{"id":2979,"date":"2015-06-04T16:21:24","date_gmt":"2015-06-04T21:21:24","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=2979"},"modified":"2026-04-17T15:30:05","modified_gmt":"2026-04-17T20:30:05","slug":"june-5-2015-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2015\/06\/04\/june-5-2015-weekly-round-up\/","title":{"rendered":"June 5, 2015 Weekly Round Up"},"content":{"rendered":"<p>This week I gave two presentations via the internet to folks in San Angelo and in Jefferson County. \u00a0To those of you new to the blog from these presentations, welcome!<\/p>\n<p>It&#8217;s been another busy week in the agricultural law realm.<\/p>\n<p><strong>* \u00a0Hays County Groundwater Bill on Governor&#8217;s Desk. \u00a0<\/strong>The Texas Legislature passed HB 3405, known as the \u00a0Hays County Groundwater Bill, sending it on to Governor Abbo[Read article <a href=\"http:\/\/www.texastribune.org\/2015\/05\/31\/hays-county-groundwater-bill\/\">here<\/a>.] \u00a0As you likely recall from prior blog posts, Hays County finds itself in the middle of a groundwater battle as a water supply company has secured groundwater rights and plans to drill a well field in the county, from which water will be produced and pumped to the suburbs of Austin. \u00a0Hays County is not part of a Groundwater Conservation District, which means that there is essentially no oversight of this type of pumping project. \u00a0HB 3405 expands the jurisdiction of the Barton Springs\/Edwards Aquifer Groundwater Conservation District to include the area where the proposed well fields will be drilled, thereby allowing the GCD&#8217;s rules to apply to the proposed fields. \u00a0If the GCD&#8217;s rules do end up preventing or limiting the right of the supply company to produce groundwater, most agree that litigation will follow. \u00a0[Read article <a href=\"https:\/\/www.texastribune.org\/2015\/05\/31\/hays-county-groundwater-bill\/\">here<\/a>.]<\/p>\n<p><span style=\"color: #000000;\"><strong>* \u00a0North Carolina Property Protection Act\/&#8221;Ag Gag&#8221; Law Passes Over Governor&#8217;s Veto.<\/strong>\u00a0 Despite the fact that North Carolina&#8217;s Republican governor vetoed an &#8220;ag gag&#8221; law passed by the state&#8217;s Congress, lawmakers on both sides of the aisle overrode the veto, voting the act into law. \u00a0[Read article <a style=\"color: #000000;\" href=\"http:\/\/www.wral.com\/lawmakers-override-mccrory-veto-on-controversial-private-property-bill\/14687952\/\">here<\/a>.] In his veto message [available <a style=\"color: #000000;\" href=\"http:\/\/www.foodsafetynews.com\/2015\/05\/north-carolina-governor-vetoes-ag-gag-bill-wants-whistleblower-protections\/#.VWxjVM9VhBc\">here<\/a>] the governor said that while he supported the basic premise of the law&#8211;the idea that employees seeking jobs for the purpose of corporate espionage should be prohibited&#8211;he felt that the law went too far and could be used to silence legitimate employees with concerns. \u00a0The bill [read full text <a style=\"color: #000000;\" href=\"http:\/\/www.ncleg.net\/Sessions\/2015\/Bills\/House\/PDF\/H405v4.pdf\">here<\/a>] provides that any person who gained access to nonpublic areas of another&#8217;s premises and engages in an act exceeding his or her authority was liable for damages. \u00a0Acts exceeding authority included (1) an employee entering for a reason other than a bona fide intent of seeking or holding employment and thereafter captures data, records, or documents, records sound, (2) an employee enters for a reason other than a bona fide intent of seeking or holding employment and places unattended surveillance devices or cameras to use against the employer; (3) a person knowingly paces an unattended camera or surveillance device and uses that device to capture images; (4) a person conspiring in organized retail theft; and (5) an act that substantially interferes with the ownership or possession of real property. \u00a0[Read article <a style=\"color: #000000;\" href=\"http:\/\/abc11.com\/politics\/governor-mccrory-vetoes-ag-gag-bill\/754427\/\">here<\/a>.] \u00a0The Act will go into effect January 1, 2016 and will apply to all incidents after that date.<\/span><\/p>\n<p><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2015\/01\/cow.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\" size-medium wp-image-2557 aligncenter\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2015\/01\/cow-219x300.jpg\" alt=\"cow\" width=\"219\" height=\"300\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2015\/01\/cow-219x300.jpg 219w, https:\/\/agrilife.org\/texasaglaw\/files\/2015\/01\/cow.jpg 234w\" sizes=\"auto, (max-width: 219px) 100vw, 219px\" \/><\/a><\/p>\n<p><strong>* Oklahoma Passes Law Preventing Local Fracking Bans.<\/strong> \u00a0Following in Texas&#8217; footsteps last month, Oklahoma has passed a law that prohibits local governments from enacting laws preventing fracking in their territory. \u00a0Governor, Mary Fallin, issued a statement that she believes the state corporation commissioners are in the best position to regulate the oil and gas industry as opposed to a patchwork of local regulations. \u00a0The bill does allow certain local laws to be passed, including reasonable regulations concerning roads, traffic, noise, odors, fencing, and spacing requirements. \u00a0[Read article <a href=\"http:\/\/www.santafenewmexican.com\/news\/oklahoma-is-latest-state-to-prevent-local-fracking-bans\/article_ef38cc9d-e2f8-507b-bdd8-cf13f65e5079.html\">here<\/a>.]<\/p>\n<p><strong>*Maryland Bans Fracking Through October 2017.<\/strong>\u00a0 Taking the approach opposite to Oklahoma&#8217;s, the Maryland legislature passed a bill ensuring that fracking will be prohibited in Maryland through October 2017. \u00a0During the time when fracking is prohibited, the state is required to draft regulations for when the ban lifts. \u00a0Although fracking has not been wide-spread in Maryland, it has been in neighboring Pennsylvania.
