Worth, where I spoke on agricultural law at Annie&#8217;s Project. \u00a0Next up, I discussed wildlife leases at a program sponsored by the Texas Parks and Wildlife in Bonham. \u00a0Finally, I wrapped things up speaking at a Landowner Rights Seminar in College Station. \u00a0To those of you new to the blog from these presentations, welcome!<\/p>\n<p>Here are some of the ag law stories recently in the news.<\/p>\n<p><strong>* Groundwater Continues in Bastrop County<\/strong>. \u00a0This week the Statesman ran an article outlining an ongoing water battle in Bastrop County. \u00a0The battle involves Bastrop&#8217;s request to pump 2,000 acre-feet of water per year by drilling a well on the XS Ranch, a planned development just north of the city. \u00a0Nearby landowners claim that allowing this project to go forward will jeopardize their water interests. \u00a0Leading the charge is\u00a0the owner of a neighboring ranch, who says she wants the city to fund an aquifer model to determine the potential impact of the City&#8217;s pumping project and include protections for local landowners if they are damaged. \u00a0The City argues these requests are unnecessary and expensive. \u00a0That neighboring landowner was found to have standing to challenge the City&#8217;s request before an administrative law judge at the State Office of Administrative Hearings. \u00a0Also challenging the City&#8217;s request is water developer Forestar, whose own petition to drill a well field was granted only in part last year based on the GCD&#8217;s claim that allowing more production could harm the area&#8217;s future water supply. \u00a0After the administrative hearing, the administrative law judge will issue proposed findings of fact and conclusions of law, which will then be considered by the City. \u00a0[Read article <a href=\"http:\/\/www.statesman.com\/news\/news\/local\/bastrops-water-fight-roars-on\/nk8Ty\/\">here<\/a>.]<\/p>\n<p><strong>* Vermont GMO Labeling Law Scores Court Victory.<\/strong> \u00a0The Vermont GMO labeling law, discussed in <a href=\"http:\/\/agrilife.org\/texasaglaw\/2014\/11\/12\/gmo-labeling-laws-where-are-we-now\/\">this prior post<\/a>, recently received a victory in court when challengers were denied a preliminary injunction in the case and portions of the State&#8217;s motion to dismiss were granted.\u00a0 Read 84-page opinion <a href=\"http:\/\/www.consumerproductmatters.com\/files\/2015\/04\/vermont-decision_81793.pdf\">here<\/a>. \u00a0 Specifically, the court found that the plaintiffs were unlikely to succeed on their First Amendment claim as there was evidence sufficient to satisfy the &#8220;reasonable relationship&#8221; test between the state&#8217;s interest and the GMO labeling requirements. \u00a0Next, the court dismissed the Commerce Clause claim, reasoning that there are no other conflicting state labeling laws at this time. \u00a0Additionally, the court found that the labeling law was not pre-empted by federal regulations. \u00a0The bright spot for plaintiffs came with regard to the prohibition on labeling products containing GMOs as &#8220;natural.&#8221; \u00a0Here, the court allowed the plaintiffs challenge to go forward on this issue based on First Amendment and Commerce Clause grounds.\u00a0 \u00a0[Read articles <a href=\"http:\/\/www.agweb.com\/farmjournal\/blog\/ag-in-the-courtroom\/recapping-round-1-of-the-vermont-gmo-labeling-lawsuit\/\">here<\/a> and <a href=\"http:\/\/www.agandfoodlaw.com\/2015\/04\/us-district-court-allows-vermont-gmo.html\">here<\/a>.]<\/p>\n<p><strong>* Idaho &#8220;Ag Gag&#8221; Law Argued in Court.<\/strong> \u00a0As we discussed in this <a href=\"http:\/\/agrilife.org\/texasaglaw\/2014\/09\/10\/idaho-judge-allows-ag-gag-lawsuit-to-move-forward\/\">prior blog,<\/a> Idaho passed its\u00a0Interference with Agricultural Production act last year, which criminalizes certain actions, including entry onto an agricultural operation and recording video thereof. \u00a0Last week, the judge conducted a summary judgment hearing on the constitutionality of this statute. \u00a0Specifically, challengers argue the statute violates the First Amendment&#8217;s guarantee of free speech and the Equal Protection Clause. \u00a0It is expected the judge will issue a written ruling in the coming weeks. \u00a0[Read article <a href=\"http:\/\/www.spokesman.com\/stories\/2015\/may\/03\/idaho-ag-gag-law-challenged-in-federal-court\/\">here<\/a>.]<\/p>\n<p><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/08\/dairy.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\" size-medium wp-image-485 aligncenter\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/08\/dairy-300x200.jpg\" alt=\"dairy\" width=\"300\" height=\"200\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2013\/08\/dairy-300x200.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2013\/08\/dairy.jpg 960w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p><strong>* Basic Primer on Estate Planning for Farmers.<\/strong> \u00a0The Delta Farm Press recently ran a great piece providing information for farm families to consider when drafting estate plans. \u00a0These are issues that face all operations and this article does a good job of laying out some of the most important considerations. \u00a0[Read article <a href=\"http:\/\/deltafarmpress.com\/management\/estate-planning-farmers-basic-primer?NL=DFP-01&amp;Issue=DFP-01_20150507_DFP-01_593&amp;sfvc4enews=42&amp;cl=article_2&amp;utm_rid=CPG02000000698080&amp;utm_campaign=3849&amp;utm_medium=email\">here<\/a>.]<\/p>\n<p><strong>* State Bar of Texas Agricultural Law Course Coming Up Soon.<\/strong> \u00a0In two weeks, I will be attending the 9th annual John Huffaker Agricultural Law Course in Lubbock. \u00a0This course offers nearly 14 hours of CLE credits for attorneys and will cover a wide variety of topics including crop insurance, drones on the farm, conservation easements, water law, livestock production in the public eye, labor and employment, and a legislative update. \u00a0For more information or to register, <a href=\"http:\/\/www.texasbarcle.com\/materials\/Programs\/3103\/Brochure.pdf\">click here<\/a>. \u00a0I hope to see some of you at the event and plan to be Tweeting from the course for those of you who follow me (@TiffDowell) on Twitter.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Last week, I found myself all over the state at various meetings. \u00a0I kicked things off in Ft.
