closed down his business because he said he could not compete with other producers without the use of farrowing and gestation crates.\u00a0 He was unable to\u00a0use the majority of his barns and structures in his subsequent hay production operation, or for any other feasible operation.\u00a0 He then filed suit against Florida for inverse condemnation (meaning that the state took his property without providing just compensation in violation of the 5th Amendment).\u00a0 The state did not dispute that Mr. Basford could not use the structures\u00a0for other purposes, but\u00a0argued there was no taking because Mr. Basford was able to continue raising crops on his land and, therefore, he had not been deprived of all economic value.\u00a0 Mr. Basford\u00a0argued that the taking was not of his land, but of\u00a0the structures thereon, of which he was deprived of all economic value.\u00a0 The court found for Mr. Basford and held that the state did, by the rules of the Constitutional Amendment, take his property.\u00a0 [Read opinion <a href=\"http:\/\/opinions.1dca.org\/written\/opinions2013\/07-24-2013\/12-4106.pdf\">here<\/a>.]<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>Why is this<\/strong><\/span><strong><span style=\"text-decoration: underline;\"> significant<\/span>?<\/strong>\u00a0 This case is interesting for a couple of reasons.\u00a0 First, animal rights lobbies are pushing these type of animal rights bills and constitutional amendments in multiple states, so this is an issue that will likely continue to arise for producers.\u00a0 Second, this is the first reported case dealing with an inverse condemnation\u00a0claim in the context of animal rights legislation.\u00a0 Although the decision would not be binding on other states, it might be persuasive to other courts.\u00a0 Third,\u00a0the case points out that a takings claim may be made based not on regulation of the land, but on regulations that impact the structures themselves.<\/p>\n<p><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/07\/Sow-and-babies.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-367 aligncenter\" alt=\"Sow and babies\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/07\/Sow-and-babies.jpg\" width=\"281\" height=\"190\" \/><\/a><\/p>\n<p><strong>* More COOL Litigation.\u00a0<\/strong> Several meat industry groups are seeking a temporary injunction to stop the new country of origin &#8220;COOL&#8221; labeling requirements imposed by the Department of Agriculture.\u00a0 This request for an injunction comes after a <a href=\"http:\/\/agrilife.org\/texasaglaw\/2013\/07\/11\/july-12-2013-weekly-round-up\/\">lawsuit\u00a0was previously filed <\/a>against the USDA\u00a0claiming that the rules are unconstitutional as they violate the First Amendment.\u00a0 If granted, the temporary injunction would\u00a0prevent the rules from being enforced until the constitutionality of the rules can be decided by a court.\u00a0 The COOL regulations require that meat packaging provide information about where animals were born, raised and slaughtered.\u00a0 The groups claim that these new regulations will require them to spend millions in additional record-keeping and packaging costs.\u00a0 [Read article <a href=\"http:\/\/thehill.com\/blogs\/regwatch\/business\/313813-slaughtered-in-the-usa-meat-labeling-rule-draws-fresh-legal-attack-\">here<\/a>.]<\/p>\n<p><strong>*Super Sized Sodas Survive.<\/strong>\u00a0 The Supreme Court Appellate Division\u00a0in New York has found that\u00a0New York City&#8217;s\u00a0ban on large sodas in is unconstitutional.\u00a0 The court found that the law, which was presented by Mayor Michael Bloomberg and passed by the mayor-appointed Board of Health violates the separation of powers doctrine.\u00a0 Specifically, the court found that Mayor Bloomberg violated the separation of powers doctrine by sidestepping the City Council, and instead bringing the law before the Board of Health for consideration.\u00a0 The court explained that the Board&#8217;s action overstepped its power to regulate public health, and instead constituted policy-making, which is the province of the Legislative branch.\u00a0 Mayor Bloomberg says that the ruling will be appealed to the Court of Appeals (the highest appellate court in the state).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>**This article is not a substitute for the advice of an attorney.** Happy August!\u00a0 Here are some agricultural law-related stories making the news this week. * Arsenic in Texas Wells?\u00a0 A recent study looking at water well quality in the Barnett Shale region\u00a0has found elevated levels of arsenic in wells that are closer to natural gas extraction sites.\u00a0 The study tested 100 wells in the region where fracking has been used to extract natural gas and found that those with dangerous arsenic levels were generally closer to the&#8230;
