{"id":2666,"date":"2015-02-25T02:23:41","date_gmt":"2015-02-25T08:23:41","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=2666"},"modified":"2026-04-17T15:30:38","modified_gmt":"2026-04-17T20:30:38","slug":"faa-publishes-proposed-drone-regulations","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2015\/02\/25\/faa-publishes-proposed-drone-regulations\/","title":{"rendered":"FAA Publishes Proposed Drone Regulations"},"content":{"rendered":"<p>Much anticipated proposed federal drone regulations were published by the Federal Aviation Administration last week.<\/p>\n<p><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2014\/08\/sunflowers.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\" size-medium wp-image-1927 aligncenter\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2014\/08\/sunflowers-300x225.jpg\" alt=\"sunflowers\" width=\"300\" height=\"225\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2014\/08\/sunflowers-300x225.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2014\/08\/sunflowers.jpg 960w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p style=\"text-align: center;\"><em><strong>Current Status of Federal Drone Rules in the United States<\/strong><\/em><\/p>\n<p>Currently, the ability to use a drone legally in the US depends on the type of use to which the drone is being put.<\/p>\n<p>The use of drones for <em>commercial<\/em> purposes is banned in the United States. \u00a0Absent express permission from the FAA, drones may not be flown for commercial purposes under current rules. \u00a0The first time this permission was granted to an agricultural operation was earlier this year, when the FAA issued permission for a company to use a drone for\u00a0&#8220;crop scouting.&#8221;\u00a0 [Read article <a href=\"http:\/\/time.com\/3657000\/faa-drone-agriculture-real-estate\/\">here<\/a>.]<\/p>\n<p>Using a drone for <em>recreation<\/em> or <em>hobby<\/em>, however, is allowed provided that FAA rules are followed. \u00a0[Read article <a href=\"https:\/\/www.linkedin.com\/pulse\/20140915140803-5866889-are-agricultural-drones-legal-to-fly-as-hobby-aircraft\">here<\/a>.]<\/p>\n<p>Where agricultural use fits in this scheme is somewhat of a grey area. \u00a0There are certainly arguments to be made the the use of a drone in an agricultural operation is for a commercial purpose. \u00a0In light of this, until the FAA finalizes rules regarding the commercial use of drones, farmers should use drones with extreme caution due to the chance such use may be considered commercial.<\/p>\n<p>To review current federal drone rules (which will remain in place until a final FAA regulation is passed), <a href=\"http:\/\/knowbeforeyoufly.org\/\">click here<\/a>.<\/p>\n<p style=\"text-align: center;\"><em><strong>State Drone Rules<\/strong><\/em><\/p>\n<p>Additionally, thirteen states (including <a href=\"http:\/\/www.legis.state.tx.us\/tlodocs\/83R\/billtext\/pdf\/HB00912F.pdf#navpanes=0\">Texas<\/a>) have passed their own drone laws. \u00a0[Read articles\u00a0<a href=\"http:\/\/www.janzenaglaw.com\/2014\/09\/while-faa-regulations-stay-grounded.html\">here<\/a>\u00a0and <a href=\"http:\/\/www.texasmonthly.com\/daily-post\/texass-drone-law-pretty-much-opposite-every-other-states-drone-law\">here<\/a>.] \u00a0It is, therefore, important that drone users understand the laws in their individual state to avoid potential issues.<\/p>\n<p style=\"text-align: center;\"><em><strong>The Proposed FAA Regulations<\/strong><\/em><\/p>\n<p>The complete proposed FAA rule may be reviewed <a href=\"http:\/\/www.gpo.gov\/fdsys\/pkg\/FR-2015-02-23\/pdf\/2015-03544.pdf\">here<\/a>. \u00a0The following are some provisions that could impact drones used for agriculture.<\/p>\n<p>* Operators must be certified, which requires meeting certain requirements (i.e. at least 17 years old, no drug convictions, no physical or mental condition impairing ability to fly the drone), passing an aeronautical test at an approved testing location, and passing a follow-up test every two years.<\/p>\n<p>* Drones must be registered with the FAA.<\/p>\n<p>* Operators must have visual contact with the drone using human vision not assisted by any device other than glasses or contacts. \u00a0The operator may enlist additional &#8220;visual observers&#8221; to assist with this requirement.<\/p>\n<p>* Operators\u00a0and visual observers may only \u00a0operate one drone at a time.<\/p>\n<p>* Drones may not weigh more than 55 pounds.<\/p>\n<p>* Regulations impose a flight ceiling of 500&#8242;.<\/p>\n<p>* Drones must adhere to a speed limit of 100 mph.<\/p>\n<p>* 3 miles minimum visibility from control station is required.<\/p>\n<p>* Drones may be flown no closer than 500&#8242; below and 2,000&#8242; horizontal from any clouds.<\/p>\n<p>* Drones may not be flown over any persons not involved with the operator and not in a covered structure that would protect them from a falling drone.<\/p>\n<p>* Not surprisingly, drones may not be flown within\u00a0certain airspace designated for airports.<\/p>\n<p>* Night use is prohibited.<\/p>\n<p style=\"text-align: center;\"><em><strong>The Potential Use of Drones in Agriculture<\/strong><\/em><\/p>\n<p style=\"text-align: left;\">Many have heralded drones as offering major utility for the agricultural industry. \u00a0In fact, agricultural use was the reason drones were initially developed and still has the potential to be the biggest market. \u00a0[Read article <a href=\"http:\/\/www.jdsupra.com\/legalnews\/drone-on-drones-farm-lands-are-fertile-57297\/?utm_source=jds&amp;utm_medium=twitter&amp;utm_campaign=aglaw\">here<\/a>.]\u00a0\u00a0The ability to use drones in precision farming, crop health analysis, monitoring livestock, and other agricultural uses has been deemed a &#8220;game changer&#8221; by one precision agriculture expert. \u00a0[Read article <a href=\"http:\/\/www.latimes.com\/business\/la-fi-drones-agriculture-20140913-story.html#page=1\">here<\/a>.] \u00a0Additionally, American producers point out that farmers and ranchers in numerous other counties are using drones, putting US farmers at a technological disadvantage due to lack of regulations permitting drone usage. \u00a0[Read article <a href=\"http:\/\/www.cnbc.com\/id\/102071305#\">here<\/a>.]<\/p>\n<p style=\"text-align: left;\">On the other hand, many farmers and ranchers are concerned over their privacy rights when it comes to droves flying over their property and operations. \u00a0The proposed FAA rules do not address issues related to privacy or trespass claims, which will, instead, be left up to state law. \u00a0Agricultural producers may have cause for concern here.
