{"id":3231,"date":"2015-07-31T09:10:45","date_gmt":"2015-07-31T14:10:45","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=3231"},"modified":"2026-04-17T15:29:31","modified_gmt":"2026-04-17T20:29:31","slug":"july-31-2015-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2015\/07\/31\/july-31-2015-weekly-round-up\/","title":{"rendered":"July 31, 2015 Weekly Round Up"},"content":{"rendered":"<p><span style=\"color: #ff0000;\">*Don&#8217;t forget to nominate the Texas Agriculture Law Blog as one of the Top 100 Legal Blogs, <a style=\"color: #ff0000;\" href=\"http:\/\/www.abajournal.com\/blawgs\/blawg100_submit\/\">click here<\/a>.*<\/span><\/p>\n<p>The summer sure seems to be flying by and here we are at the end of July! \u00a0Here are a few ag law stories in the news this week.<\/p>\n<p><strong>* Investigation into whether Big Bend Pipeline Should Face Federal Regulation.<\/strong>\u00a0 You may remember from <a href=\"http:\/\/agrilife.org\/texasaglaw\/2015\/07\/17\/july-17-2015-weekly-round-up\/\">this prior blog<\/a> that a pipeline is proposed to transport natural gas between the Permian Basin and Mexico, through Big Bend. \u00a0This week, the Federal Energy Regulatory Commission has sought additional information from pipeline operator, Energy Transfer Partners, to show that it should be Texas, rather than FERC, that regulates the line. \u00a0ETP argues that the pipeline is mostly intrastate, it should be governed by the state entity in charge of pipelines, the Texas Railroad Commission. \u00a0Opponents argue that because the pipeline will cross the border into Mexico, it should be federally regulated. [Read article <a href=\"http:\/\/www.texastribune.org\/2015\/07\/24\/big-bend-pipeline-opponents-claim-small-victory\/\">here<\/a>.]<\/p>\n<p><strong>* TX Groundwater Districts Struggle to Track Disposal Wells.<\/strong>\u00a0 The Texas Tribune ran an article this week discussing difficulties facing Texas Groundwater Conservation Districts in tracking the locations of disposal wells. \u00a0The issue is centered around the fact that while groundwater wells are regulated by groundwater conservation districts (in those areas where districts exist), disposal wells are governed by the Texas Railroad Commission. \u00a0Further complicating the issue is that there is no legal requirement that groundwater districts be given written notice of a disposal well permit application filed in their jurisdiction. \u00a0A bill was offered in the Senate that would have required such notice be given to any GCD within 10 miles of the location of a proposed disposal well, but it did not make it out of the Senate. \u00a0Instead, GCDs are left attempting to track and follow disposal well permits in their areas through public notices published in the newspaper and a database managed by the Railroad Commission. \u00a0[Read article <a href=\"http:\/\/www.texastribune.org\/2015\/07\/29\/groundwater-officials-seek-help-tracking-disposal-\/\">here<\/a>.]<\/p>\n<p><strong>* \u00a0Life in Prison Recommended for Peanut Company CEO after Salmonella Outbreak. \u00a0<\/strong>[Read article here.] \u00a0Federal court officers have recommended a sentence of life in prison for Stewart Parnall, owner of Georgia peanut company, Peanut Corporation of America. \u00a0Parnall was convicted of 71 counts related to a salmonella outbreak in 2008 and 2009. \u00a0The charges included conspiracy, obstruction of justice, and wire fraud. \u00a0The outbreak was linked to 714 illnesses and 9 deaths. \u00a0Defense attorneys call the recommendation &#8220;unprecedented&#8221; and argue it is not proper as Parnall never meant to hurt anyone and claims he ate the peanut butter himself. \u00a0Sentencing will take place September 21, 2015 in Georgia. \u00a0[Read article <a href=\"http:\/\/hosted.ap.org\/dynamic\/stories\/U\/US_SALMONELLA_OUTBREAK_TRIAL?SITE=AP&amp;SECTION=HOME&amp;TEMPLATE=DEFAULT&amp;CTIME=2015-07-23-17-55-16\">here<\/a>.]<\/p>\n<p><strong>* \u00a0Threat of Pesticide Drift for Organic Farmers.<\/strong>\u00a0 I found an article discussing the threat of pesticide drift for organic farmers quite interesting. \u00a0Of course, pesticide drift from neighboring operations spraying crops is a risk of any farmer, but for organic farmers, the risk could be more serious and the damage more long-lasting. \u00a0For example, some organic farmers have been forced to forego selling products as organic for a season and others have faced multi-year issues if the pesticides got into the soil. \u00a0[Read article <a href=\"http:\/\/netnebraska.org\/article\/news\/984283\/pesticide-drift-threatens-organic-farms\">here<\/a>.]<\/p>\n<div id=\"attachment_3254\" style=\"width: 650px\" class=\"wp-caption aligncenter\"><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2015\/07\/Kay-Ledbetter-3.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-3254\" class=\"wp-image-3254 size-large\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2015\/07\/Kay-Ledbetter-3-1024x533.jpg\" alt=\"\" width=\"640\" height=\"333\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2015\/07\/Kay-Ledbetter-3-1024x533.jpg 1024w, https:\/\/agrilife.org\/texasaglaw\/files\/2015\/07\/Kay-Ledbetter-3-300x156.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2015\/07\/Kay-Ledbetter-3-585x305.jpg 585w, https:\/\/agrilife.org\/texasaglaw\/files\/2015\/07\/Kay-Ledbetter-3.jpg 2048w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/a><p id=\"caption-attachment-3254\" class=\"wp-caption-text\">Agrilife Research photo by Kay Ledbetter<\/p><\/div>\n<p><strong>* \u00a0Importance of Reviewing Your Estate Plan.<\/strong> \u00a0I recently wrote an article for Progressive Cattleman magazine outlining the importance of reviewing an estate plan. \u00a0As the article explains, creating an estate plan is a critical first step, but after that it is still extremely important to periodically review and update that plan. \u00a0This includes reviewing documents like wills, powers of attorney, and advanced healthcare directives, but also documents people may forget about like life insurance and pension beneficiaries. \u00a0[Read article <a href=\"http:\/\/www.progressivecattle.com\/topics\/management\/6919-the-importance-of-reviewing-and-updating-your-estate-plan\">here<\/a>.]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>*Don&#8217;t forget to nominate the Texas Agriculture Law Blog as one of the Top 100 Legal Blogs, click here.* The summer sure seems to be flying by and here we are at the end of July!
