We’re coming to the end of another week.\u00a0 Here are some of the top ag law-related stories making headlines.<\/p>\n

1. \u00a0Last week, the United States House of Representatives passed a Farm Bill, after splitting out the nutrition portion for consideration at a later date.\u00a0 House leaders say that a vote on the nutrition portion of the bill\u00a0may come within the next week or two.\u00a0 In the meantime, it waits to be seen what will happen when the House and Senate versions of the bills go into conference.\u00a0 [For more information, read articles here<\/a> and here<\/a>.]<\/p>\n

2.\u00a0 A decision from the Texas Second District\u00a0Court of Appeals highlights the importance of ensuring that reservations of mineral rights are express when selling property.\u00a0 In Thomason v. Badgett<\/em>, Thomason granted a general warranty deed to land, but failed to expressly reserve his 50% of the mineral rights.\u00a0 Instead, the deed made mention to\u00a0the\u00a0mineral rights that were recorded in two other\u00a0prior deeds.\u00a0 Because the Thomason deed\u00a0did not expressly reserve\u00a0the 50% of\u00a0the mineral rights,\u00a0\u00a0those rights were deeded to the new owner.\u00a0 \u00a0[Read full opinion here<\/a>.]<\/p>\n

Bottom line for landowners:<\/strong><\/span>\u00a0This case\u00a0sets forth important presumptions under Texas law.\u00a0 First,\u00a0courts presume\u00a0that a deed is construed to convey to the grantee the greatest estate possible.\u00a0 Thus, the presumption is that a grantor intends to convey all of his property to the grantee.\u00a0 Second,\u00a0it is presumed that a deed conveys all of the grantor’s interest unless the deed “clearly shows an intention to convey a lesser interest.”\u00a0\u00a0Thus, anytime you sell property, be sure that all rights that you intend to reserve are expressly spelled out in the deed.<\/p>\n

3. \u00a0In the last week, two articles\u00a0have come out\u00a0regarding the drought in New Mexico and\u00a0the fact that farmers and ranchers in Eddy County are selling water to oil companies, rather than using the water to produce and sell crops.\u00a0 [Read articles here<\/a> and here<\/a>.]\u00a0 This is a situation that is seen in Texas as well, as oftentimes the sale of water is more profitable than the production of crops or livestock.<\/p>\n

Critical<\/strong><\/span> advice for landowners\/water rights holders<\/span>:\u00a0 <\/strong>Anyone looking to sell water must ensure that he or she is complying with all state laws and permitting requirements.<\/p>\n

4.\u00a0 The U.S. House Energy Resources Committee recently passed a\u00a0bill that proponents say will lead to increased oil and gas production in Texas.\u00a0 H.R. 1900 would require federal agencies to either accept or deny applications for pipeline projects within one year and, if no decision was rendered during that time, the application would be approved by default.\u00a0 [Read article here<\/a>\u00a0and read full text of the bill here<\/a>.]<\/div>\n

5.\u00a0 Concerns regarding fracking and earthquakes have been in the news in the past week.\u00a0 First up, USA Today published an article explaining that\u00a0the disposal of water used in\u00a0fracking has been linked to a rise in the number of earthquakes.\u00a0\u00a0 According to geologists cited in the article, the wastewater used in fracking increases pressure on quake faults when it is disposed of\u00a0in deep disposal wells.\u00a0 [Read article here<\/a>.]\u00a0\u00a0 Second, an article published in Science<\/em> by researchers at Columbia University explains that earthquakes in distant locations, such as China or Japan, may actually set off small tremors near oil-drilling sites in the United States.\u00a0 Specifically, researchers pointed to tremors that occurred in Texas, Oklahoma and New Mexico.\u00a0 [Read news article here<\/a>.]<\/div>\n

6.\u00a0 Lastly, the USDA has decided to re-examine a rule that would require a magician to develop a disaster plan for the rabbit he pulls out of a hat.\u00a0 Marty Hahne, a Missouri magician, received a letter from the USDA that sought to enforce a new rule by requiring Mr. Hahne to develop a disaster plan to save his rabbit should a fire, flood, tornado, ice storm, or power failure occur.\u00a0 The rule (see full text here<\/a> and FAQs here<\/a>) applies to warmblooded animals\u00a0bred for commercial sale, used in research, transported commercially,\u00a0or exhibited to the public.\u00a0 After Mr. Hahne’s story was published in the Washington Post, the USDA announced that the rule would be reviewed and “common sense” would be applied.\u00a0 For now, however, the rule requires Mr. Hahne to have a disaster plan in place by July 29.\u00a0 [Read full story here<\/a>.]<\/div>\n","protected":false},"excerpt":{"rendered":"
