Tracy King, Sid Miller, and Jim Sartwelle were absolutely fantastic.\u00a0 I appreciate Evan Smith&#8217;s invitation to participate in this event.\u00a0 To view the live blog overview of our session, <a href=\"http:\/\/www.texastribune.org\/2014\/09\/20\/liveblog-environment-texas-tribune-festival\/\">click here<\/a> (our session is about mid-way down the page).\u00a0 On Tuesday evening I headed to Huntsville to speak on grazing leases to a great group of Walker County folks.\u00a0 Thanks so County Extension Agent Reggie Lepley for setting up the program.\u00a0 Lastly, on Thursday morning, I made the drive to Ozona to discuss oil and gas lease negotiations and pipeline easements with a group of landowners.\u00a0 I appreciate all of the work Aaron Renfroe, the County Extension Agent in Crockett County, put into this program.<\/p>\n<p>Here is the final weekly round up in September\u00a0of ag law stories in the news.<\/p>\n<p><strong>* SAWS Considers Pipeline Contract to Pipe Water from Burleson County.<\/strong>\u00a0 After months of negotiations, the San Antonio Water System and Vista Ridge Consortium have agreed upon a proposed contract that would result in a $3.4 billion project to pump water from rural Burleson County, Texas to San Antonio.\u00a0 The proposed contract is expected to be considered by the SAWS Board on Monday, September 29 and, if approved by the Board, would then be considered by the San Antonio City Council in October.\u00a0 Under the proposed contract, Vista Ridge would deliver 50,000 acre feet of water per for 30 years, beginning in 2019.\u00a0 [Read articles <a href=\"http:\/\/www.therivardreport.com\/saws-board-vote-vista-ridge-pipeline-contract\/\">here<\/a> and \u00a0<a href=\"http:\/\/www.expressnews.com\/news\/environment\/article\/Key-decisions-scrutiny-await-water-pipeline-5770158.php\">here<\/a>.]<\/p>\n<p>* <strong>Texas Supreme Court Considers Important Case Regarding Statute of Limitations on Royalty Disputes.<\/strong>\u00a0 Last week, the Texas Supreme Court heard oral arguments in <em>Hooks v. <\/em><em>Samson Lone Star, L.P.<\/em>\u00a0 The issue in the case is when the statute of limitations begins running against a royalty owner&#8217;s claim for underpayment of royalties.\u00a0 The plaintiff in the case claims that the defendant underpaid royalties and hid this from him by making fraudulent misrepresentations on royalty statements.\u00a0 In light of these misrepresentations, the plaintiff argues, the statute of limitations should have been tolled and his claim allowed to proceed.\u00a0 The defendant argues that the four-year statute of limitations for fraud cases applies and that the plaintiff could have discovered the underpayments by reviewing public records of productions.\u00a0 The trial court found in favor of the plaintiff, awarding him $21 million in damages.\u00a0 The First Circuit Court of Appeals in Houston reversed, finding that the claim was barred by the statute of limitations.\u00a0 This case could have important implications for Texas royalty owners and the duty imposed on them to investigate and confirm accurate royalty payments.\u00a0 The Supreme Court has taken the case under advisement.\u00a0 [Read article <a href=\"http:\/\/www.texastribune.org\/2014\/09\/18\/texas-supreme-court-weighs-oilfield-fraud-case\/\">here<\/a>.]<\/p>\n<p><strong>* Texas Department of Agriculture Modifies &#8220;Go Texan&#8221; Program Requirements for Wine.<\/strong>\u00a0 The TDA announced a new &#8220;pilot program&#8221; rule requiring that the&#8221;Go Texan&#8221; label on a wine product be used only if the product is made from at least 75% Texas-grown grapes.\u00a0 Previously, there was no\u00a0requirement that the product be made from Texas-grown grapes. \u00a0Thus, for example, a wine made from California grapes that was bottled in Texas would have qualified under the old rules.\u00a0 The new requirement will be effective for wines bottled after September 18, 2014.\u00a0 The rule will be in effect for the next 12 months and, at the end of that time, the rule will be re-=evaluated to determine if it results in increased Texas grape values, decreased consumer confusion regarding the &#8220;Go Texan&#8221; label, and results in increased consumption of wine produced from Texas grapes.\u00a0 [Read press release <a href=\"http:\/\/origin.library.constantcontact.com\/download\/get\/file\/1102557608404-554\/TDA+Amendments+to+the+GO+TEXAN+Program.pdf\">here<\/a>.]<\/p>\n<p><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2014\/09\/vineyard.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-2110 aligncenter\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2014\/09\/vineyard-300x225.jpg\" alt=\"vineyard\" width=\"300\" height=\"225\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2014\/09\/vineyard-300x225.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2014\/09\/vineyard.jpg 720w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p><strong>* EPA Withdraws Appeal in <em>Alt<\/em> Case.<\/strong>\u00a0 After losing at the appellate court level, the EPA has announced it will dismiss its case and not appeal of the decision in\u00a0<em>Alt v. United States Environmental Protection Agency<\/em> over the scope of the\u00a0Clean Water Act applied to agricultural storm runoff.\u00a0As was discussed <a href=\"http:\/\/agrilife.org\/texasaglaw\/2013\/10\/25\/october-25-2013-weekly-round-up\/\">previously on the Texas Ag Law blog last year<\/a>, the federal\u00a0district court in West Virginia\u00a0found that the farm did not have to obtain a permit from the EPA for storm runoff around her chicken houses.\u00a0 The EPA unsuccessfully argued for a much more narrow definition of &#8220;agricultural storm water,&#8221; which is, by law, exempt from the permitting requirements of the EPA.\u00a0 The case could still move forward if any of the environmental groups who intervened as plaintiffs in the case choose to continue.\u00a0 [Read article <a href=\"http:\/\/southeastfarmpress.com\/government\/epa-pulls-back-west-virginia-farms-stormwater-runoff-case\">here<\/a>].<\/p>\n<p><strong>* What Form of Social Media Best Suits Agricultural Industry?<\/strong>\u00a0 This was a question posed recently on a social media blogging site.\u00a0 The answer?\u00a0 Twitter!\u00a0 I found this surprising, but their rationale is that it is quick and easy to get involved in discussions with others in the industry.\u00a0 The article also discussed how agriculture is a unique industry because of our &#8220;community spirit&#8221; and willingness to help other farmers and ranchers in need.\u00a0 As someone who just recently began using Twitter to communicate ag law related news (follow me @TiffDowell), I thought this article was interesting and informative.\u00a0 [Read article <a href=\"http:\/\/www.socialmedia-trainingcourses.com\/blog\/2014\/07\/which-social-media-network-best-suits-the-agriculture-sector\/#.VCXhAKMo5aS\">here<\/a>.]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>This week was another busy one as I was out and about speaking at programs in Austin, Huntsville, and Ozona.\u00a0 Last Saturday, I was honored to be on a panel discussing the Future of Texas Agriculture at the Texas Tribune Festival in Austin.\u00a0 It was a wonderful event and the other folks on the panel, Blair Fitzsimons, Rep.
