{"id":2503,"date":"2015-01-09T13:36:17","date_gmt":"2015-01-09T19:36:17","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=2503"},"modified":"2026-04-17T15:30:53","modified_gmt":"2026-04-17T20:30:53","slug":"january-9-2015-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2015\/01\/09\/january-9-2015-weekly-round-up\/","title":{"rendered":"January 9, 2015 Weekly Round Up"},"content":{"rendered":"<p>Welcome to our first weekly round up of the new year! \u00a0There are lots of ag law stories making news this week.<\/p>\n<p><strong>\u00a0*New York Bans Fracking.<\/strong>\u00a0 New York Governor Andrew Cuomo has announced that he will ban fracking in the state this year. \u00a0A moritorium on the practice has been in place since 2008 and several local fracking bans are already in place. \u00a0With this ban, New York will join Vermont as the only states banning fracking, but will be the first ban in a state with significant oil and gas resources. \u00a0In December, the Department of Health conduced an investigation and recommended that fracking not be allowed until information was available to evaluate potential public health risks. \u00a0As has been seen with other fracking bans, including that passed by Denton, TX in November, litigation is likely to come from mineral owners (many of whom are southern New York farmers who previously signed oil and gas leases) and the oil an gas industry. \u00a0[Read article\u00a0<a href=\"http:\/\/www.velaw.com\/resources\/NewYorktoBanFrackingin2015.aspx\">here<\/a>.]<\/p>\n<p><strong>*Federal Court Finds Foie Gras Ban Pre-Empted By Federal Law.<\/strong>\u00a0 A Federal District Court in California has found that a ban on foie gras, a dish made by force feeding birds with a tube, is pre-empted by federal law. \u00a0The ban, supported by animal rights groups,\u00a0went into effect in 2012. \u00a0The judge found that the ban was preempted by the federal Poultry Product Inspection Act, which prohibits states from passing labeling, packaging, or ingredient requirements different than those in the Act. \u00a0The Court agreed with the challengers, finding that the ban was on an &#8220;ingredient&#8221; and was not permitted. \u00a0This case could also be important to a pending legal challenge of another California law, one banning the sale of eggs from chickens grown in battery cages in the state borders. \u00a0[Read opinion <a href=\"http:\/\/online.wsj.com\/public\/resources\/documents\/2015_0107_foiegras.pdf\">here<\/a>.]<\/p>\n<p><strong>* China Lifts Ban on Syngenta Corn Variety. \u00a0<\/strong>Chinese officials have announced approval for importing MIR 162, a genetically modified corn trait marketed\u00a0by Syngenta. \u00a0Syngenta has been seeking approval from the Chinese since 2010 and began selling the corn seed in the US prior to gaining this approval. \u00a0You may recall from <a href=\"http:\/\/agrilife.org\/texasaglaw\/2014\/11\/07\/weekly-round-up-catch-up-october-24-november-7\/\">this post<\/a>, China rejected shipments of US corn due to the presence of MIR 162, leading to numerous lawsuits against Syngenta. [Read article <a href=\"http:\/\/farmfutures.com\/story-vilsack-china-lift-ban-syngentas-gmo-corn-trait-mir-162-0-121682\">here<\/a>.]<\/p>\n<p><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2014\/08\/corn.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-1832 aligncenter\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2014\/08\/corn-223x300.jpg\" alt=\"corn\" width=\"223\" height=\"300\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2014\/08\/corn-223x300.jpg 223w, https:\/\/agrilife.org\/texasaglaw\/files\/2014\/08\/corn.jpg 358w\" sizes=\"auto, (max-width: 223px) 100vw, 223px\" \/><\/a><\/p>\n<p><strong>* Can Colorado Marijuana Farmers Obtain a Water Right?<\/strong>\u00a0 Colorado water authorities are facing an interesting dilemma&#8211;can water rights be granted to marijuana farmers?
