{"id":2112,"date":"2014-10-03T17:06:41","date_gmt":"2014-10-03T22:06:41","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=2112"},"modified":"2026-04-17T15:31:44","modified_gmt":"2026-04-17T20:31:44","slug":"october-3-2014-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2014\/10\/03\/october-3-2014-weekly-round-up\/","title":{"rendered":"October 3, 2014 Weekly Round Up"},"content":{"rendered":"<p>I spent a good part of this week at county Farm Bureau meetings visiting with Texas agricultural producers.\u00a0 Last Saturday, I was in Longview, TX for the Gregg County Farm Bureau meeting where I spoke about current Hot Topics in Agricultural Law.\u00a0 Many thanks to Glenn Richardson for the invitation.\u00a0 On Wednesday evening I made the drive to Huntsville for the Walker County Farm Bureau meeting where we discussed water rights in Texas.\u00a0 I appreciate Carl thinking of me and including me on the program.\u00a0 Welcome to those of you visiting the Texas Agriculture Law Blog from one of these great events.<\/p>\n<p>It has been a week full of ag law related news across the country!\u00a0 Here are some of the headlines.<\/p>\n<p><strong>*Federal Judge Strikes Down Environmentalists&#8217; Lawsuit Over Dunes Sagebrush Lizard.<\/strong>\u00a0 A federal district judge has ruled against a group of environmental plaintiffs in their lawsuit seeking that the US Fish and Wildlife Service reconsider its decision not to list the dunes sagebrush lizard under the Endangered Species Act.\u00a0 Prior to the USFWS decision not to list the species in June 2012, landowners, oil and gas companies, agricultural interests, biologists, and state and federal agencies worked together to impose the Texas Conservation Plan to protect the lizard and abrogate the need for its listing under the Act.\u00a0 After considering all evidence, including the impact of t he Conservation\u00a0 Plan, the USFWS determined that it was not necessary to list the lizard.\u00a0 This week, that decision was upheld and the court found that the USFWS based the non-listing on the best available scientific and commercial data as required by the Act.\u00a0 [Read article <a href=\"https:\/\/www.bigcountryhomepage.com\/story\/d\/story\/federal-judge-rules-in-favor-of-texas-comptroller\/22967\/nEdhw4dFkUyrhw5GkUod9A\">here<\/a>.]<\/p>\n<p><strong>* Lesser Prairie Chicken Case to Be Decided in Oklahoma.<\/strong>\u00a0 In more Endangered Species Act litigation news, a federal judge has decided that a lawsuit challenging the listing of the lesser prairie chicken will be decided in Oklahoma federal court, rather than moved to Washington, DC.\u00a0 This is seen as a victory for the plaintiffs in the case&#8211;Kansas, Oklahoma and North Dakota (who may soon be joined by Nebraska and New Mexico&#8211;who filed suit against the United States Fish and Wildlife Service arguing that the chicken did not meet the qualifications for being listing as threatened under the Act.\u00a0 [Read article <a href=\"https:\/\/kansasagnetwork.com\/2014\/endangered-species-act-concerning-lesser-prairie-chicken-to-be-settled-in-oklahoma-not-washington-d-c\/\">here<\/a>.]<\/p>\n<p>* <strong>Judge Dismisses Challenge to California Egg Law.<\/strong>\u00a0 A federal judge in California (these federal judges were focused on ag issues this week!) has dismissed a lawsuit challenging a California law requiring that all eggs sold in the state be laid by hens housed in cages meeting with California Proposition 2.\u00a0 Under California law, hens may not be kept in battery cages in the state and, pursuant to the law at issue in this lawsuit, no eggs may be sold in California if they were laid by hens in such cages, regardless of whether such cages are legal in the state where the eggs were produced.\u00a0 Six states&#8211;Missouri, Nebraska, Oklahoma, Alabama, Kentucky, and Iowa challenged the law, arguing that it would cost their states millions of dollars to comply with these requirements, which violate the negative commerce clause.\u00a0 The judge did not address the merits of the case, but instead found that the states did not have standing to challenge the law, as it did not impact a large number of the states&#8217; citizens, but instead only a small number of egg producers.\u00a0 [Read article <a href=\"https:\/\/www.sfgate.com\/food\/article\/Judge-tosses-suit-by-6-states-over-California-law-5797844.php\">here<\/a>.]<\/p>\n<p><strong>* US and Brazil End WTO Cotton Battle.\u00a0 <\/strong>The ongoing dispute between the United States and Brazil before the\u00a0 World Trade Organization has come to an end when the two nations reached a settlement.\u00a0 The dispute, which has lasted for over a decade, involved claims by Brazil against he United States who argued that certain federal agricultural support programs were inconsistent with WTO laws.\u00a0 Twice, WTO arbitrators sided with Brazil and in 2009, countermeasures were approved to be taken against the United States, but these countermeasures were avoided by agreement in 2010. As part of the settlement agreement ending the dispute, Brazil will terminate the case and give up its rights to counter-measures against the United States and agreeing not to bring actions against cotton support programs while the current Farm Bill is in place.\u00a0 The United States will make payment of $300 million to the Brazil Cotton Institute.\u00a0 [Read articles <a href=\"https:\/\/southeastfarmpress.com\/government\/longstanding-us-brazil-cotton-dispute-comes-end?NL=SEFP-01&amp;Issue=SEFP-01_20141002_SEFP-01_396&amp;sfvc4enews=42&amp;cl=article_2&amp;YM_RID=CPG02000000698080&amp;YM_MID=640\">here<\/a> and <a href=\"https:\/\/www.oklahomafarmreport.com\/wire\/news\/2014\/10\/07582_USBrazilEndWTOCottonDispute100114_105945.php#.VCxIJ6Mo5aQ\">here<\/a>.]<\/p>\n<p><a href=\"https:\/\/agrilife.org\/texasaglaw\/files\/2014\/01\/cotton-jennifer.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-1103\" src=\"https:\/\/agrilife.org\/texasaglaw\/files\/2014\/01\/cotton-jennifer-200x300.jpg\" alt=\"cotton jennifer\" width=\"275\" height=\"412\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2014\/01\/cotton-jennifer-200x300.jpg 200w, https:\/\/agrilife.org\/texasaglaw\/files\/2014\/01\/cotton-jennifer-683x1024.jpg 683w, https:\/\/agrilife.org\/texasaglaw\/files\/2014\/01\/cotton-jennifer.jpg 1132w\" sizes=\"auto, (max-width: 275px) 100vw, 275px\" \/><\/a><\/p>\n<p><strong>* Idaho Dairyman Combats Tarnished Image.<\/strong>\u00a0 The Idaho dairy industry has taken a hit in the media for several years.\u00a0 An undercover video showing abuse of cows at one dairy in the state, followed by push back after the passage of the state&#8217;s agricultural protection law, more commonly known as an &#8220;ag gag&#8221;
