Devon Energy Corporation and Burlington Resources have settled claims that they underpaid royalties in the San Juan Basin by improperly deducting costs of treating and transporting coalbed methane gas. In Davis v. Devon Energy Corp., New Mexico First Judicial District Court No. D-0101-CV-2003-01590, Devon settled the case for $27.75 million. In Ideal v. Burlington Resources Oil &amp; Gas Company LP, New Mexico First Judicial District Court No. D-0101-CV-2003-02309, the defendants paid $85 million.<\/p>\n<p><a href=\"https:\/\/agrilife.org\/texasaglaw\/files\/2013\/08\/2013083095105050.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-495 aligncenter\" src=\"https:\/\/agrilife.org\/texasaglaw\/files\/2013\/08\/2013083095105050-225x300.jpg\" alt=\"2013083095105050\" width=\"225\" height=\"300\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2013\/08\/2013083095105050-225x300.jpg 225w, https:\/\/agrilife.org\/texasaglaw\/files\/2013\/08\/2013083095105050-768x1024.jpg 768w, https:\/\/agrilife.org\/texasaglaw\/files\/2013\/08\/2013083095105050.jpg 1200w\" sizes=\"auto, (max-width: 225px) 100vw, 225px\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p>In these class action cases, filed in 2003, the royalty owners plaintiffs claimed that the defendants improperly deducted certain transportation and treatment costs of to place coalbed methane gas in pipeline quality condition. Coalbed methane gas in the San Juan Basin of New Mexico must be gathered and treated to remove impurities including water and CO2 before meeting the specifications set by interstate pipeline companies. For years, defendants have been deducting such costs from the royalties paid to royalty and overriding royalty owners in the San Juan Basin.<\/p>\n<p>The royalty owners argued that the defendants should bear such costs under the implied duty to market. The defendants argued that the gas was marketable at the wellhead and, therefore, the costs were properly shared, as post-production costs, between the royalty owners and the defendants.<\/p>\n<p>In both cases, New Mexico trial courts granted key summary judgment motions in favor of the plaintiffs, finding that New Mexico does recognize the implied duty to market, and that duty required the defendants to place the gas into marketable condition at their own expense. States are split on whether to apply this implied duty. Texas, for example, allows these costs to be passed on to the royalty owner, while Colorado does not.<\/p>\n<p>Two similar cases remain pending in New Mexico state courts against BP America and ConocoPhilips.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Two class action lawsuits have been settled in favor of New Mexico royalty and overriding royalty owners.
