{"id":2349,"date":"2014-12-09T01:29:01","date_gmt":"2014-12-09T07:29:01","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=2349"},"modified":"2026-04-17T15:31:07","modified_gmt":"2026-04-17T20:31:07","slug":"december-9-2014-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2014\/12\/09\/december-9-2014-weekly-round-up\/","title":{"rendered":"December 9, 2014 Weekly Round Up"},"content":{"rendered":"<p>Because I did not get the Weekly Round Up post up last Friday, I figured better late than never, so here is the first-ever Tuesday weekly round up of ag law stories in the news.<\/p>\n<p><strong>* LCRA Seeks Approval to Cut Off Downstream Irrigation Releases for Fourth Year in a Row.<\/strong>\u00a0 In a story that is unfortunately becoming all to common, the Lower Colorado River Authority voted 11-2 to seek permission from the TCEQ to curtail downstream releases from the Highland Lakes.\u00a0 The curtailment would not just impact rice farmers, but would also be detrimental to downstream businesses, tourism, and animal species.\u00a0 In addition to this request, the LCRA will continue limits on outdoor watering by customers by one day per week.\u00a0 [Read article <a href=\"http:\/\/southwestfarmpress.com\/water-shortage\/lcra-seeks-approval-cut-irrigation-water-fourth-straight-year?NL=SWFP-01&amp;Issue=SWFP-01_20141124_SWFP-01_22&amp;sfvc4enews=42&amp;cl=article_3&amp;YM_RID=CPG02000000698080&amp;YM_MID=1421\">here<\/a>.]<\/p>\n<p><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2014\/12\/rice-field.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-2381 aligncenter\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2014\/12\/rice-field-300x181.jpg\" alt=\"rice field\" width=\"300\" height=\"181\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2014\/12\/rice-field-300x181.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2014\/12\/rice-field.jpg 1024w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p><strong>*Texas Railroad Commission Passes Pipeline Permitting Process Rules.\u00a0 <\/strong>As you may recall <a href=\"http:\/\/agrilife.org\/texasaglaw\/2014\/07\/28\/texas-rrc-proposed-rule-would-change-application-process-for-pipelines-claiming-eminent-domain-power\/\">from prior blog posts<\/a>, earlier this year the Texas Railroad Commission proposed a rule modifying the pipeline application process in the state.\u00a0 After reviewing the extensive public comment on the proposed rule modifying the application process for pipeline applications, the Teas Railroad Commission has issued the final rules.\u00a0 The rules&#8211;largely similar to those previously proposed&#8211;will require pipeline permit applicants to fine an application to the RRC containing the following documentation:\u00a0 (1) contact information for a person who can answer inquiries about construction, operation or maintenance; (2) classification of the pipeline as a common carrier, gas utility, or a private line; (3) a sworn statement attesting to the operator&#8217;s factual basis to support its classification, including, if applicable, an attestation to the knowledge of eminent domain law at the Texas Landowner Bill of Rights; and (4) documentation or the classification being sought.\u00a0 Additionally, like the previously proposed rule, such permits will be renewable annually.\u00a0 The rule will\u00a0become effective March 1.\u00a0 To review the RRC&#8217;s analysis and discussion of comments received about the proposed rule and to see the final rule, <a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2014\/12\/click-here..pdf\">click here.<\/a>\u00a0 [Read articles <a href=\"http:\/\/www.star-telegram.com\/2014\/12\/03\/6338127\/texas-railroad-commission-approves.html?rh=1\">here<\/a>.]<\/p>\n<p><strong>* Update on Denton Fracking Ban Litigation.<\/strong>\u00a0 The City of Denton has filed an answer to the Complaint filed by the Texas Oil and Gas Association&#8217;s lawsuit claiming the ban violates state law.\u00a0 Specifically, TXOGA argues that the ban is pre-empted by state law regulating oil and gas production and also violates private property rights of mineral owners in Denton.\u00a0 Denton argues that TXOGA has pointed to no specific state regulations addressing this issue or making the ban unconstitutional.\u00a0 Further, Denton argues that although the state may regulate oil and gas production, Denton has the right to protect the health, safety and welfare of its citizens through this type of legislation.\u00a0 [Read article <a href=\"http:\/\/www.texastribune.org\/2014\/12\/01\/defending-ban-denton-calls-fracking-nuisance\/\">here<\/a>.]\u00a0 Additionally, proponents of the ban are seeking to intervene in the lawsuits.\u00a0 The Denton Drilling Awareness Group and Earthworks seek to intervene to assert the rights of Denton Citizens.\u00a0 [Read article <a href=\"http:\/\/www.care2.com\/causes\/texas-town-sues-to-uphold-fracking-ban-protect-democracy.html\">here<\/a>.]<\/p>\n<p><strong>* Elephant Butte Irrigation District Seeks to Intervene in Texas v.
