Worth.\u00a0 I have so enjoyed the opportunity to teach this class and was fortunate to have an absolutely outstanding group of students.\u00a0 To those students visiting the blog, welcome and thanks for a great semester!<\/p>\n<p>Here are some of the ag law stories in the news this week.<\/p>\n<p><strong>* Railroad Commission Finalizes New\u00a0Disposal Well Safety Rule.<\/strong>\u00a0 The Texas Railroad Commission has promulgated a new rule in order to reduce seismic activity related to oil and gas disposal wells.\u00a0 Under the new rule, companies seeking permits for disposal wells are required to provide USGS data regarding seismic activity in a 100 mile area around the proposed well location and\u00a0must provide monthly reports of injection rates and pressure.\u00a0 The RRC may modify, suspend, or terminate a permit if scientific data indicates a disposal well is contributing seismic activity.\u00a0 [Read article <a href=\"http:\/\/www.velaw.com\/resources\/TexasRailroadCommissionFinalizesNewRuleAddressingSeismicEventsforDisposalWells.aspx\">here<\/a> and rule <a href=\"http:\/\/www.sos.state.tx.us\/texreg\/pdf\/backview\/1114\/1114adop.pdf\">here<\/a>.]<\/p>\n<p><strong>*Second New Mexico County Imposes Strict Drilling Rules.<\/strong>\u00a0 San Miguel County voted last week to pass some of the strictest rules for oil and gas production in the country.\u00a0 The new ordinance ends a moratorium on oil and gas production in the county that has been in place since 2010.\u00a0 The new rules, however, essentially restrict drilling to a portion of the rural eastern side of the county.\u00a0 Additionally, production companies will face high application fees, obtain pre0-drilling assessments, and post bonds.\u00a0 This rule, although less stringent than Mora County&#8217;s outright ban on oil and gas production, may still face legal challenge from mineral owners and the oil and gas industry.\u00a0[Read article <a href=\"http:\/\/fuelfix.com\/blog\/2014\/11\/12\/new-mexico-county-passes-strict-drilling-rules-as-state-judge-considers-wider-ban\/\">here<\/a>.]<\/p>\n<p><strong>* Monsanto Settles Case Over GM Wheat with Farmers.\u00a0 <\/strong>In 2013, unapproved GMO wheat was discovered growing in an Oregon field.\u00a0 Although no GMO wheat has been approved in the US,\u00a0the discovered wheat matched a strain of experimental wheat tested by Monsanto a decade earlier.\u00a0\u00a0 Last week, Monsanto reached a $2.3 million settlement with wheat growers associations and farmers in lawsuits related to this event.\u00a0 The discovery of the GMO wheat resulted in\u00a0some\u00a0export bans for soft white wheat from the US in 2013.\u00a0 The USDA investigation into this situation was completed in September, finding it to be an isolated incident and there to be no GMO wheat in commerce.\u00a0 [Read article <a href=\"http:\/\/farmfutures.com\/story-monsanto-settles-farmers-2013-gmo-wheat-discovery-8-120230\">here<\/a>.]<\/p>\n<p><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2014\/11\/wheat-field.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-2335 aligncenter\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2014\/11\/wheat-field-300x225.jpg\" alt=\"wheat field\" width=\"300\" height=\"225\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2014\/11\/wheat-field-300x225.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2014\/11\/wheat-field-1024x768.jpg 1024w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p><strong>* Gunnison Sage Grouse Listed as Threatened.<\/strong>\u00a0 The Fish and Wildlife Service has listed the Gunnison sage grouse as threatened under the Endangered Species Act.\u00a0 The bird, found in southwestern Colorado and southeastern Utah, was proposed to be listed as &#8220;endangered&#8221; last year.\u00a0 Conservation efforts by interested parties convinced the Fish and Wildlife Service that a listing of endangered was not necessary, but they still found that a threatened listing was proper.\u00a0 Groups on both sides of this issue are unhappy and have threatened lawsuits over the listing.\u00a0 The State of Colorado has stated it intends to sue the FWS, arguing that the bird should not have been listed at all based upon the conservation efforts and scientific evidence.\u00a0 On the other hand, environmental groups have threatened to sue because the FWS refused to list the bird as endangered.\u00a0 [Read article <a href=\"http:\/\/uk.reuters.com\/article\/2014\/11\/12\/us-usa-environment-grouse-idUKKCN0IW2IW20141112\">here<\/a>.]<\/p>\n<p><strong>* Hawaii Judge Issues Injunction Against GMO Ban.<\/strong>\u00a0 A federal judge has issued a\u00a0temporary injunction in a lawsuit filed by Monsanto challenging the constitutionality of Maui&#8217;s GMO ban.\u00a0 The injunction prevents the new GMO law passed earlier this month&#8211;which prohibits the growing of any GMO crops in Maui County&#8211;from taking effect.\u00a0 The temporary injunction will remain in place until December 5.\u00a0 [Read article <a href=\"http:\/\/mauinow.com\/2014\/11\/15\/temporary-injunction-granted-in-monsanto-lawsuit-challenging-gmo-initiative\/\">here<\/a>.]<\/p>\n<p><strong>* United States Supreme Court Agrees To Hear Water Dispute Between Florida and Georgia, Appoints Special Master.<\/strong>\u00a0 The US Supreme Court has again agreed to weigh in in a water dispute between states.\u00a0 Like <em>Texas v. New Mexico,<\/em> the court has agreed to hear <em>Florida v. Georgia<\/em> and has appointed a special\u00a0master. <a href=\"http:\/\/sblog.s3.amazonaws.com\/wp-content\/uploads\/2014\/03\/FLORIDA-v.-GEORGIA-Original-Action-Complaint.pdf\">In its Complaint<\/a>, Florida claims that Georgia is withdrawing too much upstream water upstream of the Apalachicola Bay,\u00a0damaging the state&#8217;s vital oyster industry.\u00a0 Specifically, Florida claims that Georgia diverts too much water from the Chattahoochee River, used in order to provide\u00a0water for\u00a0Atlanta.\u00a0 The case has been referred to\u00a0Special Master, Ralph I.
