{"id":2135,"date":"2014-10-09T17:44:50","date_gmt":"2014-10-09T22:44:50","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=2135"},"modified":"2026-04-17T15:31:43","modified_gmt":"2026-04-17T20:31:43","slug":"october-10-2014-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2014\/10\/09\/october-10-2014-weekly-round-up\/","title":{"rendered":"October 10, 2014 Weekly Round Up"},"content":{"rendered":"<p>October is an exciting month for me and will be culminating in a couple of major changes.\u00a0 I will be getting married at the end of the month!<\/p>\n<p><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2014\/10\/holding_hands_1_5x7.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-2172 aligncenter\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2014\/10\/holding_hands_1_5x7-214x300.jpg\" alt=\"holding_hands_1_5x7\" width=\"214\" height=\"300\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2014\/10\/holding_hands_1_5x7-214x300.jpg 214w, https:\/\/agrilife.org\/texasaglaw\/files\/2014\/10\/holding_hands_1_5x7-731x1024.jpg 731w, https:\/\/agrilife.org\/texasaglaw\/files\/2014\/10\/holding_hands_1_5x7.jpg 1463w\" sizes=\"auto, (max-width: 214px) 100vw, 214px\" \/><\/a><\/p>\n<p>As a result of the upcoming nuptials, I will\u00a0be transferring office locations.\u00a0 I will still be working in my same role with Texas A&amp;M Agrilife Extension as the state-wide Extension Agricultural Law Specialist, but I will be moving my base office\u00a0to our Amarillo District Center.\u00a0 It is a wonderful opportunity for my husband and I to live in the same zip code and for me to continue my work with agricultural producers across the State of Texas.\u00a0 The only changes for you all will be my contact information, which you can find on the &#8220;Contact&#8221; tab or by <a href=\"https:\/\/agrilife.org\/texasaglaw\/contact\/\">clicking here<\/a>.<\/p>\n<p>With that bit of housekeeping out of the way, on to the major ag law stories in the news this week!<\/p>\n<p><strong>* Petition Seeks Endangered Species Status for Lizard Found in Eagle Ford Shale Area.<\/strong>\u00a0The San Antonio Express News highlighted an issue that has been a bit off\u00a0the radar in South\u00a0Texas.\u00a0 Several years ago, an environmental group filed a petition with\u00a0the\u00a0United States Fish and Wildlife Service seeking to list the spot-tailed earless lizard as endangered or threatened under the Endangered Species Act.\u00a0 \u00a0In 2011, the USFWS found there was substantial information that listing the species may be warranted, but to date no decision has been made.\u00a0 This proposal is particularly concerning for oil and gas companies, as the lizard&#8217;s\u00a0 habitats includes portions of the Eagle Ford Shale, one of the most productive oil and gas areas in the country, producing nearly 1 million barrels per day of crude oil.\u00a0 Attorneys believe that, if listed, this could have significant impacts on the Texas oil and gas industry.\u00a0 [Read article <a href=\"http:\/\/www.expressnews.com\/business\/eagle-ford-energy\/article\/Lizard-could-collide-with-oil-and-gas-5801332.php#\/0\">here<\/a>.]<\/p>\n<p><strong>*Texas Supreme Court to Consider <em>Bragg v. Edwards Aquifer Authority.<\/em><\/strong>\u00a0 Texas&#8217; highest court has requested briefing on the merits in the controversial groundwater case, <em>Bragg v. Edwards Aquifer Authority.<\/em>\u00a0 As you recall from <a href=\"https:\/\/agrilife.org\/texasaglaw\/2013\/08\/29\/decisions-decisions\/\">this prior blog<\/a>, both the trial court and San Antonio Court of Appeals found that the Edwards Aquifer Authority&#8217;s denial of permits for Mr. Bragg to irrigate his pecan orchards constituted a taking of private property for which he is owed compensation.\u00a0 Also\u00a0in dispute is the amount of compensation owed if Mr. Bragg&#8217;s takings claim is upheld.\u00a0 The briefing in the case is scheduled to be completed by December.\u00a0 [Review docket <a href=\"http:\/\/www.search.txcourts.gov\/Case.aspx?cn=13-1023\">here<\/a>.]<\/p>\n<p><strong>* Why Denton Should and Should Not Ban Fracking.<\/strong>\u00a0 The Texas Tribune often does an interesting series called &#8220;Trib Talk&#8221; where two writers take opposite sides of a controversial issue.\u00a0 This week, the topic was the proposed fracking ban in the City of Denton, which will come before voters next month.\u00a0 Adam Briggle, Vice President of the Denton Drilling Awareness Group,\u00a0wrote on why he believes fracking should be banned, focusing primarily on potential accidents, air quality, and the fact that the proposed ban does not prohibit all drilling, only that using fracking.\u00a0\u00a0[Read article <a href=\"http:\/\/www.tribtalk.org\/2014\/10\/03\/why-denton-should-ban-fracking\/\">here<\/a>].\u00a0 Taking the other side of the argument was Ed Ireland, Executive Director of the Barnett Shale Energy Education Council.\u00a0 He argues against the fracking ban by focusing on private property rights, economic damage, and expensive legal challenges to the law almost certain to face Denton taxpayers.\u00a0 [Read article\u00a0<a href=\"http:\/\/www.tribtalk.org\/2014\/10\/03\/why-denton-shouldnt-ban-fracking\/\">here<\/a>.]\u00a0 The New York Times also published an article discussing this issue and outlining arguments from both sides.\u00a0 [Read article <a href=\"http:\/\/www.nytimes.com\/2014\/10\/09\/business\/in-texas-a-fight-over-fracking.html?partner=msft_msn&amp;_r=0\">here<\/a>.]\u00a0 I found all of these articles to be a very interesting insight to the arguments on both sides of this hot button issue.<\/p>\n<p><strong>* Update on Proposed San Antonio Water Pipeline Project.<\/strong>\u00a0 As a follow up to the blog I posted earlier this week discussing the proposed water pipeline from Burleson County to San Antonio, the Texas Tribune published a Q&amp;A Session with San Antonio City Councilman, Ron Nierenberg.\u00a0 Not surprisingly, the pipeline was the central topic of conversation.\u00a0 [Read article <a href=\"http:\/\/www.texastribune.org\/plus\/water\/vol-2\/no-20\/q-ron-nirenberg\/\">here<\/a>.]\u00a0 Additionally, on Wednesday, numerous residents voiced their opinions&#8211;both for and against&#8211;this project at a City Council Meeting.\u00a0 [Read article <a href=\"http:\/\/www.texastribune.org\/2014\/10\/08\/residents-ask-more-time-controversial-pipeline\/\">here<\/a>.]<\/p>\n<p><strong>* American Bar Association Highlights Need for Rural Lawyers.<\/strong>\u00a0 The American Bar Association Journal published an article last week discussing the need for rural attorneys.\u00a0 Interestingly, although 20% of Americans live in rural areas, only 2% of lawyers practice in rural America.\u00a0 The article\u00a0featured a discussion of a small town in rural North Dakota, whose only attorney retired last year.\u00a0 Last year, the city was able to attract two young lawyers after offering to pay for office space and other business expenses.\u00a0 Several law schools and bar organizations in the Midwest have been formed to encourage lawyers to return to rural areas.\u00a0 One example is South Dakota&#8217;s Rural Attorney Recruitment Program that provides monetary incentives for attorneys who move to rural areas and set up shop.\u00a0 I found it telling that these issues are not located in one part of the country&#8211;the article discussed shortages in the Midwest, the south, and in Maine.\u00a0 [Read article <a href=\"http:\/\/www.abajournal.com\/magazine\/article\/too_many_lawyers_not_here._in_rural_america_lawyers_are_few_and_far_between\">here<\/a>.]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>October is an exciting month for me and will be culminating in a couple of major changes.\u00a0 I will be getting married at the end of the month!
