{"id":276,"date":"2013-07-26T11:29:25","date_gmt":"2013-07-26T16:29:25","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=276"},"modified":"2026-04-17T15:36:07","modified_gmt":"2026-04-17T20:36:07","slug":"july-26-2013-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2013\/07\/26\/july-26-2013-weekly-round-up\/","title":{"rendered":"July 26, 2013 Weekly Round Up"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"color: #993300;\">**This article is not a substitute for the advice of an attorney.**<\/span><\/p>\n<p>Here are a few ag law stories that were in the news this week.\u00a0 I hope everyone enjoys the last weekend in July&#8211;the summer is flying by!<\/p>\n<p>1.\u00a0 A new federal\u00a0study reports that climate change will make it increasingly difficult for New Mexico to meet its legal obligations to deliver water downstream\u00a0under various water compacts.\u00a0 This includes concern over deliveries from New Mexico to\u00a0Texas under the Rio Grande Compact.\u00a0 [Read article <a href=\"http:\/\/southwestfarmpress.com\/irrigation\/new-federal-study-indicates-less-available-water-new-mexico?page=2\">here<\/a>.]<\/p>\n<p><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/07\/Field.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-322 aligncenter\" alt=\"Field\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/07\/Field.jpg\" width=\"196\" height=\"232\" \/><\/a><\/p>\n<p>2.\u00a0 North Dakota has recently been studying the affects of dust on crops.\u00a0 Specifically, the study will look at\u00a0the impacts on crops\u00a0from increased rural traffic due to oil drilling.\u00a0 The study began after the state received complaints from numerous farmers and ranchers in North Dakota who claimed that dust from traffic on dirt roads stunted crops, caused allergic reactions in livestock, and damaged pasture land.\u00a0 [Read article<a href=\"http:\/\/www.agweek.com\/event\/article\/id\/18759\/publisher_ID\/80\/\"> here<\/a>.]<\/p>\n<p>3.\u00a0 The Animal Legal Defense Fund has filed suit against the California State Fair over the use of farrowing crates in a nursery exhibit at the fair.\u00a0 The lawsuit claims that the California State Fair violates animal cruelty laws by using farrowing crates.\u00a0 The ALDF argues that these\u00a0\u00a0crates deprive pigs of exercise, cause &#8220;needless suffering,&#8221; and deprive the pigs of their &#8220;maternal instinct to engage in nest-building behavior.&#8221;\u00a0 The lawsuit seeks alternative housing&#8211;specifically open pens&#8211;for the pigs, and seeks to prevent transporting the\u00a0sows to the fair so close to giving birth due to stress on the animals.\u00a0\u00a0The State Fair issued a written statement explaining hat farrowing crates are standard practice in the commercial hog industry, and that veterinarians are on sight at all times during the fair to monitor the animals and answer questions from visitors.\u00a0 The Livestock Nursery Exhibit, which allows visitors to witness live births of pigs, cows and sheep and to ask questions of veterinarians, is one of the most popular exhibits at the fair.\u00a0 [Read article <a href=\"http:\/\/www.sacbee.com\/2013\/07\/18\/5576932\/animal-rights-group-sues-state.html\">here<\/a>.]<\/p>\n<p>4.\u00a0 The New Mexico Environment Department has denied the request from Valley Meat Company, a packing plant in Roswell that intends to commence horse slaughter operations on August 5, 2013,\u00a0to renew its lapsed water discharge permit.\u00a0 The NMED will require a public hearing before determining whether to renew the permit.\u00a0 Also this week, several people including actor Robert Redford, former New Mexico Governor Bill Richardson, and current New Mexico Attorney General Bill King announced that they will seek to intervene in a lawsuit filed by animal rights groups against Valley Meat Company and another Iowa-based plant \u00a0in\u00a0order to oppose\u00a0horse slaughter.\u00a0[Read articles <a href=\"http:\/\/www.stltoday.com\/business\/local\/permit-denied-for-nm-horse-slaughter-company\/article_0bfe6dde-ce2e-5864-af4a-c43bd63ed7a6.html\">here<\/a> and <a href=\"http:\/\/newmexico.watchdog.org\/18941\/nm-attorney-general-joins-opposition-to-horse-slaughter-plant-defenders-say-its-grandstanding\/\">here<\/a>.]<\/p>\n<p>5.\u00a0 A lawsuit has been filed in Utah seeking to overturn\u00a0a state\u00a0statute that\u00a0prohibits undercover filming or photographing\u00a0of livestock\u00a0operations.\u00a0\u00a0Violators\u00a0are guilty of a misdemeanor and could face up to one year in\u00a0jail.\u00a0 The Animal Legal Defense Fund and the People for the Ethical Treatment of Animals filed the lawsuit in federal court.\u00a0 The groups argue that the Utah statute violates the First Amendment.\u00a0 [Read article <a href=\"http:\/\/www.heraldextra.com\/news\/state-and-regional\/utah\/activists-target-utah-s-agricultural-gag-law\/article_9175356d-bbf4-58fe-86f7-42274482232d.html\">here<\/a>.]\u00a0\u00a0\u00a0Several other states have enacted\u00a0similar statutes, including Iowa, Montana, North Dakota, and Kansas.<\/p>\n<p>6.\u00a0 A recent decision by the Texas Court of Appeals for the Third Circuit discusses a landowner&#8217;s ability to challenge a proposed annexation of property.\u00a0 In <em>Cockins v. City of Lakeway<\/em>, the court found that landowners have standing to challenge whether the city had the power to annex land, but do not have standing to challenge whether the city correctly followed procedural requirements.\u00a0 In this case, the court found that landowners could properly challenge whether the annexation was completed within the required 90 day period and whether the property fell within a statute describing the type of land could be annexed.\u00a0 On the other hand, the landowners lacked standing to challenge whether the city complied with various procedural provisions in the Local Government Code.\u00a0 Standing to challenge the procedural requirements\u00a0is vested only with the State.\u00a0 [Read full opinion <a href=\"http:\/\/www.search.txcourts.gov\/SearchMedia.aspx?MediaVersionID=9fe2b00b-b7a0-4257-95e8-ece424215709&amp;MediaID=ae312a6d-5a14-4a65-b2de-ccbeea77e621&amp;coa=&quot; + this.CurrentWebState.CurrentCourt + @&quot;&amp;DT=Opinion\">here<\/a>.]<\/p>\n<p>7.\u00a0 Lastly, there is some news\u00a0related to\u00a0a<a href=\"http:\/\/agrilife.org\/texasaglaw\/2013\/07\/11\/july-12-2013-weekly-round-up\/\"> lawsuit I mentioned\u00a0two weeks ago\u00a0<\/a>that was filed by\u00a0the Farm Bureau Federation and the National Pork Producers Council\u00a0to seek to prevent the EPA from disclosing producer&#8217;s confidential information to animal rights groups.\u00a0 This issue has now also moved into Congress as two senators are proposing legislation to prevent the EPA from disclosing personal information.\u00a0 The Farmer Identity Protection Act [read full text <a href=\"http:\/\/www.grassley.senate.gov\/issues\/upload\/Ag-07-23-13-EPA-bill-Farmer-Identity-Protection-Act.pdf\">here<\/a>] would prohibit the EPA from providing the following information:\u00a0\u00a0Names, telephone numbers, email addresses, physical addresses, GPS coordinates, or other information identifying the location of the owner, operator, livestock or\u00a0employee.\u00a0 The bill\u00a0points to the fact that most livestock operations across the United States are operated by families living at the same location as the livestock and that disclosing information about the livestock location is akin to disclosing personal address information for the producers.\u00a0 The bill also cites concerns of domestic terrorism if personal information is disclosed.\u00a0 The bill would recognize exceptions to the prohibition on disclosure if the producer consented to the disclosure, if it was used in forming aggregate information that did not specify the specific operation, or for use by state or federal authorities.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>**This article is not a substitute for the advice of an attorney.** Here are a few ag law stories that were in the news this week.\u00a0 I hope everyone enjoys the last weekend in July&#8211;the summer is flying by!
