{"id":3477,"date":"2015-12-14T02:05:39","date_gmt":"2015-12-14T08:05:39","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=3477"},"modified":"2026-04-17T15:28:46","modified_gmt":"2026-04-17T20:28:46","slug":"2015-national-agriculture-law-year-in-review-part-i","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2015\/12\/14\/2015-national-agriculture-law-year-in-review-part-i\/","title":{"rendered":"2015 National Agriculture Law Year in Review (Part I)"},"content":{"rendered":"<p>As 2015 draws to a close, I thought it would be interesting to take a look back at the top agricultural law developments this year. \u00a0First, we will take a couple of posts to look at the national year in review, followed up by a look at the biggest Texas-specific happenings next week.<\/p>\n<p>From &#8220;Waters of the United States&#8221; to drones to GMOs to the United States Supreme Court, 2015 has been a busy year for agricultural law. \u00a0Here are the highlights.<\/p>\n<div id=\"attachment_3274\" style=\"width: 650px\" class=\"wp-caption aligncenter\"><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2015\/08\/Kay-5.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-3274\" class=\"wp-image-3274 size-large\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2015\/08\/Kay-5-1024x602.jpg\" alt=\"\" width=\"640\" height=\"376\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2015\/08\/Kay-5-1024x602.jpg 1024w, https:\/\/agrilife.org\/texasaglaw\/files\/2015\/08\/Kay-5-300x176.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2015\/08\/Kay-5.jpg 2048w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/a><p id=\"caption-attachment-3274\" class=\"wp-caption-text\">Agrilife Extension Photo by Kay Ledbetter<\/p><\/div>\n<p><strong>\u201cWaters of the United States\u201d regulation finalized, then stayed.<\/strong>\u00a0 Probably the most watched agricultural law issue of 2015 was the Environmental Protection Agency\u2019s and US Corps of Engineers\u2019 new regulation defining \u201cwaters of the United States\u201d pursuant to the Clean Water Act.\u00a0 The agencies solicited public comment in 2014 and issued their final rule in May.\u00a0 Numerous lawsuits followed challenging the scope of the rule and the procedure used in adopting the rule.\u00a0 Currently, these suits are pending in nine federal courts across the country.\u00a0 In October, the United States Court of Appeals for the Sixth Circuit issued a nationwide stay on the rule until the lawsuits can be considered.\u00a0 Shortly thereafter, the EPA\u2019s motion to consolidate all of the pending cases into one action before the United States District Court for the District of Columbia, was denied. \u00a0Although Congress considered bills seeking to overturn the new rule, in November the Senate\u2019s version of the bill failed to pass. \u00a0Thus, for now, the new rule is not in force and litigation continues. [Read prior posts <a href=\"http:\/\/agrilife.org\/texasaglaw\/2015\/01\/26\/wotus-all-the-fuss-about\/\">here<\/a> and <a href=\"http:\/\/agrilife.org\/texasaglaw\/2015\/10\/09\/breaking-news-sixth-circuit-issues-nationwide-stay-on-wotus-rule\/\">here<\/a> and <a href=\"http:\/\/agrilife.org\/texasaglaw\/2015\/09\/02\/clean-water-act-basics\/\">here<\/a>.]<\/p>\n<p><strong>Idaho \u201cag gag\u201d statute declared unconstitutional.<\/strong>\u00a0 An Idaho federal judge issued the first legal ruling on the constitutionality of a law prohibiting secret filming of farm operations (commonly referred to as \u201cag gag laws\u201d).\u00a0 The purpose of such laws, argue proponents, is to protect the safety and privacy of farm families, employees, and animals from animal activist groups infiltrating operations.\u00a0 Opponents, on the other hand, claim that the laws encourage animal abuse and infringe upon free speech rights.\u00a0 The court agreed with the challengers, finding that the Idaho law violated both the First Amendment and Equal Protection Clause.\u00a0 \u00a0\u00a0It is unclear at this time whether Idaho will appeal the court\u2019s decision.\u00a0 Several other states, including North Dakota, Montana, Kansas, Utah, Iowa, and Missouri have similar laws.\u00a0 The impact of the Idaho court\u2019s decision on laws in other jurisdiction remains to be seen, but is concerning to proponents of such laws. [Read prior posts <a href=\"http:\/\/agrilife.org\/texasaglaw\/2014\/07\/23\/what-are-ag-gag-laws\/\">here <\/a>and <a href=\"http:\/\/agrilife.org\/texasaglaw\/2015\/08\/10\/federal-judge-finds-idaho-ag-gag-law-unconstitutional\/\">here<\/a>.]<\/p>\n<p><strong>Lesser Prairie Chicken listing under Endangered Species Act vacated.<\/strong>\u00a0 In September, a federal judge in the Western District of Texas found that the US Fish and Wildlife Service failed to follow their own rules when listing the lesser prairie chicken as \u201cthreatened\u201d under the Endangered Species Act.\u00a0 Specifically, the USFWS failed to adequately take into consideration voluntary conservation plans entered into by landowners prior to the listing decision.\u00a0 Although the US FWS has not yet filed an appeal with the United States Court of Appeals for the Fifth Circuit, it is expected that one will be forthcoming.\u00a0 For now, however, the federal protections for the bird have been removed. [Read prior posts <a href=\"http:\/\/agrilife.org\/texasaglaw\/2014\/04\/07\/lesser-prairie-chicken-listed-as-threatened-under-endangered-species-act\/\">here<\/a> and <a href=\"http:\/\/agrilife.org\/texasaglaw\/2014\/06\/11\/breaking-news-lawsuit-challenges-lesser-prairie-chicken-listing\/\">here<\/a> and <a href=\"http:\/\/agrilife.org\/texasaglaw\/2015\/11\/06\/court-vacates-lesser-prairie-chicken-listing-under-endangered-species-act\/\">here<\/a>.]<\/p>\n<p><strong>RCRA \u201csolid waste\u201d provision applied to manure.<\/strong>\u00a0 Earlier this year, a Washington federal court found, for the first time, that manure met the definition of \u201csolid waste\u201d under the federal Resource Conservation and Recovery Act.\u00a0 The case involved the alleged improper storage and application of manure by dairies in Washington state.\u00a0 The result of the application of RCRA to manure is that federal requirements under the Act would apply.\u00a0\u00a0 Shortly after this decision, the parties settled the case, entering into a consent decree under which the dairies would undertake several steps to prevent manure contamination of groundwater.\u00a0 Whether this same decision will be made by other courts across the country is unclear.\u00a0 At least one dairy in California has reportedly been served with an intent to sue under RCRA.\u00a0 Producers should certainly be concerned that lawsuits under RCRA are a possibility and ensure proper handling, storage, and application of manure. [Read prior post <a href=\"http:\/\/agrilife.org\/texasaglaw\/2015\/05\/20\/washington-court-holds-manure-subject-to-federal-regulation-parties-agree-to-settle\/\">here<\/a>.]<\/p>\n<p><strong>Corn producers and agribusinesses file suits against Syngenta.<\/strong>\u00a0 After shipments of US corn were rejected by China due to the presence of a genetically modified Syngenta variety, MIR-162, several agribusinesses and corn producers across the country brought suit against Syngenta.\u00a0 The lawsuits, the vast majority of which have been consolidated in multi-district litigation, generally allege that Syngenta\u2019s selling of the seed in the US without Chinese approval caused a decline in the corn market due to the rejections.\u00a0 Syngenta, on the other hand, argues that the seed was approved for use in the United States, China was not a major purchaser of US corn, and there is no evidence of causation between the MIR-162 seed and the decline in corn prices. \u00a0Recently, Syngenta filed another suit against grain traders like Cargill and ADM, claiming that if there is any liability to corn farmers, the traders should bear the burden of a judgment. \u00a0The lawsuits remain pending.
