{"id":2623,"date":"2015-02-13T14:09:43","date_gmt":"2015-02-13T20:09:43","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=2623"},"modified":"2026-04-17T15:30:52","modified_gmt":"2026-04-17T20:30:52","slug":"february-13-2015-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2015\/02\/13\/february-13-2015-weekly-round-up\/","title":{"rendered":"February 13, 2015 Weekly Round Up"},"content":{"rendered":"<p>We&#8217;ve made it to the end of another week! \u00a0Here are some ag law stories making news.<\/p>\n<p><strong>* Texas Supreme Court Could Hear Groundwater Case.<\/strong> \u00a0You may recall <a href=\"http:\/\/agrilife.org\/texasaglaw\/2014\/06\/18\/texas-appellate-court-rules-no-accomodation-doctrine-for-groundwater\/\">from this prior blog<\/a> the\u00a0<em>Coyote Lake Ranch v. City of Lubbock<\/em> lawsuit. \u00a0The Ranch owns the surface, but all groundwater rights were severed and sold to Lubbock by prior owners in the 1960&#8217;s. \u00a0As part of the contract for the water rights, Lubbock obtained the right to enter the land and drill water wells. \u00a0The Ranch is concerned that by doing this, the surface of the ranch will be damaged and they will not be compensated. \u00a0In order to prevent this, the Ranch claims that the accommodation doctrine&#8211;used to this point only in oil and gas law&#8211;should apply to groundwater. \u00a0The accommodation doctrine requires, if certain stringent requirements are met, the party seeking to produce oil and gas to accommodate existing surface uses. \u00a0Read a <a href=\"http:\/\/agrilife.org\/texasaglaw\/2013\/07\/08\/a-cattle-rancher-v-an-oil-company-the-accomodation-doctrine\/\">detailed explanation here<\/a>. \u00a0The trial court sided with the ranch and agreed the doctrine should apply, but the Amarillo Court of Appeals reversed, finding that the doctrine should apply only when the mineral estate is involved. \u00a0The Ranch appealed to the Texas Supreme Court, which requested briefing on the merits at the end of January. \u00a0I was recently interviewed on this case by a local television station. \u00a0[Watch interview <a on Agriculture and Livestock Interim Report.<\/strong> \u00a0Last month, the Texas House Committee on Agriculture and Livestock issued their interim report on issues of potential legislation related to agriculture. \u00a0The report looks at a number of interesting issues, including border wait times for agricultural imports, feral hogs, the Right to Farm Act, and the Texas State Soil and Water Conservation Board projects. \u00a0[Read report <a \/><\/a><\/p>\n<p><strong>* Tensions Running High in Hays County Regarding Proposed Pipeline Project. \u00a0<\/strong>As you <a href=\"http:\/\/agrilife.org\/texasaglaw\/2015\/01\/29\/january-30-2015-weekly-round-up\/\">read about previously<\/a>, a proposed water pipeline that would pump water from Hays County to Buda, an Austin suburb, has tensions running high. \u00a0Importantly, there is no Groundwater Conservation District jurisdiction in Hays County, meaning that there are essentially no rules on groundwater pumping in the area. \u00a0Residents are concerned that the proposed project will dry up their wells. \u00a0Hundreds of people attended a county meeting on this topic last week, where many exchanged harsh words. \u00a0[Read article <a href=\"http:\/\/www.texastribune.org\/2015\/02\/11\/hays-water-fight-highlights-issues\/\">here<\/a>.]<\/p>\n<p><strong>* \u00a0Environmental Groups Sue EPA Over Livestock Air Quality Standards.<\/strong> \u00a0Several environmental and animal rights groups have filed suit against the EPA, alleging that the agency is failing to adequately address air quality issues related to large livestock operations. \u00a0The plaintiffs filed petitions in 2009 and 2011 seeking to have large livestock operations categorized as sources of pollution under the Clean Air Act. \u00a0The groups claim that manure generate air pollutants causing illness. \u00a0[Read article <a Designations Are Correct.<\/strong> \u00a0Oftentimes, people forget to review their beneficiary designations, which will control how certain assets are allocated at death. \u00a0In addition to ensuring that you update the persons designated, it is also important to confirm the designation is completed and signed, ensure the percentages\u00a0add up to 100%, and understand that a will will
