Mexico"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"color: #993300;\">**This article is not a substitute for the advice of an attorney.**<\/span><\/p>\n<p>Texas has been fighting against its neighbors for water on many fronts.\u00a0 In 2013, Supreme Court litigation has pitted Texas against Oklahoma in one case\u00a0and against New Mexico in another, and\u00a0there is currently an ongoing dispute with Mexico over its compliance (or lack thereof) with a treaty allocating Rio Grande water to the\u00a0United States.\u00a0 In the upcoming weeks, I intend to\u00a0post a series of blogs called Texas Water Wars.\u00a0 This series will\u00a0discuss each of these battles,\u00a0outline basic information about the issues, and to\u00a0provide information on the current status of the disputes.<\/p>\n<p><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/07\/water.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-361 aligncenter\" alt=\"water\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/07\/water-300x175.jpg\" width=\"357\" height=\"214\" \/><\/a><\/p>\n<p>Today, we will kick off this series with a\u00a0look at the battle between the United States and Mexico for water in south Texas.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>The 1944 Treaty<\/strong><\/span><\/p>\n<p>This battle finds its roots in a treaty signed between the two countries in 1944.\u00a0 The<a href=\"http:\/\/ibwc.state.gov\/Files\/1944Treaty.pdf\"> Treaty of the Utilization of Waters of the Colorado and Tijuana Rivers and of the Rio Grande<\/a>, in its most basic terms, allocates water from these three rivers between the two countries.\u00a0 The provision at issue in the dispute is one dealing with the allocation of water from 6 tributaries that flow into the Rio Grande:\u00a0\u00a0The Conchos, San Diego, San Rodrigo, Escondido, and Salado Rivers and the Las Vacas Arroyo.\u00a0 In exchange, Mexico is given water from a portion of the Colorado River.<\/p>\n<p>The treaty provides that the United States is entitled to receive 1\/3 of the water that reaches the Rio Grande from these tributaries, and that &#8220;this third shall not be less, as an average amount in cycles of five consecutive years, than 350,000 acre-feet annually.&#8221;\u00a0 The treaty provides an exception to this requirement as follows:\u00a0 &#8220;In the event of extraordinary drought or serious accident to the hydraulic systems on the measured Mexican tributaries, making it difficult for Mexico to make available the run-off of 350,000 acre feet annually&#8230;any deficiencies existing at the end of the aforesaid five-year cycle shall be made up in the following five-year cycle with water from the said measured tributaries.&#8221;<\/p>\n<p>Enforcement of the treaty is in the hands of the US\u00a0State Department\u00a0and the International Boundary and Water Commission.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>What&#8217;s the Problem?<\/strong><\/span><\/p>\n<p>For the current 5 year cycle (October, 25\u00a02010 to October 24,\u00a02015), Mexico has not provided 350,000 acre feet\/year.\u00a0 As of July 20, 2013, Mexico had only diverted\u00a0487,208 acre feet of water.\u00a0 This means that Mexico is\u00a0469,778 acre feet behind the required average of 350,000 acre feet per year.\u00a0 The United States is concerned that if Mexico continues to fail to provide the water required under the treaty, it will be unable to produce the full amount required for this cycle by October 2015.\u00a0 This appears to be a legitimate concern considering the trend currently seen.\u00a0 In the first year of this cycle, Mexico provided 82 percent of the required 350,000 acre-feet. In the second year, that number fell to only 29 percent, and currently, Mexico has provided a mere 6 percent of the required water this third year.\u00a0 The Texas Commission on Environmental Quality provides a weekly Watermaster&#8217;s Report that tracks the water delivered under the treaty, which is available online by <a href=\"http:\/\/www.tceq.texas.gov\/border\/water-deficit.html\">clicking here<\/a>.<\/p>\n<p>Combine this with the record-setting drought that is currently going on in South Texas, and it spells major problems for the area.\u00a0 Municipalities in the area are concerned about running out of water in the coming months.\u00a0\u00a0Farmers along the Rio Grande have been unable to adequately irrigate crops due to a lack of water.\u00a0 Economists estimate that the lack of water could cost Texas farmers $395 million in economic output and that 5,000 jobs could be lost in the valley.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>Where Things Stand\u00a0 Now<\/strong><\/span><\/p>\n<p>There are currently several moving pieces at\u00a0play with regard to this\u00a0issue.<\/p>\n<p>First, there is a difference of interpretation of the treaty between the two countries.\u00a0 Mexico claims that it is not currently in violation of the treaty because the 5 year cycle has not yet ended.\u00a0 In Mexico&#8217;s view,\u00a0it is not required to \u00a0fulfill its 350,000 acre foot\/year obligation until the end of the 5 year period.\u00a0 Thus, Mexico&#8217;s position is, so long as Mexico provides the sum total of 1.75 million acre feet by October 2015, the treaty has not been violated.\u00a0 The United States takes a very different view, believing that the treaty imposes a yearly requirement of 350,000 acre feet.\u00a0 Because Mexico has not met this requirement for the last 3 years, they are in violation of the treaty.<\/p>\n<p>Second, four Texas Congressmen have introduced legislation in the US House and Senate in an attempt to entice Mexico to provide the water.\u00a0 The bills are titled\u00a0&#8220;Working to Address Treaty Enforcement Rapidly for Texas&#8221;, or the WATER Act, and would require Mexico to submit information to the Secretary of State, who would prepare quarterly reports to describe the efforts taken by Mexico to meet its treaty obligations.\u00a0 The Secretary of State would also prepare an annual report describing the benefits of the treaty to Texas.\u00a0 Under the proposed legislation, if Mexico failed to comply with these reporting requirements, the United States Department of State would withhold assistance provided to Mexico to repair infrastructure that was damaged in the 2010 Baja California earthquake.<\/p>\n<p>Third, as I <a href=\"http:\/\/agrilife.org\/texasaglaw\/2013\/07\/11\/july-12-2013-weekly-round-up\/\">previously mentioned on this blog<\/a>, Mexico stated that it would release some water pursuant to the Treaty.\u00a0 Specifically, Mexico agreed to release 1\/3 of the water from the San Rodrigo\u00a0tributary.\u00a0 The amount, however, was miniscule&#8211;only 7,500 acre feet of the 472,085 foot deficit.<\/p>\n<p>As you can tell, this battle is being fought in several arenas and is far from over.\u00a0 For now, Texas watches, waits, and prays for rain.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>**This article is not a substitute for the advice of an attorney.** Texas has been fighting against its neighbors for water on many fronts.\u00a0 In 2013, Supreme Court litigation has pitted Texas against Oklahoma in one case\u00a0and against New Mexico in another, and\u00a0there is currently an ongoing dispute with Mexico over its compliance (or lack thereof) with a treaty allocating Rio Grande water to the\u00a0United States.\u00a0 In the upcoming weeks, I intend to\u00a0post a series of blogs called Texas Water Wars.\u00a0 This series will\u00a0discuss each of these battles,\u00a0outline&#8230; <span class=\"read-more\"><a href=\"https:\/\/agrilife.org\/texasaglaw\/2013\/08\/04\/texas-water-wars-united-states-v-mexico\/\">Read More &rarr;<\/a><\/span><\/p>\n","protected":false},"author":908,"featured_media":361,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"_monsterinsights_skip_tracking":false,"_monsterinsights_sitenote_active":false,"_monsterinsights_sitenote_note":"","_monsterinsights_sitenote_category":0,"footnotes":""},"categories":[14,11,6],"tags":[],"class_list":["post-211","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-texas-water-wars","category-united-states-congress","category-water-law"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.3 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Texas Water Wars: United States v.
